    A retired nurse in Chicago never received the 2,000 catheters a company she never heard of billed Medicare for.

    And she’s just one of “450,000 Medicare beneficiaries whose accounts were billed for urinary catheters in 2023 … by seven high-volume suppliers, … accounting for nearly one-fifth of all Medicare spending on medical supplies in 2023,” for catheters that weren’t ordered, needed, and “were never delivered.”

    A company that billed Medicare $267 million for catheters over a 14-month period “is registered with Medicare to a street address of a house in El Paso. Its phone number goes to an auto body shop.”

    And how are these crooks getting the personal information of hundreds of thousands of Medicare beneficiaries? Hospital data breaches is one way.

    Looking at Metro’s proposed realignment on First and Capitol Hill when RapidRide G opens, the 10, 11, 12, and 49 will see a reduced frequency, but if executed well, they will give Pike/Pine a good combined service. Restoring the Summit Trolleybus route is a good idea, wire is still up. Some advocates even wanted the route number at time of suspension, but tge route has been renumbered several times going back to pre-Seattle Transit days. Would prefer a few more routes under wire.

    On tge Northwest Bus Fans Facebook page, a Seattle Transit/Metro veteran mentioned that in tge 50s, to replace some of tge 1940motor bus purchases, some war-purchased buses of dubious quality, and remaining buses they inherited from Seattle Municipal Railway, they bought 5 each from 3 manufacturers, ran them a year in response service, GMC got the contract for 100 buses, they kept the 5 from Twin Coach, and the Mack buses seemed too slow and they sold them off. None of those 3 still build buses, and Twin Coach is no longer around.

    One way to help Medicare’s solvency is to hunt down these crooks, arrest them, give them a fair trial, then make them kneel before a berm and have a soldier with a rifle remove the top of their head, which is what they do in China. On TV, of course, because the effort is wasted if you don’t make a public example of them. You wouldn’t have to do this very many times before the incidence of Medicare fraud would drop way off.

    Oh, I know we can’t do that, but Doctor Dumbfuck would love it if we could, because he’s all into summary verdicts and death sentences. If you’re going to do things his way, you might as well do it where it’ll accomplish some social good, instead of looking for innocent black kids or border asylum seekers to execute the way Trump does.

    Better hospital data security would help. So would more robust Medicare verification and tracking. But all of this takes money, and nobody wants to spend money to save far more money, as the GOP’s virulent opposition to hiring more IRS staffers to catch rich tax cheaters demonstrates.

    Besides, if they cracked down on Medicare fraud — billions stolen every year — who knows, it might hurt their political donations. Just sayin’.

    Lots of people smell a rat. Mitt Romney, for one. And numerous legal experts have criticized Hur’s report as violating DOJ policy, and even calling it a “political hit job” (see, e.g., story here).

    If it is, and it sure looks like one, the timing is off. The election is 9 months away. A February surprise is much more likely to be a dud than an October surprise because over that time span, if Biden and Trump are the nominees, voters will have plenty of opportunity to see for themselves which one is better at standing, walking, and climbing stairs, and which one slurs words and forgets names and dates more. In that respect, I’d bet on Biden, because Trump appears to be in a state of rapid decline. You wonder if he didn’t recently have a mild stroke, maybe with a bigger one on the way.

This is a guy who meets in person with dozens of people daily, including Senators and Representatives from both parties, labor leaders, industry representatives, CEOs, military and intelligence officials.     From early on in his political career we heard reports of Trump’s incoherence, inattentiveness, confusion, lack of judgement, and emotional rages. It was documented almost daily throughout his presidency, from suggesting that we nuke a storm, or inject ourselves with bleach, to raging fits hurling food at walls. The catalog of first hand accounts from appalled eyewitnesses was continuous and appeared to grow worse over time.

    But other than implied criticism and wild speculation from political enemies, this novel length report from Hur is the first independent first hand account from anyone claiming that Biden’s memory doesn’t work.

    It is not credible.

    If the appellant fails to post the funds (cash or bond) by the deadline then their application for appeal is summarily denied on the rules. And once the deadline passes to file notice of appeal then the appeal is dead. These are fixed rules and deadlines in federal civil procedure.

    It appears that he has fired his lawyer. So in all likelihood he’s making stupid, angry, emotional statements because no one else will. And he is obviously very confused and frustrated by the federal civil requirements. He can’t find anyone to tell him what he wants to hear. So he’s saying it himself, out loud, and publicly in some kind of vain conviction that by saying so he can make it so.

    If the defendant simply refuses to pay the judgement then the plaintiff has to go back to court, usually before the same judge, to seek a new order to have the original judgment enforced upon the defendant. The process is like a normal motion hearing. Both sides get to brief and argue the motion. Plaintiff will argue that if nothing has changed since the judgement was entered then it remains valid and binding. And then they argue methods available to the court for enforcement, such as seizures, sales, garnishment, etc, citing previous enforcement actions from the same court as supporting precedent and authority.

