    As requested by plaintiff in their motion, both plaintiff and the defense were allowed in Judge Cannon’s order to name two persons they would prefer to serve as the Special Master. Then each side was allowed to file a response stating any objections they had to the other side’s named persons.

    In the Plaintiff’s response they objected to both of the people named by the DOJ. In the DOJ’s response they only objected to the other person named by Trump. They said in their response that they were okay with Dearie.

    So since Trump named Dearie and since DOJ said they were satisfied with him, that’s who it is. Trump forfeited any objections to the person of Judge Dearie when he offered him to the court as one of his two preferred persons.

    But Trump may still object to the orders issued by the Special Master. And every part of the Special Master’s orders and proposed schedules goes before Cannon for her review.

    Given the remarkable rebuke that Judge Cannon’s final order received from the 11th Circuit, I think there’s a good chance she is going to treat Judge Dearie’s orders and schedule with considerable respect. She may be feeling a bit sorry for herself at this point. But if she looks around for somebody to blame, it isn’t going to be the DOJ. They took a very limited and very respectful approach regarding her shitty final order.

    But they also were very strategic and by leaving open all the other options, by agreeing to Trump’s choice for the Special Master, and by only seeking immediate relief from the documents where Cannon has no credible jurisdiction, they put her and Trump in this box.

    This weeks episode of the Handmaid’s Tale was continuing the story arc with June/OfFred trying to settle into exile in Canada while looking for ways to get her older daughter out.     Recently, CalTrain showed the public the Stadler KISS EMUs that will soon be running along the Peninsula Corridor. Much better design than the EMUs used in Denver, Chicago, New Jersey, and Philadelphia. Just wished Siemens had an FRA compliant model, so the distance being delivered by diesel locomotives was shorter. Sacramento is a lot closer to the Bay Area than Utah.

    As for the delivery of the EMUs from the Utah Factory, would have been great to have had it pulled by a diesel paired with a battery electric, but it was BNSF not UP, and UP owns all the lines out of Utah. BNSF has been, or will be testing battery electric locomotives, from both manufacturers, paired with Tier 4 Diesel-Electric locomotives.

    Although traditional overhead electric locomotives are better for electric freight, as they are proven, this is an interim step. Current locomotives generate tons of energy during braking, but there has been no way to harness it with Diesel-Electrics. Traditional electrics can send it back into the overhead for the next train to use. Battery electrics could use it to recharge. Although GE proposed a hybrid version of the Evolution, but freight railroads didn’t want a smaller fuel tank so more batteries could be added. Progress Rail and GE’s successor Wabtec have come up with a better solution. When paired with a Tier 4, the BEL becomes a battery tender.

    In my estimation the most likely grounds for conducting an impeachment hearing will be immigration/border. They can’t cite any specific criminal or official misconduct. But the wording of the constitution allows for the House to approve articles of impeachment against a president for lesser shit, that basically boils down to them claiming that a president isn’t fulfilling the duties of the office.

    That could mean almost anything to people who believe that a space laser has been hidden on the dark side of the moon, or that Bill Gates is planting tiny robots in your bloodstream. So what will matter will be what kind of show it would allow Republicans to mount for their audience members, with the understanding that Republicans now consider Congress to be a television program. So they’re just working on next season’s lineup.

    But BORDER CRYSUS is one narrative theme they’d like to take into their convention in 2024. Cat food doesn’t work because it’s really not something a president can directly change and having a bunch of economist talking about interest rates is terrible television.
