In general the broad categories that constitute the basis for a federal criminal appeal are evidentiary – the government’s evidence was not adequate to prove the case, due process – the defendant was denied certain rights the denial of which are very likely to have changed the verdict, the trial itself was in error – the federal rules of criminal procedure were not followed, or the judge made an error with respect to the law, again the result of which error is very likely to have changed the verdict.
Pay attention to the shit in italics. That’s important.
An appeal based on the evidence is very unlikely here. It’s quite cut-and-dried. The committee issued a subpoena. The defendant refused to respond. The jury was presented with documents and witness testimony to prove those claims and found them credible and persuasive. There wasn’t any other evidence presented. Appeals don’t second guess juries.
The defendant was not denied any of his rights in any way. He was informed of the charges against him, his first appearance and arraignment were by the book, criminal discovery was fulfilled, he was represented by legal counsel, he was able to confront the witnesses against him. And the big thing about these grounds for appeal is that in order for an appellate panel to intervene the appellant must demonstrate to the panel, with evidence, that the trial outcome was changed by the denial of rights. It’s a very high bar and one that is seldom met. Prosecutors know this and fuck around with it all the time. It’s a key part of our system.
That leaves trial procedural errors and judicial errors concerning the law. Errors in criminal procedure are rare in normal cases. They would be incomprehensible in a high profile case like this. DOJ and the District follow the rules very carefully. They do this all day every day anyway. Normally something has to be really fucked up for a procedural error to have arisen. And again, the appellant must show the panel that the error in procedure changed the outcome. So it can’t be something trivial. Finally there are judicial errors in applying the statute in accordance with the procedural and local rules.
That last bit is Dirty Hobo’s only shot IMHO. And once again, the appellant bears the full burden of proving to the panel that the judicial error they claim changed the jury verdict. So mere speculation about trial rulings from the judge don’t cut it. You’ll probably see a scrum of law school profs holding forth about how “this judge made mistakes”. First, they don’t really know shit. These guys make boat motor money to go on television and present strident, aggressive, and decisive legal positions as “common sense”. Hemming and hawing with qualifying statements doesn’t make for engaging television. Second, any mistake interpreting the statute, by itself is not enough. This isn’t Paper Chase and nobody fucking cares what John Housman thinks. Where Congress writes statutes leaving issues open to human interpretation, and where binding judicial authority about the law is absent, the trial judge decides. End of story. Deal with it. If law school profs want to debate it that’s fine. But only Congress or a binding appellate decision can change it by clarifying the statute.
This is a seldom applied statute that I don’t believe has seen any revision in over a century. It won’t surprise me at all if there’s lots of room for interpretation in the context of the modern legal world. But unless the same issue can be cited with binding authority to another case, that leaves it up to Dirty Hobo’s trial judge to decide. I think the last such case to actually go to trial was in the 1940s. It’s not a promising resource.
If we simply look at Dirty Hobo’s predicament in the light most favorable to Dirty Hobo I don’t think it looks good at all. So let’s say he argues that because Trump’s lawyers played him, and would not definitively release him from all claims of privilege, he had to protect himself from those claims arising under a lawsuit. Weighing against that he has his own legal counsel and House counsel informing him that privilege does not apply. And also informing him that even if it did, it would have to be deliberately and specifically invoked with respect to certain questions from the committee, or certain areas of knowledge claimed to be covered by the privilege. So in other words, even if the claimed risk of being sued was real, and even if Dirty Hobo possessed personal knowledge about communications covered by some valid claim of privilege, there is still no risk for Dirty Hobo to appear and answer other questions, only invoking privilege with respect to specific question in relation to specific privileged information.
He wasn’t acting like a powerless citizen trapped between powerful government or political forces and interests. He was acting in a deliberately defiant manner. If he had an appeal in mind from the very beginning, he would not have behaved with deliberate defiance. He would have sought to comply to the best of his ability. I think that makes it very hard for an appellate panel to conclude that this verdict would have ever turned out differently, no matter what the judge decided about the law.

I leave open the possibility that there may be some actual instances of an illegal immigrant, or for that matter any non-citizen casting a ballot. Because I think that our system is open to that possibility. And I think that it needs to remain that way.
In at least a few states that allow election day registration, depending on the ID requirements, it would probably be possible for a non-citizen to present themselves with fraudulent documents and cast a provisional ballot. This is by design. Because such ballots are set aside and excluded from the canvass until the registration and ID can all be verified, there’s almost no risk of a ballot cast using fake ID.
So I think there exists a very small chance that a non-citizen might manage to obtain and cast a ballot. It just won’t ever be counted. Even the wife murderer and Mark Meadows’ illegal ballots were not counted.
It mostly just shows that “stolen election” stories are just that. And Republicans in general have fallen victim to a crippling wave of delusional paranoia that can’t be quantified or even comprehended.
In truth, is somebody wanted the best opportunity to “steal” any election in the United States they would do what Trump and GOP lawmakers did in December of 2020 and January of 2021. The electoral college, and in particular the “winner-take-all” state laws create a vulnerability to precisely the type of fraud that the GOP undertook. Any successful fraud scheme doesn’t have to try to change huge numbers of votes. Instead they have to try and change much smaller numbers of votes in a few key states, which is exactly what Trump demanded:

