Not a very overwhelming statistic. Until you actually consider that since filing the indictment in August, there has been almost no information available to the media and the public responding to such polls to indicate what evidence Smith may or may not have. It’s been an incredibly well run, well managed, and efficient prosecution. The filings have all been precise, limited, direct, and responsive with very little narrative or extraneous detail. There have been no leaks or media plants. And the only leverage that Trump has been able to use to pry free information into the media has been limited to the idiotic immunity claims. And by their nature, those challenges will be very unlikely to produce any substance for Trump to leak into the media.
So 56% of people responding to the poll are sufficiently convinced that Trump is guilty of a conspiracy to use the office of the president to overturn an election he lost without seeing any of the key evidence.
That isn’t likely to get better as the trial gets underway.
Prosecution goes first. Smith seems like the type to be methodical. So the early days of trial testimony will be focused on explaining the conspiracy to the jury. Conspiracy prosecutions work like that. It’s not like a murder or a robbery where there’s an early conclusion that a crime was committed. Conspiracy prosecutions require first that the crime itself be explained for the jury. But once the prosecution has managed to explain to a jury that a crime was committed, at some point they will have to put on evidence that Trump participated in it. And we still have no idea what that evidence is.
The best guess I can offer is that there are witnesses who will testify that Trump authorized the criminal conspiracy to produce forged state certificates of ascertainment. And that Trump subsequently authorized by word or deed the effort to bring those forgeries to the Capitol and present them in order to defraud Congress in performing their official, constitutionally mandated counting function.
A lot of what has gone before in terms of media blather about this case has been produced by Trump and MAGAland to create the space Republicans will need to dismiss that evidence or to waive it away. But not knowing precisely what any of it is makes that preparation much more difficult. Trump world has not really been able to pre-cast that evidence as “flawed” or as “irrelevant” the way they want to. So without the audience having been prepared that way, how the audience responds to that when they learn it for the first time will be alot harder to control.

But by 2021 it was very clear that other Arizona Republicans wanted him dead. He was attacked and assaulted at the same events that he’d been attending for years. He was getting death threats at his home. As Maricopa County Recorder, by the time the 2022 election was rolling around Stephen Richer was forced by the unrelenting tide of Republican threats and violence to fortify his own offices and election facilities against Republican violence, for his own safety but especially for that of his staff.
He and his family have been forced to accept armed federal protection. He’s been subpoenaed as a witness in multiple federal criminal trials against fellow Republicans who threatened to murder him and his family. For his own safety and that of his political staff he can no longer attend Republican public events in Arizona. For safety, his staff has mostly shifted to work-from-home. But because in Arizona, as in most places, public employment is a public record many have quit and the office now relies on temps and contractors. For the modest public salaries the jobs paid, Arizonans could not justify continuing in jobs where major Republican public figures like Kari Lake, Blake Masters, and Mark Finchem were routinely stirring crowds of partisan Republicn voters with calls for their murder.
The violence is now a baked-in feature of Republican politics. Most Republican voters now view violence as a legitimate response to election losses. Those losses are only just getting started. And Republicans themselves stand to suffer the most from it.

This echoes what Liz Cheney’s book says, that Trump, Meadows, the White House lawyers, basically everybody, knew before Jan. 6 the election wasn’t stolen.
