    The DOJ’s sentencing memo for Proud Boy Joe Biggs includes excerpts from interviews and testimony from Biggs that DOJ argues show his intent to mislead, and harm the FBI investigation into the Jan 6 attack that they hope will substantiate an obstruction enhancement to his sentence. Among these interviews Biggs informs the FBI agents that during the period from the election leading up to Jan 6 he was “meeting regularly” with an FBI handler from the FBI’s Daytona field office who hoped Biggs could act as an informant on “Antifa” for the FBI, and with whom Biggs had numerous meetings and conversations in which Biggs described the Proud Boy activities going on during that period. That being the period in which Biggs and other Proud Boy leadership were forming their elite, secret “defense committee”, and organizing their attack on the United States Congress.

I’ll bet a fair number of those still patronizing restaurants see “20% service charge” and think of it as the tip, see no reason to tip 20% twice, and the end result is tipped employees aren’t tipped. There are several ways to think about this, including the following:

    1. The 20% is no accident; it intentionally looks like a tip.
    2. The restaurant is diverting tips into the till.
    3. It’s a 20% wage cut for the tipped staff.

    It all comes down to what I said @16, to wit, every new business model that comes along has as a key element paying less for labor by cutting wages and making employees work for less pay. This scheme fits that template perfectly.

    Guest count is down.
    But there is mixed data regarding the assumption that these potential diners are saving any money. A high percentage of diners responding to price and fee signals in restaurant settings by opting to dine at home are substituting take out, prepared foods, and home delivery meal kits. Many such options are actually more expensive, or yield massive reduction in quality.

    But it’s such a chaotic environment that the truth is hard to ever know. What we can know is that some distinct and growing groups of American consumers are losing or abandoning their ability to prepare their own food.

    The professionals who prepare their food for them (and serve it to them) have more leverage right now than at any other time in our past.

    Every time some wunderkind from the business schools propagates a new business model, it’s based on lowering wages. Nothing ever changes.

    Reminds me of something I read in the late Joe Coulombe’s memoir, the founder of Trader Joes.

    He thought he’d interview a newly hatched Stanford MBA for a job. This was sometime in the 70’s or probably 80’s many years after the start of TJ in 1967. Coulombe wanted to get a sense of the latest thinking from his alma mater’s business school.

    He related to her his policy of employee compensation. Stanford and probably all business schools teach that a policy is a “standing decision”. But to Coulombe, his employee compensation policy was something deeper. If growing his company could be compared to waging a war – the most reasonable as opposed to optimal employee compensation policy was a fundamental strategy to prevailing – through any curve the economy would throw at the business. Reasonable vs optimal. Tenacity trumps brilliance. Coulombe read a book by Barbara Tuchman about WWI and read that although the French and the Germans had brilliant military staffs both sides deviated from their initial war plans and the war became a quagmire. He thought of that book as the best book on management and mismanagement he’d ever read.

    So what was his employee compensation policy? Pay every employee well – the median California family household income.. In 1967 it $7,000 and by the time he wrote his memoir it was $40,000. And even though he didn’t anticipate so many women entering the workplace starting in the late 60’s – he stuck with the policy. He never deviated.

    Why did he do that? One reason I saw was gratitude. Trader Joes was originally called Pronto Markets and originally a division of Rexall Drug Stores and about to be spun off so its owner, Justin Dart, could go big into the very profitable Tupperware business. Coulombe leveraged himself to the gills, borrowed from family members, got some bank financing and persuaded a bunch of Pronto employees who believed in him to put up their own meager savings.

    Another reason was more business school oriented.. Every school teaches that the biggest labor expense is NOT wages.. It’s employee turnover. The solution to that headache to Coulombe seemed so obvious – pay your employees well, make sure they’re productive, problem solved. Businesses that do that are the great exception and it’s not easy. Coulombe admits that to maintain that policy every other policy flows from that – from store siting, to leasing decisions, merchandising and pricing – almost everything. But he got the most loyal and dedicated workforce one could imagine in the bargain.

