The US Government has disputes and controversies with China and Russia with regards to freedom of religion and treatment of missionaries. The act would apply.

If you commence correspondence with any foreign government or any officer or agent thereof, with intent to influence the measures or conduct of any foreign government in relation to any disputes or controversies with the United States, then the act applies.
Actually, under a closer reading, it could easily be argued that the dispute between Syria and Israel is not a dispute or controversy with the United States, so the act would not apply. There is no prohibition in the plain words of the act against a person doing any sort of negotiating as long as the United States is not a party to the dispute.
Yes, as Israel is a close ally, and our foriegn affairs are rather closely interwoven, that argument is splitting hairs, but the writers of the act didn’t envision us having that sort of relationship with any foriegn country.
The border dispute is between Israel and Syria. We aren’t officially a party to the dispute, so Speaker Pelosi can do any negotiating she wants between the two countries.
So the Logan Act doesn’t apply. Not guilty.

IS THIS “THOMAS HAYS” THE SAME AS THE ALLEGED SEXUAL OFFENDER FROM THURSTON COUNTY?
There may very well be a good reason why the State Department wants better documentation of the identity of “Thomas Hays”. There are only five people named “Thomas Hays” registered to vote in Washington. One of these is allegedly “Thomas Anthony Dean Hays”, allegedly born on November 30, 1968, who is registered to vote in King County. Presumably, the same person, since the fellow in the Seattle P-I claims to be 38 years old.
When I search for “Thomas Hays” on the statewide case name index for civil and criminal cases in superior, district, and municipal courts, I get four cases that are possibly associated with this same person:

As for case # 8, this appears to be the same 2003 arrest in Seattle that is mentioned in the full Seattle Post Intelligencer article. The charges were dismissed on August 25, 2003 and he wasn’t convicted of anything.
Interestingly enough, his date of birth is listed as November 30, 1968 on the state voter database, but as November 20, 1968 with Seattle Municipal Court. So it is possible that there is some confusion as to when he was actually born or who he actually is.
Much more alarming, of course, is the possibility that this “Thomas Hays” could be associated with Cases # 2 and # 5 on this list. It appears that someone named “Thomas Hays” was sued by a female petitioner in Thurston County District Court in June 2006 for a sexual assault protection order.
A sexual assault protection order is a protection order that an alleged victim of sexual assault can apply to the court to keep the alleged perpetrator away from them. It is designed for victim of stranger sexual assault who do not meet the “domestic relationship” requirement with the person who sexually assaulted her/him to qualify for a domestic violence protection order.
Whoever this “Thomas Hays” happens to be, it appears that he lost in district court and got slapped with a sexual assault protection order. He apparently appealed this order to Thurston County Superior Court, where no decision has yet been rendered on the appeal. In any event, one of the parties appealed, and I would bet dollars-to-donuts that it was the alleged perpetrator instead of the alleged victim doing the appealing.
The Seattle P-I article said that this “Thomas Hays” with passport problems is affiliated with The Evergreen State College, which happens to be located in Olympia, in Thurston County. None of the other four “Thomas Hays” persons are registered to vote in Thurston County, and I haven’t been able to find any other “Thomas Hays” with a logical connection to Thurston County.
I am not passing judgment on (A) whether the “Thomas Hays” with the passport problems is the same “Thomas Hays” involved in the sexual assault protection order proceeding in Thurston County, or (B) whether the “Thomas Hays” in the Thurston County court system should be found either civilly or criminally liable for alleged sexual assault.
All I am saying is that the State Department certainly has good reasons to further verify the identity of the “Thomas Hays” who is applying for a United States passport.

Even if he is the same “Thomas Hays” from the Thurston County court system, he may very well be legally entitled to a U.S. passport. There is a important difference between having a civil protection order based upon a sexual assault and being convicted of a sexual assault crime. Even if he were a convicted sex offender, he could still be issued a passport if there wasn’t a warrant for his arrest, and if leaving the U.S. didn’t violate any condition of his parole or other legal restriction placed upon him.
But just because a sex offender may have a legal right to a U.S. passport doesn’t mean that other countries are required to admit that person. Germany and other countries have the right to flag a sex offender, not allow them to enter on visa-free conditions that other U.S. citizens may otherwise enter under, place special scrutiny on any visa applications, and deny visa or entry entirely. They also have a right to place him under special scrutiny if they do decide to let him enter their country.
If this “Thomas Hays” is the same person involved in the Thurston County sexual assault protection order proceeding, the State Department will probably want to put that into our intelligence computers and share this same information with our friends and allies to go into their intelligence computers. So it should be extremely important to verify this person’s exact identity, so his liberties in other countries can be protected if he is not the same person, and the security of other countries can be protected if he is.

Poindexter resigned, and North was fired, but Iran-Contra was far from over. The press hounded the president: Did he know about these illegal activities, and if not, how could something of this magnitude occur without his knowledge?
