The agreement does require IDoT to reimburse for capital costs, that does include rolling stock. Tgere is precedent for commuter rolling stock in Chicago to be adapted for Intercity use. The Chicago and Northwestern used them on the Peninsula and Flambeau 400s, and the Burlington in the later years adapted a few to use on the Denver Zephyr in busy seasons.