    It should go without saying that if def has the funds to satisfy the judgement, or can obtain them in a reasonable time frame, then they have considerable incentive to do so and avoid enforcement. It’s almost always better for the def to avoid turning over control of their financial assets to the court.

    But that’s not the same thing as refusing to meet the procedural deadline for noticing of appeal. The “penalty” for missing the deadline is the appeal dies. That starts another clock (I think 90 days but don’t quote me) before either the parties reach an agreement or the plaintiff can file their motion for enforcement. That motion gets calendared in the civil docket (which can be slow in a court like SDNY). The risk of a penalty like contempt is rare honestly, and would not begin until after that enforcement order was entered. Then it would require that the def willfully defied that enforcement order or sought to obstruct the court from carrying it out.

    Chadwick liquidated assets and moved funds into (at that time) secret, off shore accounts beyond the reach of the court. He did so after judgement had been entered and in anticipation of enforcement in order to thwart enforcement.

    Trump would not survive 14 years in prison without access to diet pills, sleeping pills, stimulants, hair products, spray tan, spanx, and bacon cheeseburgers.

    To speculate about what’s really going to happen (beccause fun!) as the procedural deadlines and processes make plain, it can be a little while from an entry of judgement in a case to the actual transfer of any money. Defense attorneys use that to their client’s advantage if they can. But of course the circumstances control.

    Still, what often happens is that immediately after entry (if not sooner) the two sides meet and attempt to negotiate a quick settlement if they can. At this point they’ve already been through settlemtn negs pretrial and then the trial, so both sides have a good understanding of the terrain. Generally the def offers a low ball quick settlement payable in full today. They may even show up with a check already made out. With giant, oversized jury awards like this one it isn’t at all unheard of for the plaintiff to take the money and run. IIRC Carroll’s original settlement offer pretrial was $5 million. So many plaintiffs and their attorneys would be quite happy with maybe two times that.

    But what I know about Carroll and Roberta Kaplan tells me they are not in this quite so much for the money as for the chance to punish Trump The Rapist. They know that if they are patient and willing to hold out that most of the award is likely to withstand appeal. Habba is an idiot. Throughout trial she waived her client’s right to object or to note exception in the record when her objections were overruled. Those issues are now lost to appeal. Thus the scope of any appeal in this case has been substantially narrowed by Habba’s incompetence as a lawyer. So dangling the threat of appeal is a much less effective a tactic here.

    Moreover, the longer the case drags out pending appeal the more Trump The Rapist is punished by that underlying adjudicated fact of law that Donald J. Trump raped E. Jean Carroll. He’s too dumb to get that. Carroll and Roberta Kaplan are not. And I can’t help but imagine that they’d like to see this serve as an example to other asshole rapists like Trump. So I don’t imagine that they are super receptive to any low ball offers from Trump The Rapist at this point.

    But given everything we know about Trump The Rapist in these kinds of situations that’s what he’s almost certainly doing. Everything is transactional and nothing is principled for Trump The Rapist. And he probably doesn’t even understand how Carroll and Kaplan might be unreceptive to negotiating a low settlement. To him if it isn’t about the money, then it isn’t about anything at all. So at this point he’s negotiating at a considerable disadvantage and missing all the sign posts on the way. They understand him far better than he understands them. I don’t think he’s used to negotiating from that position.

    So my guess is he will eventually post bond to keep his appeal alive and he will file notice. That will keep the case alive well past the November election. And Carroll and Kaplan will use that to inflict maximum punishment on Trump The Rapist. They’ll have plenty of other opportunities to make money from this, from media appearances, essays, speaking, books, documentaries, etc. The sky is the limit. A Netflix dramatization including a reenactment of the actual rape itself would be very possible. There is literally no legal impediment to that. They could hire someone like James Austin Johnson to portray Trump attacking Carrol in a dressing room in Bergdorfs and violently jamming his puffy, sweaty fingers into her vagina. And there is no legal recourse available to Trump to stop that.

    You can literally count the votes being lost.

    Then sometime later next year Trump will lose the appeal and the judgement will go into effect. By then he’ll be a broken man, having already been convicted in criminal trials in DC, Florida, and Atlanta. He’ll have squandered vast sums on those trials and appeals. But the Carroll judgement will have been secured by a bond.

    The only people I feel sorry for are the bond holders. He will almost surely default.

    The 122 page response contains only two potentially relevant paragraphs.

    In one of the two paragraphs a former business associate of Nathan Wade is described as being a direct fact witness to a romantic relationship existing between Willis and Wade prior to Wade’s appointment in November of 2021. As described in Merchant’s filing the testimony this witness would give is hearsay. This witness did not personally observe any facts either supporting or denying that the personal, romantic relationship between Willis and Wade existed before Wade’s appointment in November of 2021. Instead the witness is described as having heard Wade make a statement attesting that the relationship existed before his appointment. It contains no quotes. It contains no detail. It does not purport to describe the information the witness would provide to the court. It does not specify what the witness is said to have heard. There is no affidavit. If the facts as described by Merchant were true they would be relevant insofar as they would demonstrate that Wade and Willis willfully misled the court about their relationship in their filed response to the motion when they stated that their more personal, romatic relationship did not begin until 2022. The mere existence of the relationship would be irrelevant, as a matter of law in Georgia.

