  72. @40 So let’s say the defendant is blatantly guilty of hitting a federal officer with a hurled sandwich in front of numerous witnesses, all of whom cooperated with police and will testify against him, with the identity of the perpetrator not in question. Heck, let’s even say the suspect confessed to committing the deed after his Miranda rights were read to him.

    Assuming the officer wasn’t injured, under typical state laws this was at most an unwanted touching constituting simple misdemeanor assault, which normally would result in a fine.

    What about federal law? DOJ’s own manual says,

    Absent a statutory definition of assault, the courts have looked to the common law and have concluded that an “assault” is: An attempt with force or violence to do a corporal injury to another; may consist of any act tending to such corporal injury, accompanied with such circumstances as denotes at the time an intention, coupled with present ability, of using actual violence against the person. [Cit. om.] But, of course, an assault can also be committed “merely by putting another in apprehension of harm whether or not the actor actually intends to inflict, or is capable of inflicting that harm.”

    This seems to raise the question of whether an assault was committed at all, because it’s a stretch to argue that throwing the sandwich constituted “force or violence,” and a sandwich is incapable of inflicting corporal injury.

    Obviously where I’m going with this is, at least at first blush, it appears the case has been drastically overcharged. Let’s say the defendant is ultimately found guilty of misdemeanor simple assault and fined $500 and ordered to attend anger management class.

    Now let’s suppose he spent a large amount in legal fees defending against an inappropriate felony charge brought against him for what a jury could reasonably infer was political grandstanding purposes.

    My question is, does he have a tort claim against the government for malicious prosecution, or would a guilty plea or verdict on the simple assault charge preclude any legal remedy against the authorities for maliciously charging him with a much higher degree of crime than the evidence would support in the mind of any reasonable police officer or prosecutor?

    And if the answer is yes, would the result be different if instead of charging him with felony assault, they charged him with murdering the officer struck by the sandwich, even though the officer is alive and well?

    The point is, putatively DHS LE have some legal jurisdiction to conduct immigration enforcement and removal operations anywhere. Whether or not FBI, DEA, Secret Service, Fish and Wildlife, NPS, or U.S. Marshals have any such authority is unknown and unproven. But more importantly the kinds of operations going on in DC have no rational nexus to immigration enforcement.
