Parties make deals, sometimes strategically rank the rival they know over the competition from within their own side of the aisle. American advocates want it up to the voters wether they rank at all.

    Clayton County Georgia is a small rural county in N Georgia surrounded by nuthin with a population of about 290,000. Believe it or not their county attorney’s office has a small staff with no particular expertise in criminal appellate practice and a very small budget. So they farm out this work to locals.

    Deborah Leslie is a Clayton County local nobody practicing mostly real estate law.
    She got the work because she bid low.
    My guess would be she assigned the briefing to a recently licensed hourly contract associate with no experience in criminal trials, much less criminal appeals. And they did what kids do these days and turned it over to AI.

    Has nothing to do with Democrats, presidential politics, or Newsom.

    But at least the lying troll has consigned himself to his fate of losing in 2028.

    Criminal appeals work like this: each side prepares briefs that are presented to the court of appeals having jurisdiction explaining why or why not the original trial was somehow in error. These briefs are accompanied by the original full trial transcript. The briefs consist largely of citations to other prior appeals that resulted in precedent rulings that favor a finding by the court of appeals for whichever side presents that brief. Criminal appeals in general almost exclusively rely on convincing the court of appeals that some kind of error on the law or due process was committed by the original trial court.

    The local real estate attorney the Calhoun County DA hired to prepare the briefs and argue the appeal included material falsehoods in her briefs consisting of citations to rulings in other cases on appeal that do not exist, or of citations to rulings in other cases on appeal that do not contain the precisely quoted language in their rulings that the briefs claimed. That’s not a constitutional deficiency. It has nothing to do with the due process the appellant is entitled to. It would be a legal deficiency, insofar as any court misunderstood the law by relying on those erroneous briefs.

    That’s actually very unfortunate. Because it may not support a finding in favor of the original appellant. Although it should support a finding to vacate the lower court of appeal’s ruling, and granting the appellant a new appeal if the lower court relied upon false information about the law in reaching its decision to rule to uphold the original conviction.

    What this entire episode amply demonstrates is just how incredibly tilted our system is in favor of obtaining convictions against the accused, regardless of the law and regardless of the facts. And also how incredibly tilted our system is in favor of upholding those convictions no matter how materially flawed they may be. In every respect, law enforcement and criminal justice in the United States does not reflect the way they are portrayed to us in the media, whether it be “news” media or entertainment media. The original appeals court simply grabbed their assigned handle on the meat grinder and gave it a few turns.

    Our system runs on aggresively railroading accused persons based very often on minimal and conflicting evidence, extracting guilty pleas at minimal effort and expense, and blindly pursuing process towards a preordained outcome, then defending that outcome regardless of the facts or mitigating circumstances. It does not produce “justice”. Nor quite obviously does it produce public safety. It produces lots and lots of jobs, vendor contracts, bureacracy, income, professional titles, status, and profesional opportunities for those who work within the system, primarly those who work to obtain indictments and convictions. It’s bloated, inefficient, and enormously harmful to the communities of American citizens it targets.

We understand Republicans are stupid enough to vote for him anyway, out of partisan loyalty, but Fetterman owes Mullin no partisan loyalty if he wants to keep calling himself a Democrat.     Even though the tremor’s profile was identical to a nuclear test’s — shallow and of short duration — it could’ve been a natural earthquake, which are known to occur in that area. There’s a fault line there.
