OK so so a slightly different take on where Kavanaugh goes from here.
Democrats will continue to hammer the social upheaval a Kavanaugh seat will bring. They’ll also hammer the perjury. And at last polling, 38% of voters agreed the nomination should proceed.
I’m not convinced this gets a cloture vote. Cruz is locked in a scary tight battle. I assure you there’s an internal poll out there on what happens if Ted votes yea. If the opinion of Kavanaugh drops any further it could be death to Cruz to support. He could be a good party guy and lose his job or he could vote no and lose his job when the crazy stays home as a result. Either way taking the vote is not good.
Some outgoing senators may not want this to be their legacy. Flake, despite his anti Trump mumblings is a full social conservative so he may not give a fuck. Then again he may not want to be a name associated with “A Trump
Court” in his obituary. Who knows? Can Mitch count on him?
Collins and Murkowski certainly have a lot riding on this. Of the two Murkowski is the more likely no but Collins is getting a ton of heat so she might be a no. If they are BOTH no this is academic anyway.
I can see a scenario where McConnell counts his votes and delays ending debate because flipping D Senate seats probably hinges on not confirming before November and confirming could lose Texas and Arizona and Nevada too and hands the senate to The Democrats. It would be in McConnell’s best interest to wait and see. If as predicted House flips then risking both houses of Congress to the opposition and all hell breaking loose on Congressional investigations and a
D Congress sending one super popular Bill after another to be vetoed isn’t a good outcome for GOP. (Think net neutrality, green energy, Medicare for all, student loan interest caps, raising caps on Social Security contributions, DACA…) Delaying is risky but not delaying may be a disaster
Delaying gives temporary cover from making the tough vote now, Cruz will not want to make this vote, with the understanding that if GOP holds the Senate they are lockstep confirm.
Kavanaugh purjuring himself didn’t help the GOP mid terms at all. It would have been better for GOP with their base if he had said, “Hell yes the Executive branch is supreme and no
Law applies to a sitting president and well duh, they nominated me too overturn Roe and socialized medicine. I will deliver.”

Roger Rabbit spews:
Trump rallies aren’t meant to engage our nation’s leader with its citizens. They are staged propaganda events, pure and simple. You’re there to help create an image of Trump as a wildly popular leader and that’s it. You’re onstage, and if you don’t play your role according to the script, “You’re fired!” So, if you want to be in one of these little staged dramas, you must clap and cheer on cue like all the other red hats. Individual opinion or expression is not allowed.

But it could be worse. If you don’t clap enthusiastically enough at a Trump rally, you only get thrown out. In North Korea, you’d be sent to a slave labor camp, and so would your children and grandchildren.

But that’s also why neither Senate candidate is eager for reproductive freedom to become a central issue in the election. It’s a spark in dry grass. If it gets going there’s no way to know which way it burns.
I say stick to perjury with the exception of Collins, Murkowski and Heller. The objective is not to keep the nominee/perjurer off the court. The objective is to make this the most costly political fiasco of McConnell’s career and ultimately cost him and Schumer their leadership positions.

