It’s a busy evening for me so I’m sure to be a little late. First I’m heading down to Renton for a King County Democrats fundraiser for Darcy Burner (5:30 pm to 7:00 pm, Renton Carpenters Hall, 231 Burnett AVE N… you’re all invited), before rushing back to Graham Hill Elementary School for the district’s site hearing on school closures. I’m guessing I won’t get to the Alehouse much before 9 pm.

In other words, cross burning conveys a threat, while flag burning conveys only protest, dissent, or disrespect. Cross burning implies violence to come; flag burning does not. The First Amendment has never protected threatening speech.

The “fighting words” doctrine essentially says that epithets or insults which incite violence are not protected speech. This is an oversimplification; there is a complicated legal test.
The issue typically comes up in the context of prosecutions under assault, harassment statutes, or disorderly conduct laws. This is most likely to occur as a violation of a municipal ordinance.
An illustrative case is Seattle v. Camby, 104 Wn.2d 49, 701 P.2d 499 (1985), which involved a prosecution under Seattle’s harassment ordinance of a restaurant patron who invited a bouncer to “step outside” so he could “kick your ass” and threatened to return later if the bouncer didn’t step outside. And if you really want to get into it, you can research whether there is a “duty to retreat” before claiming “self defense”. In other words, if you are really faced with an imminent threat of death or injury and you have an avenue of retreat open, are you required to retreat rather than assault or kill the person who is threatening you? Hint: there is no “duty to retreat” in Texas (big surprise, huh?)
