The kid’s goat was sold against her will at a 4-H auction. Whatever contract existed was nullified by the kid’s exercise of her right under a California statute that allows minors to repudiate contracts. The county fair went ahead and auctioned her goat anyway.
The winner of the auction was the GOP nominee for governor, but based on currently available public information, he’s not the bad guy in this. He, at least, knows a public relations disaster in the making when he sees one. After being contacted by the girl’s family, he waived his claim to the goat and the fair was informed of this.
Fair officials decided to confiscate and execute the goat anyway. They sent two sheriff’s deputies on a wild goat chase fivecounties away, outside of their jurisdiction and where they have no law enforcing authority, armed with a search warrant obtained under false pretenses, and acting under color of law forcibly seized the goat which was the subject of a private civil contract dispute at premises other than those specified in the search warrant, then delivered it to third parties who, as far as I can determine, had no colorable legal claim to the goat and who chopped it up into barbecue meat served to 4-H kids the next day.
California statutes describing in very specific detail what is to be done with property seized pursuant to a search warrant were not complied with.
The lawsuit doesn’t name the sheriff’s department, only a lieutenant and two detectives (the two deputies who seized the goat) in their individual capacities.
Somehow I have a feeling this isn’t going to turn out well for these livestock rustlers.
My guess is the jury award will be somewhere around $75,000 for comp damages, the punitive damages are anybody’s guess, and although Shasta County is a hotbed of alt-right craziness, if this was done without the constitutional sheriff’s knowledge or approval, the international publicity now descending on his office seems likely to get the rustlers a personal interview with the boss that begins with the words, “You fuckups …”

I’ve always said the only thing really holding back Libertarians is the Libertarians.
Once you fight your way through their thicket of “reason” you inevitably find yourself face to face with a desperate emotional cripple deprived of familial love and nurturing. None of them, aside from the occasional sociopath, is remotely equipped to deal with the complexity, nuance, and basic cruelty of the world they yearn for.
In every case you find yourself in a dismal trap where you can either disengage the pointless debate, or confront them with their own crippling emotional emptiness. Either way you are the lesser for it.
Put simply, we can never have the stripped down, free will, dynamic interplay of self-seeking individuals that Libertarians long for because of all the Libertarians. And everyone else too.
Humans really are not the rational, cost/benefit analysts we pretend we are. None of us works that way. None of us. That isn’t how we make decisions. It isn’t how any of us lives our lives. It is not what guides our successes or determines our failures or our life outcomes.
But it is funny that so much of our culture is devoted to propping up those enduring myths. Throwing yourself from a tall building is an act of sheer desperation. But then again, so is agreeing to manipulate the price of a publicly traded stock. The very same man who made those desperate, emotional decisions is the man who rose through the ranks of corporate climbing titans to be chosen to lead a massive organization of people in a global retail empire.
The owners and board members who chose him, the fellow executives he surpassed, the host of people who helped him in his rise, and all the people he climbed over, were and are all weak, fragile, frightened, and very emotional creatures. Take a moment this morning to carefully observe something that the corporate, sensationalist media are very clearly overlooking for some reason.
In his ceaseless shit-spew and spin defending himself from criminal charges for his obvious violations of felony criminal statutes, Trump and Trump’s idiot-minions have consistently maintained that “he declassified all of it”. This is tailor made for the 24 hr sensationalist news media because it provides content for debate. An endless stream of “subject matter experts” can be trotted out of the makeup rooms and into the studios to preach the case one way or another, or to “educate” the audience.
The audience of partisans on either side are encouraged to take up sides and build their own “expertise” about classification levels and presidential powers. Each side can build their own confidence in the authority and virtue of their “legal” positions.
But stop for a second and consult the actual record of legal arguments made so far by the stakeholders (and not just the television noisemakers). In none (zero, zilch, nada) of the legal filings that Trump’s lawyers have made to any court so far have they even once merely suggested that these materials might not be classified. Not one single time.
Never have any of them mentioned any “declassification” of any of the documents. Not a word even implying it. The complete and total silence with respect to this major claim screams volumes to anyone careful enough to listen.
Because it’s a lie. The claim that Trump and his media surrogates make that he previously declassified everything is a lie. And none of the lawyers currently preparing these motions, responses, and lawsuits to the SDFL and the DC District are willing to swear and sign to a filing that they know contains lies.
It isn’t “souvenir lunch menus”. And it was never declassified.

