While investigating the threats allegedly made against the vice president, federal agents discovered multiple digital files of child sexual abuse materials (CSAM) in Mathre’s possession.

    Important detail hidden in the ususal gaslighting noise: the admin venue shops the fifth and carefully cherry picks cases to appeal there.

    By statute, nationwide injunctive relief of administration interpretations of the Illegal Immigrant Reform and Immigrant Responsibility Act of 1996 cannot be applied to classes. What this means is that similarly situated immigrants denied habeas may not be joined in a class. The result has thus been many thousands of individual cases currently plodding through the court processes in dozens of venues. One of the reasons why the administration has been on a panic stricken fast track to build out detention facilities in Louisiana, and one of the reasons the DHS very quickly transfers detainees to these detention facilities in Louisiana is to obtain jurisdiction in the favorable circuit. And despite losing literally hundreds of district level rulings on the very same question of how the administration interprets IIRIRA, the administration carefully selects only just the right cases with just the right fact sets to appeal to the circuit panel. So out of all those cases, with all those reversals from all those district judges, including more than a few of the most respected and influential, this one goes to appeal before the preferred venue and gets a split panel decision from the two most laughed at circuit court judges in the U.S.

    The gameplan for all this from the beginning has been to prolong the legal uncertainty about the truly tortured way the administration has chosen to define IIRIRA in a way that actually defies 29 years of stare decisis and many hundreds of previous judicial rulings.

    This is in fact why the Fifth has become the most reviewed and overturned circuit. It is being used to drag out the charade. But now that charade has reached its terminal stage. The plaintiff appellees now have the option to go straight to the SCOTUS. And if SCOTUS denies cert they can opt for an en banc review at the circuit. But if cert is granted, and if the court reverses the fifth circuit yet again, as it has grown increasingly comfortable doing, it may also produce guiding opinion from the SCOTUS that would confirm the previously settled interpretation of IIRIRA and end the charade for good.
