The 5PM Friday deadline is fast approaching, and so far no word from state House Speaker Frank Chopp as to whether he plans to let the Homeowner’s Bill of Rights come to the floor for a vote. If he does, it will surely pass by wide margins, giving owners of single family homes the same rights condo owners have had since 1990. If he doesn’t, than unfortunate homeowners like Scott Thalhamer will remain mired knee-deep in muck in the basement of his one-year-old home, barred by law from suing contractors for shoddy workmanship and code violations.
Even the Seattle Times agrees that this bill provides “reasonable protections,” yet according to KOMO-TV, one man stands in the way: Speaker Frank Chopp. Watch the video and see for your self, then dial the legislative hotline at 800-562-6000 and ask your representatives to ask Frank to let them vote on SB 6385.

@1 This isn’t Texas, and the oft repeated statement that you can’t sue your homebuilder is pure bunk. The fact that Sen. Weinstein sued and reached a settlement deal with his homebuilder and window supplier would seem to indicate that his claim that you can’t sue is in fact not true.
Poorly worded legislation can have unintended effects. Sen. Weinstein’s legislation doesn’t define what a defect is, nor does it define who a construction professional is. Lawyers will have a field day with this one.

@6 It’s not inconcievable that if you hire a contractor to build your home, and you make any decision about the design or materials that you could be considered a “construction professional” under this legislation. So three years later you sell the house, the windows turn out to have leaks, the new homeowner could sue you along with everyone else involved in the construction. That’s what I mean by having a field day. Broadly worded legislation without definitions of key terms will leave it up to a judge or jury to decide what it means.
For the guy with the flooded basement, he should sue his builder, which he’s currently allowed to do under WA law.

Home builders aren’t trying to “erect a wall” — nor are they trying to “take legal rights away.” This bill is all about trial lawyers attempting to create new ways to sue builders. Homeowners already have adequate safeguards. Passing this bill will only increase insurance costs for all builders. Those costs will be passed on to new home purchasers. This state can ill afford new regulations that will drive up the cost of housing.

You hit the nail right on the head. A builder is an entirely different creature than a mere contractor. A builder generally buys vacant lots from developer, builds homes from the ground up, and then (hopefully) sells the finished product to a new home buyer for a profit in the high five figures or even low six figures.
An argument can be made for treating home builders with softer gloves than condominium builders. However, the situation is similar enough, that new home buyers should be afforded some protections. They can be screwed worse than used home buyers — if you buy an existing home, it has been broken in, and the current owner likely fixed any problems and problems which still need fixing tend to be obvious, either upon lay inspection or expert inspection.
The homebuyers bill of rights also passed muster with the Seattle Times editorial board — a group of folks who usually tend to fall in the mainstream pro-business crowd (as opposed to the extreme pro-business crowd). So I will assume the proposed legislation is pretty sensible and balanced.

Frank Chopp is a dictator, it’s his way or no way. He sucessfully held up Tacoma Narrows Bridge construction for a year because he doesn’t like public private partnerships. A number of lawmakers, both state and federal, asked him to reconsider, but no.
So my guess is that he is going to hold up the Homeowners Bill of Rights until he gets a bill to his liking. That would be next year at the earliest. It doesn’t matter to him how much support there is for this bill.
