There is still a TRO in place ordering Fat Hitler to refrain from any Guard deployment in Oregon. Judge Immergut issued one original TRO when stupid Fat Hitler tried to order up the Oregon Guard. Then Fat Hitler tried to be cute and deploy the Texas National Guard. So Immergut issued a second TRO preventing any Guard deployment in Oregon.
The recent panel decision was in response to the first TRO. The DOJ intentionally declined to appeal the second TRO. It remains in effect. The DOJ is in court today asking Immergut to lift her second TRO in response to the panel decision rendered yesterday. She does not have to. But she might.
The fundamental issue has to do with specific findings of fact and how the 3 judge panel handled those, if at all. Immergut may conclude that the panel decision is not responsive to the findings of fact issued in her second TRO. And unless the DOJ can prove that the facts on the ground have changed since the ruling, which they have not, she may conclude that her second TRO remains valid and in effect.
Meanwhile the state is requesting an en banc review of the first TRO by the entire 9th circuit (and not just the 3 judge panel with two fascists appointed by Fat Hitler).
