What if the Catholic schools couch crosses himself or goes out to the 50 yard line and prays before or after the game. Is that not then the school establishing religion. Using your logic it is, I think it’s not, and that this lies in that gray area between church and state and the individual has some wiggle room. The appeals court only denied an injunction it never heard the case nor allowed other appeals. There is certainly other cases where other districts have said school employees may pray over their lunch, wear a Yamakah,, wear a cross, ect. That these personal displays of faith is not the school establishing religion. Now maybe just maybe the school really thinks he is a lousy couch or a so so couch and decided this was the way to fire the man. The behavior lasted from at least 2008 to 2015 so maybe he was a winning couch for 6 years. I think it would be appropriate for the Supreme court to hear the case, but more likely they will just tell the appeals court to allow an appeal. IE a punt where the appeals court must hear the case. Then if the court rules in favor of the school and with these other appeals courts having ruled differently (ruling with the employee) then it’s ripe for the Supreme court to take up an appeal.

Just comes to profitability, unfortunately that leaves large stretches of Washington and a lot of rural Florida out of receiving those services. And yes the private transportation folks would love to get their hands on the crown jewel of AMTRAC, the northeast corridor, and would jettison the rest for just the jewel and the profitable route. AMTRAK runs into the issue of being public and having to serve all of us, and not just the profitable areas, but cannot garner enough political friends to receive the money it needs to expand. But they did find another 70 billion for the US military. 10 billion to AMTRAC would go a long way, and a billion to the post office for the retirement fund would really help a lot and keep postage down. The coach (not “couch”; couches are inanimate objects that people, dogs, and cats sit or sleep on, and don’t file lawsuits) file a lawsuit against Bremerton School District (“BSD”). An injunction was the relief sought. He lost his lawsuit and appealed to the 9th Circuit Court of Appeals, where he lost his appeal. The opinion addresses the merits of his First Amendment claim. If this was only a procedural decision on a procedural motion — it’s not — he couldn’t appeal it to SCOTUS, because the appeal wouldn’t be ripe. He can. I told you before, Shortbus, stop trying to be an amateur lawyer, you’re no good at it. And for god’s sake, don’t attempt to do surgery on yourself, either. Stick to what you know how to do, washing dishes or mowing yards or driving a delivery truck or whatever it is.

@38 As an attorney you know the injunction was so the school system had to reinstate the coach while the lawsuit went through the appeals process. It did not rule on the merits of the case. It denied the injunction, and denied the appeals. I’m not all sure the Supreme court will act as it gets to pick and choose, and the justice this goes in front of may do nothing, the court could do something, and I think most likely the court will punt and tell the Appeals court to do the appeal, with or without the injunction which was to reinstate the coach pending review. The court could agree to hear the case, only then to punt and tell the Appeals court to hear the case and instate the injunction pending outcome of appeal. All of which has nothing to do with Professional football players, and you confabulating public and private. I don’t know if the coach will prevail in the 9th circuit if they hear the appeal, but he has pretty good chance of winning at the Supreme Court, or there are going to be some other cases overturned, and individual school teachers and employees are going to be told they cannot wear a cross, wear a Yamakah, ect as that somehow is the state supporting one religion over another, because they are displaying their religion, NFL players would not be affected by the ruling as they work for teams that are private profit making concerns, who has contracts with those players, and can dictate very much what those players can and cannot do on the field. Much of that will be driven by ratings, and if ratings are good then players will get to kneel or strip naked on the field ect. Or if ratings go down, the players will be told do this and do it this way, it’s in your contract. If you don’t you are fired, if they do it they will be fired and then your original analysis is correct. Only the coach does not work for a for profit corporation, he works for the school which is part of government, and while it’s ok for a corporations to squelch free speech, it’s not cool for the government to do so even with employees. Even if you put on the Uniform you do not loosed your first amendment rights.

I just find the whole thing unreasonable, unless there is some other reason, or his team was not winning enough games on Friday night and the school could not get out of the contract. Or another person wanted the job opened up.

Ever heard of chain-of-command? Trump is the commander-in-chief, but can’t give orders to an Army private. He can fire Rosenstein, and Rosenstein can fire Mueller, but Trump can’t fire Mueller, at least there’s reason to believe courts wouldn’t uphold it, although we don’t really know for sure.
As for whether Congress can access Mueller’s investigative files, the answer is complicated. Not directly, because Congress has no supervisory authority over Mueller, who is an executive branch official. Congress has subpoena authority, but there are some legal impediments to using it in this context, and subpoenas are only as good as courts’ willingness to enforce them.
