But that would include some EDI (equity/diversity/inclusion) curriculum. Right? And basic health curriculum including sexual education about genital health, reproductive health, STDs, safe sex practices, etc.
You can pretty quickly see where this is going. And honestly, not to trouble anyone with tedious “legal details”, but since this shit only has to pass rational basis scrutiny, that also means the legislature can restrict some parts of the religious curriculum if it “rationally” deems them injurious.
Before you can say “Fuck Your Feelings” you’ve empowered the states to shut down all the parochial and private K-12 schools and require all the kids to attend “the government school”.
There is no enumerated right to hold your kids out of public schools. It’s not in the text. And there are no federal laws protecting such a right. It would be entirely up to the states.
And yet, Alito does not want this.

What possible good does a 13th Amendment do, without a 14th Amendment accompanying it? How much new value in rights accrue to newly emancipated former slave if the state wherein he or she resides can simply reimpose slavery by passing new laws and calling it something else? To be meaningful a right must be protected, enforceable, and it must entail a means of obtaining a remedy when the right is infringed. This is very fundamental. But we do continue to struggle with much of it. So to be free from slavery and recognized as a full citizen also includes important protections that are incorporated into the meaning of citizenship. But the lawmakers who passed the 13th Amendment were not a trusting bunch. Just to be safe they spelled it all out with a 14th Amendment.
We are not so lucky with the right to privacy. It is not spelled out. Some have argued (and I tend to agree) that the Framers deliberately refused to spell such things out, fearing that this would create narrow limits on rights they held sacred and considered to be universal and nearly unlimited. The right to privacy is certainly among those. But the fact that we are forced to work out for ourselves, through trial and debate, does not mean the right doesn’t exist.
So what is incorporated into an unenumerated substantive due process right to privacy? We argue that it includes privacy in individual personal decisions about reproduction at least as much as it includes privacy about what porn movies Bork rents. At least.

Moreover, Ali accurately pointed out that Perez scored a knockdown for Wepner that he should not have. Perez was well positioned to make the correct call.