@2 If McConnell is at all a decent colonel he will realize that battlefield victories come at a cost, meaning casualties have to be accepted. Republicans have sought a SCOTUS conservative majority and Roe overturn for 45 years, which is now within their grasp. This one is the Holy Grail, and it’s worth shedding blood for. The base will not understand if the colonel doesn’t seize the initiative and throw his troops into battle. What good is holding the Senate for another 2 years without the Supreme Court? The latter is infinitely more valuable than the former. There are two things I see potentially scrambling this picture. One, we already know McConnell is a timid commander, so there’s a potential for him to suffer another bout of hesitation; two, the colonel can’t keep all his troops in the front line; some break and run for cover, while the enemy holds steadfast. Conceivable, not likely, but possible. The assumption that this party toady gets confirmed still seems like the safest bet. But the polls. Yes, the polls show that only a third of the American public want this hack on the Supreme Court. Any delay raises the question of how to deal with the OSC and DOJ investigations that probably draw in the NRA and perhaps even top RNC donors and donor PACs. With Elliot Broidy’s wife negotiating $75 million retainers to shut down DOJ foreign corruption investigations, and David Keene’s wife hiring a Russian spy to put together Gazprom fuel deals, you know this thing is sprawling.
It is clear that what McConnell is hearing from Flood and the Raskins is that PornSweat cannot be questioned. They have rejected a take home test! They wont even agree to give attorney prepared, sworn written answers to a limited set of written questions. What that tells us is that there is no way to do it that doesn’t involve either perjury, subornation, admission of criminal guilt, or all three. PornSweat would have to invoke. And he refuses to do that.
As a team, they must pull off a plan to close down these investigations. After the midterms the options for doing that while preserving viability for an ideological nominee grow drastically narrow and risky. Recess appointments to cabinet and DOJ made after Dec. 31st, but before the new Congress will remain in effect through the end of 2020 without a confirmation vote. The window of opportunity is narrow. Even if we assume the GOP retains the Senate (likely), investigations and hearings in the House could create significant problems for confirmations beginning Jan. 3rd.
Mark Adams spews:
@2 There is no filibuster so in about 8 days after the committee wraps up and sends a recommendation to congress there will be a new Supreme Court member (or surprise, surprise there won’t). McConnell has one big hammer in his bag the Democrats do not want to give him an excuse to use. The one where he goes well since this has taken so long, we gotta stay in Washington and work boys and girls. Should Kavanaugh be rejected how quickly can he and Trump put in a new candidate and fast track. Trump has his list and he did speak to a couple of other potential nominees who may have been vetted, so it could just be a phone call. I doubt Cruz is hurt or helped by Kavanaugh, but could be he is a 2020 Presidential contender. He was certainly being a preening politician, did Cory Booker outdo him?
Republicans should do everything they can to get this one in the bag as quickly as possible. These Senators know this. The fact Democrats have made this process so contentious is what the Republicans want, and they have the votes. Senator McCain is out of the picture, and that provided some cover for these other dissenting votes, and that is now gone. If anything it makes it more imperative the Republicans be solid and get this win in the bag before the midterms. The timing makes this all about the winning.
Mark Adams spews:
@4 The truth is no one knows what you get I the box of chocolates once a judge becomes a Supreme. Mark Adams spews:
@10 You are using the poll numbers to confuse. Unfortunately the results are along party lines. About 34 percent to confirm, only 29% to not confirm, and the rest are undecided. So roughly 2/3 rds are ok if he gets confirmed.
What is important is that the Nationals play the Cubs. And the Nationals are doing pretty well this year, only 8 games out. This would show they understand the priorities of voters.

18,
Yertle loses a single seat and he’s pretty fucked. I can think of at least three this confirmation vote might jeopardize, if not this year then in two more. The Republican majority in the Senate is a very tenuous one, built less on policy and more on structure. That structure has been weakening for about ten years. This year’s class I elections are the Democrat’s most vulnerable based on incumbency and partisan lean. Had Republicans nominated and elected a President who wasn’t a Russian plant, and whose brain case wasn’t filled with angry spiders, they’d probably be looking at picking up two to three seats in the Senate. As things stand it’s a complete toss up. And a bunch of the structurally weaker Senate Republicans in class I are facing possible upset. If Republicans walk away from these mid terms with a one seat pickup they will declare that a monumental victory. And idiots like you will choke-fap to it in smugness.
But in reality it will represent a massive defeat. A criminal FedSoc Robot on the court will not change the structure of Senate elections. Class II is coming. Since you idiots (with PornSweat’s encouragement) are almost certain to re-nominate that child molester in AL, that leaves Democrats quite safe. And it also leaves a half dozen of your GOP brothers and sisters riding the bubble until then.
Don’t expect you to get that. It wouldn’t conform to your imaginary comic book happy place where Hitler rides a dinosaur.