    So what did the Stanford MBA think of that? She told him: “Joe, you’re doing all the wrong things for all the right reasons!”

    She didn’t get the job.

For all the hoopla associated with the hippie generation, they mostly fell into very traditional roles as far as domestic life is concerned. But a common element of aging is that the traditional home maker in a couple wants to retire just as much as the traditional bread winner. So what happens with both spouses fully retire? The meal preparation at home stops as well.

    Previous generations solved some of this by moving into adult/assisted communities or joining a country club with a lot of those meal preparation services provided. But Boomers are aging at home a lot more than predecessor generations. So they’ve been dining out a lot more too. And now that is catching up to them.

    We could of course easily import cheap labor to “fix” all of this.
    But ironically the very same Boomer generation is the most vehemently opposed to the importation of cheap labor unless the imported laborers can be confined, monitored closely, and preferably sterilized so they never have children who require public schools and compete for doctor’s visits.

    So I’m not sure there’s any way to comment on Weiss’ conduct without venturing into some speculation. But since speculation, and frankly bizarre MOON LASER conspiracy peddling is all Republicans have left when it comes to DICK PICS, what the hell.

    But first a recitation of the known facts may be in order.

    David Weiss was appointed to serve as the United States Attorney for Joe Biden’s home state by President Trump. We know by now that as President, Trump made such appointments strategically, and that throughout his presidency, but certainly by the time of Weiss’ appointment Trump was obsessed with former Vice President Biden as a potential re-election challenger, reasoning quite correctly, that Biden would easily kick his ass. And by the time of Weiss’ appointment by Trump the campaign had already begun to put in motion it’s efforts to produce a Ukraine based smear campaign targeting Joe Biden, and employing Rudy Giuliani as Trump’s “personal lawyer” to head up that project for him the following year.

    As United States Attorney for the District of Delaware, it fell to Weiss to take on various aspects of the investigations into Hunter Biden when the tampered laptop hard drive file was first produced by the Trump campaign and Giuliani. Right away there were, and still are, legal evidentiary obstacles that would prevent the laptop files, such as Giuliani produced them, from every being used as evidence in any criminal proceeding against Hunter Biden. Large sections of the files and file structure are unable to be authenticated owing to the alteration of the contents subsequent to those contents no longer being in the possession and control of Hunter Biden, and presumably while they were in the possession and control of Rudy Giuliani. Other portions of the file contents have been confirmed to have been added into the contents after Rudy Giuliani first obtained possession and control over those contents. Thus tainted by alteration and corruption the laptop would not be able to be introduced as reliable evidence to any jury or other criminal hearing.

    This fact would have left Weiss and his investigators to attempt to produce the same or similar evidence via parallel construction – that is to determine and authenticate whatever evidence they can of any criminal wrongdoing that they discovered from the corrupted laptop contents from other independent sources. We may safely assume that Weiss would have subpoenaed all appropriate sources for records that might provide that parallel construction. Those sources would include IRS filings and other federal and state governmental records, ISP and mobile phone provider records, search engine provider records, messaging app records, social media account records, personal and business banking records, credit card, debit card, and other purchase records, and personal and business accounting records. With those records and any other leads they might have produced they could then determine most of Hunter Biden’s whereabouts, communications, movements, and activities for the relevant time period dating back to the Obama administration. That evidence produced from parallel construction would then be admissible as evidence.

    In May of this year attorneys from Weiss’ office approached Hunter Biden’s criminal defense attorneys to propose discussions and negotiations for a plea agreement and a prosecution diversion agreement. Those negotiations initially proved fruitful and resulted in a proposed settlement that was presented to the Delaware district court on July 26. The settlement and agreement required for Hunter Biden to waive jurisdiction on some of the criminal charges and allow the matter to be heard in Weiss’ district. It was the understanding of Hunter Biden and his lawyers at that time, and based on affirmation from attorneys from Weiss’ office, that the agreement would provide him with immunity from further federal criminal charges relating to the matters included in the plea agreement and the accompanying diversion agreement. The agreement as documented and as filed to the court referenced the diversion agreement, even though such a diversion agreement falls outside of the jurisdiction of a federal court.

