For a member of the court to intervene on behalf of one of the litigants is grounds for recusal in any other venue.

Maryland is the trad jurisdiction for the sitting CJ due to convenience. But Roberts’ intervention to cure a defective application is unwarranted and unethical. Moreover, nothing contained in the government’s application supports any claims for emergency relief – no claims of irreprable harm of any kind appear in the application. It’s a farce.
Based on simple principal-agent principles, the fact the U.S. is paying El Salvadore to imprison Garcia would seem to make the U.S. liable for anything that happens to him in the Salvadoran prison, in that El Salvadore is acting as an agent of the U.S. government.
Apart from that, Garcia would seem to have a whole card deck of tort claims against Noem, HHS, ICE, and other defendants: Kidnapping, assault and battery, false imprisonment, intentional infliction of emotional distress, violating his civil rights, defamation, etc.

Moreover, the order issued Friday morning with a deadline of midnight tonight provided the United States with several days in which to comply, including taking various easily reversible steps to prepare for compliance. They took none.
Lastly, and as the 4th Circuit stated clearly and eloquently, the order is facially not an intrusion into foreign policy. It is a court of law issuing an order arising from the traditional role of the judiciary to rule on the nature of the laws in vindicating rights in litigation before that court. And again, if the United States wishes to argue that courts may not exercise this role it bears the burden of supplying at least some supporting citations arising from more that Fat Hitler’s gaping asshole.
Mere claims are not arguments.

Claiming it “may not be possible” to get him back is an assertion by the noncomplying party, not a factual finding by the court. To render it factual, they have to ask El Salvador to return him, and facilitate his return — in other words, try to comply with the court order.
As an assertion, it’s of dubious credibility, given that El Salvador imprisoned Garcia at our government’s request and we’re paying them to do it. Ask for his return, stop paying them, provide a plane, and see how quickly they hand him over, because they have no reason of their own to keep him.
2. “would require the US to comply with an order by a judge with no jurisdiction on the case” — flat-assed false.
Two courts have ruled the judge has jurisdiction, and absent a Supreme Court ruling otherwise, that’s the law of the case. Your personal opinion does not overrule an extant court order. Neither does the stay, it merely pauses the requirement to comply.
3. “and represents an intrusion of the judiciary into US foreign policy” — hiring a foreign government to house our detainees isn’t “foreign policy,” it’s a contractual relationship. Since the goal is to save money, there’s no foreign policy component. But even if there is, Garcia’s detention in El Salvador flunks a balancing test, because the extreme violation of his civil rights outweighs whatever slight foreign policy interest the United States might have in removing a lawful resident from the U.S. in violation of its own laws.

The government had full opportunity to “debate” the impact, if any, on its foreign policy in briefing and oral argument before the court. And where else would you debate the issue of the judiciary allegedly intervening in foreign policy other than in court?
Moreover, even if foreign policy is implicated by returning Garcia to U.S. detention, where is the “irreparable harm” in detaining him here for a few dollars more than in El Salvadore?

That therefore makes him not just a weak CJ but also a profoundly corrupt one. He worked in cooperation with one of the litigants coming before his court to grant them precisely what they needed without any intervening public process and did it in precisely the way needed to silence the other litigants.