My explanation of why I think Cannon’s order will be overturned.
The basis for relief is the presentation of irreparable injury to the privilege interests claimed by Trump in allowing the DOJ to continue their review (largely moot since the review is largely done). Cannon finds no adequate remedy available at law for any injury to Trump’s claimed privilege if the review is allowed to continue.
That’s incorrect.
Assuming the set of facts most favorable to the moving party, as is required of the court, whatever “executive” privilege Trump may be assumed to retain over documents recovered in the search is not at risk of irreparable injury.
If he is the rightful owner of any document retained for review by DOJ he can sue in federal court to get such a document back.
A remedy is therefor available at law.
If Trump is not the rightful owner of any document, and the document is retained in accordance with the PRA and NARA disclosure laws, then he suffers no injury.
If there is no injury, then he is not entitled to any remedy.
And if any so-called “privileged” material is used as evidence in any way as the basis for a criminal indictment against him he can move for that evidence to be excluded and for the indictment to be dismissed.
A remedy at law is therefor available.
It’s a delay, and not a very effective one. Nevertheless, I think DOJ should file for an immediate stay citing the national security interests and equities at stake. There is a very real risk of irreparable harm in having some rando Florida law school prof pouring over top secret national defense secrets in their basement study in Boca. She’s only 41. And she’s already plateaued. Within ten year’s time she’ll have become an insufferable burden for the other judges in her district and a black hole for her clerks.
Honestly, and I may be alone in this, but the prospect that a partisan SCOTUS would deliberately delay acting until summer of 2023 in intervening to grant relief from this ruling is more threatening with a good time as far as I’m concerned.
DOJ gets to keep right on conducting their investigation, issuing grand jury subpoenas, deposing potential witnesses under oath, and preparing to bring indictments. If the result is that an indictment naming Cheetolini comes down next summer or even later than that, I would regard that as a big assist. Let’s see him scheduled for trial in the same week as the convention. That would be awesome.

In the U.S. there are two kinds of courts: Courts of law, and courts of equity. They coexist side-by-side in the same court and judge. For example, a Washington superior court can exercise both law and equity jurisdiction.
The general rule is that equitable remedies can be applied only if there is no adequate remedy at law. An example of this is an injunction, which is an equitable remedy. An injunction may be issued to prevent an irreparable harm, such as a Forest Service permit to log an old-growth forest on public lands. A conservation group interested in preserving the forest has no remedy once the trees are gone.
As Elijah points out, Trump has law remedies if DOJ took documents belonging to him, or tries to use privileged information against him in a criminal case. A court can order DOJ to return the documents, and hold the information inadmissible.
When Trump tried to enlist the courts in his campaign to overturn the election, conservative as well as liberal judges proved a bulwark in defense of the rule of law.
The district judge in this case is not only a Trump appointee but also a Federalist Society member. She is presumed to decide matters before her impartially according to the law. It is further presumed that if she is mistaken as to the law, a higher correct will correct her.
If she proves to be serially incompetent and constantly reversed, then pursuant to longstanding custom the presiding judge will, as Elijah suggests, permanently assign her to the federal district courts’ equivalent of hearing traffic fines and noisy lawnmower cases.

It’s certainly a wild order. And the universe of legal scholars ripping into it are well justified in doing so as I see it.
I’ll just say one more thing about it, for now.
Legally, the impact is probably very minimal. That’s likely to prove a very sick practical joke on Trump. Lots of attention still needs to be paid to who Cannon appoints and what instructions she gives to them. But unless those instructions are wildly unlawful (in keeping with this order) and unless DOJ has been lying on the record for months about how they’ve been proceeding with their efforts to recover the stolen documents, their ongoing criminal investigation can withstand an outside review. Though very wrongly decided, ignoring significant precedent with respect to executive privilege and making findings that are entirely outside the record and the law, it is nevertheless a practical order with respect to Trump’s legal interests as a future felon. The more the government bends over backwards now, the more certain we can all be later when Trump waddles into a courtroom wearing a waist chain.
As much as the order’s reasoning is demented, I wish I could say I was shocked or even dismayed. But news that a federal district court judge has got their head way up their ass is like news that rush hour traffic is heavy. We all know it, but for some reason the news still reports on it anyway. And it’s certainly never fun to have to explain to an otherwise good person that the judge fucked them in the ass. But judges fucking litigants in the ass is not exceptional. It’s just another Monday.
I think the good news may lie in how Trump is likely to react to this. He will regard this as a transformative, triumphal event, as he has every other time his malign interests have prevailed within a legal process. He will be buoyed by the news of it. He will consider himself and all his lies and whining victimhood validated by it. He will feel emboldened.
And he will launch his campaign.