So-called “moderate” Republicans want desperately to sustain the myth that Christian Nationalism represents a marginal faction of their party with little influence. But in fact these Christian Nationalists are the only faction of the party getting things done and making any real progress in advancing an agenda. And the Christian Nationalists know it. They will never be content to retreat into the background. Not without a fight.
In order to win key races in close elections “moderate” or “mainstream” Republicans have had to embrace, adopt, and promote the agenda of the Christian Nationalists over every other party interest. The Christian Nationalists see this and recognize the power they wield over Republican voters.
Right now heading into the midterms and beyond the Christian Nationalists and other extreme elements of the Republican Party are feeling triumphant. They have achieved major victories through the conservative majority on the Supreme Court, they have transformed the rhetoric and positioning of the Republican Party, and unprecedented numbers of their candidates voicing their concerns and speaking directly to their issues have won important Republican primaries and will appear on the ballots in November.
I don’t think it’s possible to say for sure just how dominant they will become. And I think there still remains a possibility that the majority of Republican lawmakers and voters will successfully reject this ideology embracing religious and racial bigotry, intolerance, and authoritarianism. But they won’t ever manage to do that without a significant confrontation within the party ranks comparable to 1964.
In the midst of such a confrontation there exists a strong probability that candidate Trump would, just as before, move to outflank his primary opponents early and often. With only a will to dominate and defeat his opponents, and devoid of ideology beyond personal gain, I don’t think Trump will hesitate at all to wrap himself in Christian Nationalism.
The media will denounce the rhetoric. Even the traditionally conservative media will distance itself from such campaign rhetoric, exactly as they did in 2015 and 2016. But if Trump can once again persuade a large enough segment of primary voters that his campaign is more “honest” and “less phony” than the other Republican campaigns, how the media treats him won’t matter in 2024 any more than it mattered in 2016.
The only question is how will the rest of the Republican primary field respond? If they begin their campaign positioning with more moderate appeals, and only begin to shift more and more to the right in response to Trump, the way many did in 2016, they play right into Trump’s hands. But can they resist that? Or as an alternative do they instead begin their primary campaigning right out of the gate with a full-throated embrace of Christian Nationalism instead?
I don’t believe Youngking style Republican candidates who stick to a more moderate image will have a chance (see JEB!). With so much of the party political rhetoric in general focused on “saving” America from “destruction” by Democrats, they will be perceived as weak by voters and portrayed as weak by their primary opponents. I think that leaves defeating Trump relying on an early embrace of the more extreme Christian Nationalist ideas and rhetoric to prevent Trump from controlling the flank.
I’m actually quite sad to say this. I take absolutely no pleasure in it. But I do think it is more likely that in the next two years the Republican Party will become more politically extreme, not less.

This is not about Virginia voters and it’s not about general election voters either.
It’s about how the 2024 primary contest could potentially drive the Republican party even further to the right than the 2016 primary did. Virginia general election voters don’t figure into that nationwide party primary battle. Two things that made a big difference for Youngkin were that he did not have any credible or competent primary opponent outflanking him to the right, and that his general election opponent achieved Clintonesque levels of vagueness.
I think Trump will run. I think he will be very well funded even before the Russians pitch in. And I think he will immediately enjoy strong support from a significant number of Republican primary voters and quite a few Republican national leaders. But I also think he’s a one-trick pony. He’s very likely to follow a pattern and primary campaign strategy nearly identical to 2016. If I’m right I think that means he’ll move very far to the right of the rest of the field. But 2024 Republican primary field will not resemble Glenn Youngkin vs. Pete Snyder.

The results can be interpreted more than one way. If enough black voters turn out to make the oversampling become an accurate prediction of voter participation, the Democrat candidate could win. In this respect it’s a carrot, of sorts.
To me, that’s the most optimistic interpretation.
A more realistic interpretation is that it’s done to mislead the low-information voters like Steve has become, so that these voters think their guy has a chance and they show up to pull the lever for all of the other Democrats on the ballot, in other races.

Oversampling in cases like this is to correct for potential inaccuracies that may result when a small sub-set of the surveyed sample is not statistically well represented in the sample.
Sample size is mostly driven by budget. All other things being equal, a larger sample size will improve reliability of a survey. But quality sampling is the most expensive part. And there are diminishing returns. So public opinion researchers often rely on smaller than optimal samples to limit expense, but make scientifically valid adjustments to the sampling methodology and data to compensate. If an overall sample size is small, let’s say 100 participants, and a sub population happen to only make up 3% for example, surveying only three individual participants from that sub group can produce bad results. Over sampling is a mathematical technique as much as a sampling technique. A larger number of participants for a targeted sub group is calculated to produce a more statistically representative sample of that group. But the over sample is only used to model that group. So if 5 individuals are surveyed instead of 3, the responses of those 5 individuals are used to model the 3% that they are calculated to represent in the overall total 100%.
Over sampling like this is a common technique for a couple of reasons. First, there can be a strong interest in knowing the opinions of sub groups within the whole. Second, some sub groups are much harder to survey than others.
For example, old white retired homeowners are much easier to survey than young minority recent college grads who rent. And interesting corollary to all this and something that may be worth noting is that many very hard to survey sub groups who might be of unique interest and who might alter the outcome of elections are seldom over sampled. One example of this might be non-college educated white first time or infrequent voters in Blue Wall states in 2016.
I wish to point out that over sampling is a very common technique in medical research and something a real doctor would be very, very familiar with.