    In the other paragraph a former employee of the Fulton County DA’s office is described by Merchant as having shared a place of residence with Willis until the fall of 2022, aproximately one year after Wade’s appointment. Merchant states that this former employee will testify that Wade and Willis regularly stayed together at this residence until the employee’s employment was terminated in the fall of 2022, again aproximately one year after Wade’s appointment. This paragraph contains no other relevant dates or descriptions of events or circumstances. As described in Merchant’s filing the witness statements would comport precisely with the time frame described by Willis and Wade for when their personal relationship developed. Again, the mere existence of such a relationship is irrelevant to disqualification under Georgia law. Only the intentional false or misleading statements about the relationship would be. This witness, as described in Merchant’s filing, does not offer any evidence in support of such a conclusion.

    Given the gravity of the misconduct alleged by Merchant, accusing Willis and Wade of lying to the court in their sworn filing, it is frankly unthinkable that a responsible officer of the court would file such a response omitting such important relevant detail unless that detail was not available to her.

    Either the witnesses described to the court are unable to give true and accurate testimony providing the crucial detailed information relevant to the underlying motion, or they can and Merchant declines to include that detail because it would doom her motion.

    Including the precise details about dates, places, statements, etc. would render this filing a very powerful document that would certainly convince the court that the hearing must take place.
    Omitting the precise details renders this filing almost moot and potentially fraudulent.

    There are only a few credible ways of explaining why Merchant would intentionally omit from her response to the show cause order any useful or relevant detail establishing that Willis and Wade lied in their filing from one week ago last Friday.

    This is an attorney engaged to defend her client and vindicate his legal right to a fair trial. And she is pointedly alleging once again that her client’s rights in that regard are implicated by facing these two across the aisle or across the table. She is arguing that, at a minimum, these two attorneys must be disqualified in order to ensure her client’s right to a fair trial. Beyond that, she is ultimately arguing and attempting to establish a record, that her client’s indictment is improper and unfounded and that the charges against her client should be dismissed.

    These are very serious felony charges. Her client will spend down a great portion of his personal wealth and savings in defending himself if the trial goes ahead. And if he is convicted he stands to go to prison for decades, which might include most of the rest of his life. An attorney engaged to defend Mike Roman has the highest duty to provide him with every conceivable and legitimate defense available. And given the nature of the relief sought by the original motion there is no circumstance that would justify the withholding of information from a filing that might result in the charges against your client being dismissed. Or at the very least to obtaining disqualification of the prosecutors and the charges being moved to what is guaranteed to be a venue more favorable to your client. The stakes can not be any higher. Nor the duties incumbent upon the attorney.

    If such an attorney had specific, detailed witness statements that could establish with credible certainty that these prosecutors lied in their filing to the court then that attorney would have a duty to their client to supply those details about that testimony at the earliest available date. If the defense attorney withheld such information from the court, information that is very likely to move the court to disqualify the prosecutors, open up an investigation into the propriety of your client’s indictment, and begin the process of moving the case to a new trial venue, then that defense attorney would be in very serious breach of their ethical and professional obligations not just to their client but to the court itself.

    There is no value to her client to be had by slowly teasing out this kind of information. And there is incalculable risk and potential harm, to say nothing of the financial cost of slow walking it. This filing from Merchant is now the fourth filiing she has made to this court regarding her original motions. It has been a month. In that time Mike Roman’s reputation has declined, his conduct as an attorney while working for the Trump campaign has been called into question, the peril of his criminal trial has grown nearer, and he has been suffered to pay gigantic legal bills for his representation in this matter.

    If Mike Roman’s attorney Ashleigh Merchant has obtained detailed witness statements establishing that the prosecutors who brought this inductment have lied to the court she would have produced those statements and delivered them to the court.

    This is likely a charade. It is a charade formulated to play upon the television expectations of media dumbshits who think that “surprise evidence” revealed in “dramatic moments” is how criminal trials work. They do not.

    In nearly any actual criminal trial all the evidence that ever will be presented has been entered into the record even before the jury has been seated. There are no surprise moments where witnesses confronted by a skillful attorney break down. A Few Good Men is a fantasy. This artificial and contrived effort by Merchant is intended to produce media speculation filling in all of the critical detail that she has intentionally omitted.

    We should not be fooled. Nor should the court.

    According to the IDF the operation took place around 1am local time. Forces from the Shin Bet special operations unit, the Israeli Police counterterrorisn unit and IDF navy seals arrived at a building in the heart of Rafah where the two hostages were held