Trump’s always had his list, and given that Kavanaugh was the least acceptable choice to Democrats from that list, for them any alternative is better than this one.
Roger Rabbit spews:
@15 “Cruz … is a 2020 Presidential contender.”
No, he is a failed 2016 contender, who could be an ex-senator by 2020 and in any case is not going to run against an incumbent of his own party who is seeking re-election, so the only way he becomes a 2020 contender is if (a) he’s reelected and (b) Trump is forced from office. However it plays out, I predict Cruz will never be president. He pisses everyone off and no one likes him. I’ll bet even Snowflake, his kids’ dog, wouldn’t vote for him.
“Republicans should do everything they can to get this one in the bag as quickly as possible.”
Impressively insightful. Really. That required some actual thinking. Not much, but some.
Roger Rabbit spews:
@16 When a judge won’t criticize a president who’s attacking the very foundations of our legal system, you have a pretty good idea of what you’re getting.
A toady. A party hack. A narrow partisan mind hiding behind a high IQ and grade A credentials. An embarrassment to his alma mater and the distinguished judges he clerked for. A clown in judicial robes. All of these things. Would you like me to continue?
This isn’t about Kavanaugh’s views on Roe v. Wade, his ideas about the expansiveness of executive power and privilege, his anti-labor record, or his positions on other issues he may be called on to decide. It’s about his willingness to shamelessly pander to a man who, as a litigant, wanted to disqualify the judge hearing his case because of the judge’s race, in pursuit of a position. That makes Kavanaugh the Richard Rich of this performance of “A Man For All Seasons.” It’s not hard to deduce what such men do with power when they get it; history is full of examples. You can have all the brains in the world, but if you lack character — if you’re nothing more than an unprincipled opportunist — you’re too small to sit on the highest court deciding the biggest cases.

https://www.cbsnews.com/news/amber-guyger-dallas-police-officer-who-shot-killed-botham-jean-updates-today-2018-09-08/
Roger Rabbit Commentary: Still a lot of mystery here. On the face of it, the cop went to the victim’s apartment by mistake, and one surmises each thought the other was an intruder and the situation escalated from there. It’s hard to see how that could happen, and makes more sense if it turns out she had a few drinks on her way home after her shift. But something about this doesn’t feel right. There’s a strange odor hanging over it.
Even if there are no criminal charges, it’s hard to imagine this cop keeping her job. In any case, the city and its insurers are likely on the hook to the victim’s family for around $3-5 million. This story says tenants could access their apartments with either a key or a keypad; if she got in by the keypad, how did she know his combination? But if so, you could have apartment owner liability here, too. And maybe even keypad manufacturer liability for a defective or poorly designed keypad — a bad lock.
One of the things investigators undoubtedly will look at is whether they knew each other, and whether there were any prior run-ins between them. A little voice in my head squeaks this may have been a premeditated hit. I suspect they’ll be looking at all possibilities including that one.

If either of those are true it’s rather remarkable that she wouldn’t be in custody. Generally when police respond to a homicide, aprehend the individual responsible, and learn that they knew the victim, it’s pretty much game over. Detectives proceed from the assumption that it’s a murder investigation and they make the arrest then and there and proceed backward to build the case. They ought to be particularly concerned that the suspect will do harm to herself.

At this point I think as Senator Mitch McConnel has stated Kavenaugh will be a Supreme court justice by October 1. He’s is probably itching to seat another justice if given the opportunity. As you just never know about these judges. Gee if these Senators just had some kind of crystal or mirror on the wall they would know what a potential justice would do on a particular case. It would make stacking the court so so much easier, and you can go with relatively young judges with not much case law, and little else out there in the real world. And of course we cannot have cantankerous judges that piss off Democrats and Republicans at the same time or on different cases.

@24 Actually I’m independent on tis and recognize that it’s going to be a narrow majority. That is the nature of the beast. Neither party in the Senate can overcome a presidential veto, not likely to remove the President in a purely partisan spat, it is this whole concept of checks and balances, and the folks who created the constitution not being thrilled with parties, and fully aware of the dangers. They were very much aware of the British Parliamentary system of it’s strengths and weaknesses. The amusing part is that the Senate was originally designed to give the states a forum, Now the states other than Guvnors being on various associations the states only forum is the courts.
Democrats can try to make the Senate elections about Trump, and they are being very successful in that in New York, Washington and California….places the Democrats have an incumbent Senator, and yes just for this amount of hubris I would love to see the Senate seat here in Washington state go Republican. The Democratic candidate has not offered me a whole lot.
Has not suggested that Washington state could follow its progressive spirit and initiate single payer (something a large employer like Boeing should insist on as their foreign competition has an unfair advantage because those companies do not have to provide healthcare) or the state should pay for college. Our Senator will not resist large increases in the military budget in support of such policies and feeding and housing the poor. Even NAZI’s were for policies feeding and housing the poor and employing those able to work. All she is promising is more of the same, and maybe I will get to be in the party with a majority again, and she loves Chuck, who should be chucked as minority party leader.

