    @1 Possible criminal and civil liability for the thief. Possible negligence claim against the government under the Federal Tort Claims Act. The Westfall Act bars lawsuits against federal employees individually for actions within the scope of their employment, even if they were negligent. That law converts claims against federal employees into claims against the government.

    The FTCA is a limited waiver of sovereign immunity. In any FTCA case, the plaintiff’s lawyer has to research whether the particular type of claim is allowed under the act. As in any tort claim, you must prove a breach of duty, actual harm, and damages. A quirk of the FTCA is that for tort claims it applies the law of the state where the tort occurred.

    I definitely have concerns that actions of the Trump administration, even if unconstitutional or unlawful, might be without legal recourse.

    However, Trump’s presidential immunity is only immunity from criminal prosecution. His actions could still be the basis of tort claims under the FTCA.

    The FTCA waives sovereign immunity for federal law enforcement, so if ICE deports U.S. citizens, they may be able to sue under the FTCA.

    As for identity theft concerns, I think the best hope for a remedy there is if federal courts step in and block DOGE’s access with injunctions. Mixed results on that so far, but judges are viewing Musk’s activities with skepticism.

    Funny thing about the FTCA:

    Plaintiffs must completely exhaust all possible avenues for administrative claims before they can even file under the FTCA. And as you know, discovery can only commence after.

    This has a few important implications.
    First, it leaves plaintiffs deprived of most of the documentation of government wrongdoing they need to establish their claims. And it leaves the timeline for any claims entirely in the control of the DOJ and the various respondent administrative agencies. This typically produces years of delay.

    That works out okay for a polluter suing the EPA. But it might not be really so great for an American citizen from Puerto Rico kidnapped and flown to El Salvador, or a single mother in Tennessee working two jobs while trying to restore her credit score after one of Elonia’s teenaged propeller heads gave her SSN to the Yakuza.

    2)If the Feds had to provide free credit monitoring even for about a year like some companies do for employees after a breach, the number of people affected, would be costly. The OPM breach, it was decades of employees getting letters, I remember getting one, and it was for my two weeks as a Casual Clerk for the USPS in 97.

    Would be great if SEPTA could get its regional rail procurement sorted out. Although the purchase recently cancelled was for locomotive hauled coaches, and that company should never have won the contract, especially since agencies can’t use federal funds now to buy from Chinese companies.     The Regional Rail division was cobbled together from the Suburban Services of two failing private railroads. About the only thing they had in common was the tracks were standard gauge. Reading and Pennsylvania culture still persists, although SEPTA did try to integrate them, using the City Center Tunnel that was built to connect them, but through running was later eliminated. Also, each EMU married pair requires an assistant conductor. Sometimes 6 married pairs can be coupled together.

    President Musk responds to judge’s order blocking DOGE access to Treasury payments system:

    Musk … offered a defense of the access in a social media post Saturday, saying that DOGE and the Treasury Department “jointly agreed” to requirements involving government payments, including that “all outgoing government payments have a payment categorization code, which is necessary in order to pass financial audits.”

    There are states women, blacks, other people of color, and LGBQT people shouldn’t live in, and teachers and health care professionals should avoid. Oklahoma is one of them unless you’re a Native American on a reservation, in which case the state can fuck off because you’re on federal land and they have no jurisdiction there.

    Oklahoma also has a high number of wrongful convictions. It’s dangerous for innocent people to be in red states, and Oklahoma has one of the worst criminal justice systems. That state is racist, too.