    The inclusion of that diversion agreement by reference into the plea agreement being sought caused Judge Norieka to pause the proceedings and engage in further inquiry among the parties. Initially it was her purpose to determine if the diversion agreement could legally be included in any plea agreement for her to consider. Then subsequently she sought further inquiry into whether the diversion agreement needed to be referenced. Her inquiries of the parties into the purpose and necessity of the inclusion of the diversion agreement into the plea agreement led to the discovery that Hunter Biden and his defense attorneys had become misled about the future status of immunity that the plea agreement would produce. We don’t know if they were deliberately misled. But the judge became substantially alarmed and frustrated over that, since it would be her obligation under any such plea agreement to certify that the defendant entered into the agreement with full knowledge. Good federal judges (Aileen Cannon notwithstanding) actually care about reaching final outcomes that do not produce gigantic errors, especially when those errors deprive the accused of due process – due process is a judges main job.

    So then Weiss notified the DAG that it was his intention to seek appointment as a Special Counsel under that statute so that he could proceed to trial in whatever venue – the waiver of venue having gone out the window with the rest of the plea agreement. And because of the loss of the waiver of venue Weiss also filed to dismiss some of the charges in Delaware, since without the waiver that court would lack venue jurisdiction. The Attorney General approved the appointment. In the interim, in contemplation of the dismissal of the charges in Delaware, Hunter Biden’s lead defense attorney removed himself from the case and Abbe Lowell was entered. This is because Hunter Biden contended in his filing to the court ahead of the dismissal that one of Weiss’ attorneys, prior to the Juyl 26 hearing, had attempted to significantly narrow the scope of the immunity granted. His attorney in that interaction, Chris Clark, thus became also a witness to those alleged facts and can no longer both serve as Hunter Biden’s attorney and a witness for Hunter Biden in any claims about the events that caused the collapse of the plea agreement. And that’s basically where things now stand in terms of knowns, with the previous charges filed in anticipation of the plea agreement dismissed, the diversion agreement on gun charges signed and filed in June still standing, and the two parties potentially in dispute about the previously signed criminal diversion agreement on gun charges.

    Now for the speculation. Since becoming Attorney General one of the many laudable accomplishments of Merrick Garland has been to restore some integrity to the DOJ by really putting a lid on all the unauthorized (and frankly even authorized) communications with the media. Obviously an investigation like this one (or any of the Trump grab-bag) are very newsworthy and sensational. There is tremendous pressure and frankly plenty of inurement on offer from giant global media companies courting leakers. Further complicating that is a Republican House committee and its staff attempting every public and private back channel means at their disposal to pry loose any detail to be used for political purposes. It’s noteworthy that all the leaks about Trump’s criminal adventures have come from Trump himself. But alas, as Weiss’ tenure and this investigation precedes Garland, it has not been so with the Hunter Biden investigation. And while “senior law enforcement officials close to the investigation” may have earned themselves a future in network television or as a lead staff attorney for an Oklahoma cow farmer, they have almost certainly complicated things for Weiss in terms of his aims and objectives going forward from here.

    It would be very ironic if that same “senior official” turned out to be Weiss himself in at least a few cases.

    There are reasons Weiss instructed his lead attorneys to approach Biden for a deal. There are reasons Weiss scuttled the deal at the last minute. And those reasons are now free, and very likely, to come out in criminal discovery ahead of any criminal trial wherever the Special Counsel may choose to file it. None of those reasons will be persuasive in getting the diversion agreement vacated. And the more Weiss or his subordinates attempt to clean the shit off themselves by placing more leaked details, especially false and misleading details about their investigation into the media as they struggle forward from here, the worse this will get. All of Donald Trump’s and his corrupt DOJ and White House appointee’s imprecations to Weiss to bring charges will be available to the trial defense. All of Devin Nunes’, Gym Jordan’s, Stupid Cow Farmer’s, and Stupid Corn Farmer’s pleadings and pressure campaigns will get entered into discovery. And Clark, who represented Hunter Biden throughout the period when Weiss was stalling in a decision and yielding to pressure, notified Weiss through formal presentations of his intentions to seek discovery from DOJ and Weiss in particular about the sources of the many Weiss leaks that somehow found their way into the news media and into the hands of Stupid Cow Farmer staff. As we now know, such leaks involving a grand jury information are illegal. But moreover, they provide the credible and persuasive evidence of a powerful political campaign to persuade sway a prosecutor making a charging decision.