@42 Aside from professional courtesy there are plenty of reasons detectives may not make an immediate arrest. They may feel a mistake was made, but it’s self defense. They may prefer that the officer be free to walk around free able to talk to people, she may talk to someone other than her attorney. She has knowledge of the law and how police forces operate, and generally once you arrest here she is going to lawyer up. And if you don’t do the arrest right and fail to follow protocol, which is going to include some discussion with the DA, there is no reason to be hasty, unless you think she is a flight risk. A lot of of suspects are taken down town, and released once the cops speak to the DA as they don’t have enough, yet; often the suspect is arrested and then booked.

If you all want to be corporatists as you have been the past oh 10 years and emulate Republicans there maybe a real big flaw in your strategy. It is ironic that Bill Clinton ran to the right of his Republican opponents in some areas using that mysterious third way, but that has wrecked the parties brand. Trump ran to the left of your Hilliary Clinton. He beat Hillliary using Bill Clintons tactics and strategy. Other Republicans will pick up on that and may even exaggerate the same way, and they can get away with it because the brand of the party no longer carries much political meaning.
Parties unlike you all on here cannot hide its identity from the public. They operate mainly out in the disinfecting sunlight. Appearances do mean something in American politics. The answer out of the wilderness is in the name of the party….democrat being of the people, and not of corporations.

@84 In the 1920’s and early 30’s yes. Progressivism does have some dark shadows if you dare look. The NAZIs were socialists. And many German’s did not believe a lot of the ranting in Mein Kaumph. Especially before the party got into power. For many it became the way into the middle class. Sure there was a dark underbelly but it would be nearly a decade before the truly horrible things happened to an underprivileged group. For the ordinary German it meant food, housing and jobs, and they already had health care, and corporatism was very much a thing already in the Weimar Republic. It is no wonder many ordinary Germans many who disliked Hitler became party members. When it’s the only party in town and you want to run the towns sewer or water department, and you must be a party member well you typically join. If you want your company to build stuff for the 1936 Olympics, feed the athletes, house them, put up the decorations, ect and get the goodies from that you might very well become a party member. If you want your child to get into the right schools and university he or she joins the right part of the Hitler youth. Our military leaders were so upset with the camps that they thought the local government leaders had to know about the atrocities, and they took them to the camps, and at best they could only say these Germans should have known, but the government did much in secret. Certainly they should have known from furtive discussions or the guarded train cars, ect, so perhaps they were willfully ignorant, or unwilling to join the occupants of the car in protest. At the beginning though none of this is true and your comments are not true.
What is equally true is that Germany could just as easily gone communist around about that time in history. And what I’ve said about the ordinary German would be true under a communist dictatorship. Which may or may not have instituted some kind of holocaust. Invited their Russian brothers in and went to war against the imperialist capitalists in France and Britain. Those capitalist were of course more frightened of the communists than the NAZI’s.

@101 Totally political that McConnell sat on Merrick Garland’s nomination for a year, sacrificing 200 years of Senate tradition and his party’s last vestiges of honor, in order for his party to steal that seat from the president and party who had the constitutional right by virtue of election to fill it. Yes, it’s political, and these days it’s degenerated into political dirty pool, so fuck you. Well, two can play that game.
The Democrats who run things are kinder and gentler to you assholes than I would be. If I could make decisions, the third week of January 2021 would look like this:
Day 1 – Morning: The Supreme Court is expanded from 9 to 11 seats on a simple party-line majority vote with no debate. Takes about 20 minutes.
Day 1 – Afternoon: Two extremely liberal but well-qualified judges untainted by corruption, scandal, or conflict of interest are nominated to fill the new seats. Takes about 15 minutes.
Day 1 – Evening: The two new Supreme Court justices are confirmed by a simple party-line majority vote with no debate. Takes about 40 minutes.
Day 2 – Noon. The Senate Minority Leader and other key Republicans are invited to the White House for afternoon tea and served cupcakes with “Fuck You” inscriptions. Crying towels are available.
Day 3 – The Supreme Court accepts additional cases for the current (2020-2021) term and announces it will revisit some of the decisions made in the previous term.

