    That may help explain why all 6 FEC commissioners’ terms have expired and no one has replaced them.

    The FEC currently has 4 acting commissioners — 2 Republicans, a Democrat, and an independent — all of whom are holdovers whose terms have expired.

    It takes a quorum of 4 commissioners to transact business, and 4 votes to approve any action.

    This means a unanimous vote is required to approve anything, and if one more acting commissioner leaves, there will be no quorum and no business transacted.

    I wish that guy luck with his lawsuit. If the court issues a writ of mandamus ordering the FEC to act on his complaint, and the commissioners vote on whether to accept or reject his complaint, a single vote against accepting it will result in it being rejected.

    That doesn’t look like an airtight litigation strategy to me, but I’m just a rabbit with a law degree and 40 years of legal experience.

    Any reason why Trump hasn’t nominated 6 people to fill the vacancies? Any reason why the Republican-majority Senate hasn’t confirmed them?

    A surtax on real estate sales by the wealthy is not collected until a wealthy homeowner sells. The higher the capital gain, the greater the disincentive to sell. This creates problems in at least two ways:

    1. The collection of the tax is based solely upon the whim of the wealthy homeowner. If there is no sale, there is no tax. This has been discussed before on HA, when WA state was considering a capital gains tax. I pointed to the rationale of California, which correctly saw that the consistency of surtax revenue inflow related to a capital gain wholly under the control of the seller would not be advantageous.

    2. A surtax perceived as burdensome could interfere with home sales in general. If older and wealthier people choose to stay put, there is less inventory available for the younger cohorts of the population to purchase.

    Additionally,
    3. A surtax would be a disincentive to taking up residence in Seattle in the first place. This would increase my property value, but would also increase commuter volume and associated wear and tear on the infrastructure and, alas, the environment.

    You want a tax that can be collected now and is aimed squarely at the wealthier Seattleites, Goldy? Impose a special sales tax that hits only higher-end restaurants within the Seattle city limits. An extra 15% on the bill should about do it.
