The highest CEO compensation in America last year ws $1.7 billion. There were at least three people in American business who collected over $1 billion in compensation last year. We need to stop lying to our children about the value of hard work. Work is worthless! At least, that’s the value American business puts on it. People don’t get paid for working hard under our system. They get paid for being clever thieves. Our economy is based on the Republican value system. Apparently not, as he was never charged with such. He has been found liable in a civil trial for violating a duty of confidentiality. The court was very careful to state that the issue was that he violated a House ethics rule, rather than the law.

No again, the court was pretty careful not to claim that Mr. McDermott violated any law. Their ruling focused solely on the fact that he was given the tapes as a member of the House Ethics Committee, and as such, had an obligation to consider them to be privileged information.

Well, since I said “no” to both of them, and since the court seems to agree, I’d have to say he did not break the law.
I will acknowledge that, had the parties been switched, I would have been much more annoyed with Mr. McDermott than I am.
Of course, considering what was on the tapes, I would have been far too embarrassed to actually say so in public, and would have simply hoped that the whole issue would just go away.
So, yes, the court did find that Mr. McDermott did violate a duty of confidentiality when he let the entire world know that the architect of the neo-con movement, and the hero of conservatives was a liar and a criminal conspirator.
The court ruled that, as a member of the Ethics Committee, Rep McDermott had an obligation to consider the tapes to be priviledged information. Instead, he let the American public know that Republican Speaker of the House Newt Gingrich violated federal law. I’m sure that all the news stories coming out will prominently mention exactly what Mr. Gingrich was doing on those tapes as well. After all, we do want the whole story.
We should thank Mr. Boehner for making sure that we’re all reminded of the whole affair.

The complaint alleged that Representative McDermott violated 18 U.S.C. § 2511(1)(c) when he disclosed an illegally-intercepted conversation in which Representative
Boehner participated. The record developed in discovery showed the following.
On December 21, 1996, Representative Boehner participated in a conference call with members of the Republican Party leadership, including then-Speaker of the House Newt Gingrich. At the time of the conversation Gingrich was the subject of an investigation by the House Committee on Standards of Official Conduct, commonly known as the House Ethics Committee. Representative Boehner was chairman of the House Republican Conference. The participants discussed various strategies regarding how todeal with an expected Ethics Subcommittee announcement ofGingrich’s agreement to accept a reprimand and to pay a fine in exchange for the Committee’s promise not to hold a hearing.
On January 10, 1997, Clymer published a front-page article in the New York Times entitled “Gingrich Is Heard Urging Tactics in Ethics Case.” The article, which included lengthy excerpts of the taped conversation, reported the circumstances leading to disclosure of the tape
On cross-motions for summary judgment the district court held that Representative McDermott violated 18 U.S.C. § 2511(1)(c) when he disclosed the tape to the reporters.
Boehner v. McDermott, 332 F. Supp. 2d 149, 158 (D.D.C. 2004) (Boehner II). Section 2511(1)(c) makes intentional disclosure of any illegally-intercepted conversation a criminal offense if the person disclosing the communication knew or had “reason to know” that it was so acquired.
As Chief Judge Ginsburg wrote in the original appeal: “One who obtains information in an illegal transaction, with full knowledge the transaction is illegal, has not ‘lawfully obtain[ed]’that information in any meaningful sense.” Boehner I, 191 F.3d at 479 (Ginsburg, J., concurring) (alteration in original).
We do not understand Representative McDermott to be arguing that even if he unlawfully obtained the illegally-intercepted conversation, he had a First Amendment right to disclose the tape. See generally Boehner I, 191 F.3d 463; id. at 479 (Ginsburg, J., concurring).
In the Boehner case, as in this suit, a conversation over a car cell phone was intercepted, but in that case the defendant knew both who was responsible for intercepting
the conversation and how they had done it. In the opinion of the majority [of the D.C. Circuit], the defendant acted unlawfully in accepting the tape in order to provide it to the media.

The problem with your references is that they go back to the original, now vacated ruling. While the full court still ruled that Mr. McDermott violated Mr. Boehner’s privacy, they used different reasoning and did not find that any laws were broken.
Instead, they apparently went further, stating that if Mr. McDermott had not been a member of the Ethics Committee, with special responsibility to treat the tape as privileged, that he would have been within his First Amendment rights to publish the tape.
Your mistake is understandable, as the full decision of the court is not yet available (or at least I couldn’t find it), and the earlier (now vacated) decision is being referenced by Faux News on a regular basis.
Splitting hairs? Yes, I am. But that split hair is the difference between violating the law and violating a House rule.
There is the possibility that, once the full ruling of the Court of Appeals is readily available, that it will not say what every news agency has reported that it says. Stranger things have happened. There is also the possibility that the case will be appealed to the Supreme Court, at which point anything could happen.
My best guess is that Mr. McDermott will be satisfied with the ruling, as it confirms that no laws were broken, Mr. Boehner will be stuck with the ruling, as he technically “won”, even though the real hope was that the courts would rule that Mr. McDermott violated the law.
Faux News and NewsMax will continue to reference the now vacated ruling, as it says what they want to hear, and we’ll be reading references by the right wing types to that old ruling, and we’ll continually have to correct them, showing the ruling of the full appeals court that does not make the claim that a law was broken. For most of those right-wing types, the distinction will be much too subtle.
On one level, the right wing types will have a point, in that, if Mr. McDermott were a Republican, many of our posters here would ignore that distinction as well.
But, if the parties of all the players here were reversed, I wouldn’t be saying much about the whole thing, because the underlying cause of the whole thing (the information on that tape) would be way too embarrassing.

Why, for the same reason that your side thinks that taping by Ms. Tripp is good, and release of the tape of Mr. Gingrich is bad, of course. Neither side is entirely free of hypocrisy.