    I think Weiss fucked this thing up, just like Giuliani did. Maybe he’s a drunk or megalomaniac like Rudy. Or maybe his weak willed and succumbed to pressure. If I had to I’d guess the later. Those are precisely the qualities that Donald Trump and Jeff Sessions would have been looking for.

A member shared some old photos of an odd bus model Seattle Transit repurposed after its revenue service days were over. I asked if it was a holdover from the days when operators could give change, but turns out the coin changers were issued in a different room. These were for depositing the farebox reciepts at the end of the day.

    Learned more from the member about the transition to exact fare in 1969. Did the operators and union oppose it? Apparently, they were all for it. The reason was, several robberies between 67 and 69 including one murder over the coin changer. He said it was $50-60 in the device, adjusted for inflation, that was about $500. I can see why they were relieved. The current Metro Farebox, a model dating back to the 90s, seems well mounted on the bus. Tge HistoryLINK article about the first day of exact fare, mentioned management was surprised about the transition being so smooth, that they couldn’t believe it. Although the fine for not having the exact fare was just an IOU slip where the rider would pay twice the fare next time.

    The old Northgate mall was the first of its kind when it was built in the early 50’s. The very first although some mall in MN gets the credit for the first enclosed indoor mall. Now it’s dominated by the Seattle Kraken’s training facility, a public ice rink, a sports bar and a few other retail shops and restaurants – completely different although I rarely shopped at the old mall. It was ok back in the day to have a choice of three department stores, a hardware store, a toy store, some restaurants, food court and other retail available close by when you needed them. Some more barely affordable multi-unit housing and office space are going up over the old footprint. Will I miss the old stuff? Sure.. I just said I didn’t shop there that often but there’s still some good memories there.

    Seattle has always had “exclusionary zoning and sweeping development restrictions,” which today if anything are more accommodative of greater density than in the past (there’s a massive amount of apartment construction in my neighborhood, plus cottage developments and backyard auxiliary living units are springing up, but $800,000 starter homes is a new phenomenon. I would argue one of the drivers of that is an influx of high-salaried tech workers whose home greed is freezing everyone else out of the housing market.

    Years ago, during the heyday of exclusionary zoning and development restrictions, a home selling for $1 million made the local news. Now, you have to pay $1.4 million to be one of my neighbors. And, needless to say, I’m surrounded by neighbors who work for the likes of Amazon and Google.

Then figure in all the various layers of citing restrictions and other land use limitations that were built in from the start, and the underlying land value is probably double what it might be without all the limitations. Put it all into the spreadsheet and what comes out is a design spec demanding luxury condos instead of affordable apartments.

    There is much anger directed at foreign buyers. They feel foreign buyers swoop in and steal homes away from locals and offer to rent them back to the locals. Locals cannot compete with cash buyers.

    However foreign home buyers are small compared to hedge fund, ibuyer companies. Banning foreigners buying US homes won’t solve the problem.

    The real cause of housing problem is houses are being used by investors as an investment. So despise of affordable housing shortage, there are plenty of empty houses in the markets.

    The only real solution to housing problem is the government needs a new law to limit real estate investment.

    1) there is upward movement of people in their prime earning years
    2) there is family expansion during reproductive years, requiring square footage expansion
    3) there is downsizing by people who are entering their retirement phases of life

    so there will always be empty dwellings awaiting their arrival.

    For this healthy mobility to occur, there must be emptiness. An empty house means nothing just as an Asian surname as owner means nothing.

    Unless you need to fan the flames of xenophobia by turning it into something, girlfriend.