Well, well, lookee here – packing the Supreme Court to restore a liberal majority isn’t just the idea of a nobody rabbit ranting on an obscure west coast local blog. It’s under active consideration and gaining traction in the places where party positions are born:

Of course, it’s not surprising that I’m not the only one who’s thought of it. After all, it’s a fairly obvious idea, and has been thought of before (by FDR, in the 1930s, although he only used it as a threat to get the decisions he wanted from a recalcitrant court; whereas things are different today, these Republicans won’t take the hint, and we’ll have to follow through).

72,
You know, we went over this only a few hours ago with you already, Shortbus.
Yes. The current majorities can conspire to conceal the nominee’s documentary record from the public eye as long as they are in the majority. Kavanaugh’s hidden emails, letters, notes, and other documents demonstrating that he lied repeatedly under oath to the committee can be published at any future time by a different majority.
These confrontations may indeed be useful as campaign soundbites this fall. But they also serve to lay down a marker for future reference. And they serve the very important purpose of forcing the nominee to make a declaration on the record that can be referred back to during later hearings if needed.
And by now it has become abundantly clear that for an EEEN-DEE-PEN-DUNCE like you, any time Democrats put up a fight you don’t like it. Funny how that always seems to be the case with you EEEN-DEE-PEN-DUNCE. There’s only one thing that bugs you more than Democrats not doing “progressive” stuff. And that’s whenever Democrats do “progressive” stuff. If Democrats reach across the aisle and compromise to make progress you sing Corrupt Duopoly” and vote for the other guys. And if they dig in and put up a fight you sing Partisan Obstruction and vote for the other guys.
More or less makes you one of the other guys.

Here’s a direct link to the Vox article linked by Five Thirty-Eight about packing the court. Vox calls it the Democrats’ “nuclear option”:
https://www.vox.com/2018/7/2/17513520/court-packing-explained-fdr-roosevelt-new-deal-democrats-supreme-court
I think it’s absolutely justified, for at least two reasons:
1. The shit Republicans pulled with Merrick Garland.
2. A conservative-majority court eager to overturn Roe v. Wade and the decisions establishing gay rights doesn’t reflect American society, and such actions would be contrary to the will of the people, as polls show strong public support for both Roe v. Wade and protecting gays from discrimination.
It’s been said that Justices read election returns, and Justices also have been known to surprise the presidents who appointed them. (Eisenhower once said he made two big mistakes as president, and “both of them are sitting on the Supreme Court.”) So even if conservatives gain the upper hand at the Court, all is not necessarily lost; it only takes reluctance on the part of one of them to overturn a precedent supported by two-thirds of the American people to preserve Roe v. Wade, and at this point, gay rights also has strong popular support. So, even ideologically-driven Justices might accept the status quo and content themselves with not expanding those rights any further.
But we can’t be sure of that, and given how Republicans and McConnell in particular broke time-honored Senate tradition — for all practical purposes cheated — to gain that Supreme Court majority, it’s entirely apropos for Democrats to depart from the old conventions to recover it, as soon as they have the voting power to do it. You have to fight fire with fire.
This is especially true if Kavanaugh gets confirmed and then the Court overturns Roe v. Wade. That would essentially constitute a declaration of war on our nation’s democratic principles — by imposing the minority’s will on the majority, and cheating to get there. That’s not much short of tyranny. In such circumstances, it’s reasonable to take back the Court majority and then undo the minority’s trickery by any lawful methods that will work.
It may take time, and require undoing a great deal of undemocratic practices that have crept into the system over the past several decades that have been used to impose minority rule on our nation – voting suppression, gerrymandering, and so on. But no matter how long it takes, or how much effort it takes, we simply must stand up to this bullying, face it down, and defeat it. If we don’t, we might as well be living under a king, dictator, shah, or potentate.
That’s not what our ancestors, the founders of our republic, had in mind or wanted for us, or shed their blood to attain.
Roger Rabbit spews:
@109 Shortbus actually believes his trolling is clever and original. It’s true he’s not your typical Republican ignoramus who thinks knowledge is corrupting and “real Americans” don’t read books or newspapers. He knows who Liddell-Hart is and which major power didn’t sign the Versailles Treaty, or at least knows how to look it up – although he does not, in general, research anything or verify the factual premises of his posts. This is deliberate; he’s no more interested in nailing down the truth than are Dumbfuck, Piddles, or any of the other trolls that have come and gone on this blog over the years. Shortbus’ style is not to dig in his heels and defend the blatant bullshit emanating from the rightwing noise machine, but to create stealthy bullshit by distorting otherwise respectable facts to fit with his narrative and argument. Back in 2003, in slightly different form, this was called “fixing the facts to the policy.” It’s not a new scheme, and no impartial observer would ever confuse it with critical thinking or genuine analysis. It’s still propaganda fashioned from falsehoods and misrepresentations, only thinly disguised to try to look like something reputable. The disguise is too thin; notwithstanding his attempts to pose as a wise old owl, professorial if you will, the pigeon poop he drops into these threads is still bird shit. You wonder who he thinks he’s fooling. We even tell him, upfront, that we’re not fooled, but he keeps at it. If you don’t at first succeed, keep doing the same thing and expect a different result. Einstein’s take on that wasn’t wrong, per se, but it was incomplete. He forgot to include stupidity. Just as not all insane people are stupid, not all stupid people are insane. I’m confident Shortbus isn’t insane; merely stupid enough to believe he’s getting away with something, as if the rest of us had never seen a troll before.

