Monday Open Thread

The legislature adjourned Sine Die over the weekend. Some stuff passed that even recently seemed impossible: Rent stabilization, even if it’s not as far as I would like, and parking reforms especially seemed like impossible tasks just a few years ago.

And yet. And yet. Without a wealth tax, the budget is still cuts heavy. Shame.

I am still going to tell you to write to your legislator, but things aren’t as urgent now that the session is over.

    Having your phone number publicly available makes it much much much easier for someone, like say a hostile government agency or a bored kid with some CompSci knowledge to track your physical location and being in close proximity to a known phone makes it much much much easier to hack.

    DENVER (KDVR) — MyPillow CEO Mike Lindell and his legal team have to explain themselves to a federal judge in Colorado after she discovered a recent brief they submitted pointed to fake court cases as evidence.

    According to court documents, federal judge Nina Wang found about 30 defective citations in a brief Lindell’s legal team filed in February. The defects range from misquotes to “citations of cases that do not exist.”

    Court documents show the brief was generated by artificial intelligence.

    Entergy Louisiana says it needs to build a major new natural gas plant to power the facility.

    The utility wants permission to pass the plant’s construction costs onto its entire customer base.

    In Louisiana, a battle is heating up over who will pay for the new power plants needed to serve the $10 billion data center Meta is building in the state’s northeastern corner.

    Meta announced in December the 2,000-acre Richland Parish data center campus, which is expected to be completed in 2030. The company plans to use the data center to train AI models.

    @8 It’s pretty standard for utilities to put capital costs into their rate requests. Happens here in Washington, too, and whenever they try to pull that stunt, I submit a comment to the Utilities & Transportation Commission stating that if I have to contribute capital to the utility then I want shares of stock in return.

    The way it should work is investors provide the capital to build the facility, then state regulators allow a rate that includes a reasonable ROE. In other words, if I’m the customer, you provide money to build the generating plant, and I pay an electric bill that includes ~10% return for the investors.

    Making me pay for the plant, then charging me a profit for the shareholders, is a double-dipping ripoff. It’s even worse if I have to pay for a plant that generates electricity for a giant corporation.

    Even in Louisiana, folks probably aren’t dumb enough to fall for this scam, but corrupt state politicians and regulators in bed with the corporations might not leave them a choice. About all anyone can do is avoid living in a state that treats its citizens like that.

    “Rent stabilization” is just a euphemism for rent control. During wartime, price controls typically are coupled with rationing, are temporary, and are justified because government has diverted civilian production to military production. (Auto plants, for example, make tanks instead of cars.)

    Outside of wartime planned economies, price controls interfere with market mechanisms that bring supply and demand into balance; and typically reduce supply below demand, leading to permanent or long-term supply shortages. This is Econ 101 and common knowledge.

    Republican deregulation of residential mortgage lending led to the 2007-2008 crisis that brought homebuilding to a near-halt, resulting in a nationwide housing shortage that can only be resolved by a decrease in population, new construction in excess of population growth, or a combination of both. There is no quick fix, and bringing housing supply into balance with demand will take years.

    In these circumstances, temporary rent control might be justified to prevent price-gouging by landlords, but the devil is in the details. The Washington bill is 23 pages long and complicated in its details (read it here). And, as they say, the devil is in the details.

    From my quick perusal, it appears rent increases are capped for existing tenants, but landlords can adjust rents without limit on vacated units. If this reading is correct, it will have some tendency to reduce renter mobility by freezing tenants in place, because any tenant who moves will have to pay market rent in the new unit, instead of controlled rent in the existing rental.

    Under this bill, rent control isn’t automatic. If a landlord violates the rent cap, the tenant must complain in writing and give the landlord an opportunity to cure, otherwise the rent cap is effectively waived. By requiring tenants to affirmatively act to claim the law’s benefits, the law won’t help passive tenants at all. This probably means many vulnerable tenants — the elderly, poor, and those unaware of the law — won’t get any benefit from the law.

    The bill also exempts several types of rentals from its rent control provisions: Apartment buildings less than 12 years old; buildings owned by public housing agencies and nonprofit organizations, where rent increases are regulated by other laws; tenants in owner-occupied single family residences, duplexes, triplexes, and quadplexes. Not exempted: Single family houses rented out by mom-and-pop landlords.

    Another provision requires landlords to give tenants 90 days advance notice of rent increases. I didn’t take time to determine whether this applies only to rent-controlled units, but a quick reading suggests to me it applies to all renters.

    There is a separate set of rules, with a lower rent increase cap, for mobile home parks.

    The rent controls imposed by the bill aren’t permanent, in the sense they sunset or expire on July 1, 2040, unless extended by a future legislature, so you can argue this is a temporary measure for the time it takes for housing supply to catch up to demand. The general rent cap is 7% a year plus CPI, not to exceed 10%, which isn’t onerous during periods of normal inflation, so the bill mainly imposes an onerous paperwork burden on landlords in order to raise rent by any amount. Probably not enough to drive commercial landlords out of the business, but an additional hassle for mom-and-pop landlords that may take some rental rooms or SFRs off the market.

    My overall impression is this bill won’t solve the housing shortage, will slow it down, and while it creates powerful tools to prevent rent-gouging, it creates new burdens on both landlords and tenants. Whether it will help or hurt Washington’s housing situation remains to be seen, but my guess one of its effects will be to marginally reduce the supply of rental housing. It could, for example, encourage owners to convert apartments to condos, and lead SFR landlords to sell rental houses that become unprofitable.

At least for now until appellate court review of the injunction.

    A number of Christian men I’ve known have expressed discomfort at viewing nudity in high art. I don’t think they are prudish simpletons incapable of understanding the arguments distinguishing art from pornography; rather, these are honest men who care about honoring God and womanhood.

    I’m not suggesting we take a sledgehammer to Gian Lorenzo Bernini’s masterpieces or erase every living memory of them off the internet. However, as we create art, we need to reevaluate our long-held ideas and assumptions. The fact that celebrated works from the past contain nudity doesn’t justify us including it in our films, literature, and other mediums.     It’s useful to understand that the cuts under consideration would not be made to the purchase of Narcan (the inhaled version of naxolone), but to the HHS unit that hands it out.

    Narcan can easily be handed out by a different unit of HHS. Or grants can be made to states so that states may purchase it according to their individual needs. I think I read something about the DJT47 wanting to return power to the states. This would be an example of that policy goal.

    NDP and Liberal is enough. Add in the one green and if BQ wants to get anything out of the next couple years and you’ve got the Conservative party isolated and relegated to complete irrelevance.