If this is purely about Roe v Wade and Democrats want certainty then that can only come from amending the US constitution or passage of legislation in congress. And typically this sort of thing is left to states, so why not a change to the Washington state constitution? Doubt you all want to go down that road.

Even we, on this blog, aren’t advocating impeaching any of the current Supremes, nor are any of us advocating groundless impeachment of Trump or Kavanaugh (if he gets on the court), or anybody else.
We believe impeachment is an extraordinary, last-resort remedy, and that substantial justification is required to overturn an election or constitutionally authorized appointment.
If Trump colluded with the Russians to rig the election in his favor, if he has conflicts of interest and compromised the public interest in pursuit of his private interests, if he has committed crimes or obstructed justice – that’s impeachable.
If Kavanaugh committed perjury in his confirmation hearings, that’s impeachable – not only from a Supreme Court seat, but from the Circuit Court seat he currently occupies.
Mere disagreement with beliefs or policies is never grounds for impeachment. Those issues are to be decided at the ballot box.

Not for criminal defense. The union is only obligated to help her preserve her employment.
“And you are making assumptions.”
Do you know what “if” means, son? Go back and read #91 again. What is the first word of the first sentence in that comment? It qualifies everything that follows as contingent: If X happened, then Y follows; but if X didn’t happen, then no Y.
“Why not an assumption of innocence until proven guilty in a court of law”
Because this is a discussion about an event reported in the news, not a court trial. She’s not entitled to an assumption of innocence here; but that said, no one here – including me – has used the term “guilty.” That’s for the court and jury to determine. The prosecutor has made an initial determination of probable cause, and that’s enough to call her an accused, which is what she is right now.

@99 I voted for Jill Stein as she was a far candidate than the ones offered by the Republican or Democratic party. Also at this time in Washington state only the Democratic candidate is getting the electoral college votes as this is a non competitive state, and we are taken for granted by the Dems nationally, and generally ignored by Republicans, on the national stage Washington state is a second class citizen. Presidential candidates have been decided by the we vote in every Presidential election for decades. Guess you like that status quo.

@121 What’s unethical about #93? Insinuating that you’re a dummy? That’s not unethical, it’s objective reporting.

@123 “She is out on bail already did not have to wait until tomorrows arraignment…professional courtesy?”
In Texas, usually bail is set when the arrest warrant is issued, by the judge who signs the warrant, not at arraignment.
In this case, bail was set at $300,000, so somebody either put up hefty collateral or paid a hefty bail bond fee.
Roger Rabbit spews:
@125 Voting for Jill Stein was abstaining. It was opting out. But let’s play a thought experiment here. If you had to vote for either Trump or Hillary, which would you vote for?
I have nothing to hide. I voted for Hillary, and if the election were held today, I’d still vote for Hillary.
You?
Roger Rabbit spews:
@125 There’s no reason why a Republican couldn’t win Washington’s electoral votes. All Republicans have to do to win this state is stop being a shitty party with a shitty platform and shitty candidates. If they stopped pandering to plutocrats and represented working people instead of shitting on them, they might get somewhere, because there are more working people here than plutocrats, even though we have more than our fair share of billionaires.
Roger Rabbit spews:
@128 Getting to you, am I? Good. Making trolls miserable is what I do on this blog.

If you want to know what assuming guilt looks like, here’s a perfect example:
“Pence and the President’s counselor, Kellyanne Conway, tried to put the spotlight on the motives of the anonymous official, warning that there could be ‘criminal’ dimensions to the op-ed ….
“She said there could be a criminal aspect to the writing of the opinion piece — though she was unable to say exactly how the author might have broken the law …. ‘I have really no idea, nor do you, what else this person has divulged,’ Conway told Tapper. ‘I think somebody so cowardly and so conceited would probably go a step further.’ …
“Pence appeared to be arguing that by showing such disloyalty to the President and even whispering about invoking the 25th Amendment to remove him, the ‘resistance’ the op-ed writer mentions is subverting the democratic process.”
https://www.cnn.com/2018/09/10/politics/trump-white-house-fear-op-ed/index.html
Analysis: In Conway’s case, that’s called “making shit up.” Pence, on the other hand, instead of imagining facts that don’t exist, imagines a crime that doesn’t exist.
Moreover, even if “the ‘resistance’ the op-ed writer mentions” is a crime, the op-ed merely disclosed the commission of the crime, which is a far cry from being guilty of committing it.
B-b-but s/he must be guilty of something. Keep working on it, make like Elliot Ness, maybe we can get him/her for tax evasion.
Mark Adams spews:
@124 Have you checked out the rules and laws for police unions in Texas? It maybe the Union does have to defend her, depending on the rules of the union she is a member of. Have you researched the rules? What union? While not likely the Union could have paid her bail. You are making any number of assumptions based on what is in the paper hour to hour on this thing, and the information may or may not be accurate, and you point the parts that are I beneficial to your narratives. You certainly go outside the four corners of the law, and no mention of a presumption of innocence, and if you are an attorney or even former attorney that is unethical.
@104 And your little what I would do on day 1 ect is absolutely unethical.
Day 1 Morning. Best you could do is announce and have friends in the Senate and House introduce laws. Which are unlikely to pass,
Day 1 afternoon. for rGB and Brayer because they are retiring?
Day 2: Sure they will discuss day with you in the same salty language. Very short honeymoon.
Day 3 And the Chief Justice would tell you the court as an equal and separate branch will make its own case load If you wish to make suggestions he will file them in the appropriate circular file.

@130 I would write in Sloopy. Or Pogo. Or a candidate of my choice. I will never vote for Hilliary Clinton under any circumstance. I will consider Biden or that real popular fellow here in Washington that the majority of Democrats liked here…Bernie something.

Since the matter is going to be an employment issue they are on the hook. They may only recommend a defense attorney, but they will need to work in concert with that attorney. The officer can certainly consult with them.

He’s a private citizen.
And you are an ignoramous.
Again.
The point here, and it really ought to penetrate with orange throat yogurt gargling fanboys like you, is that there is substantially less value in stealing and railroading through a lifetime court appointment if the appointee is freighted with criminal baggage.
Once upon a time that was one of the biggest reasons for the vetting process and hearings like these. To avoid squandering the appointment on some creep with a closet full of skeletons. You idiots really ought to ask yourselves why this guy? And why the big rush?
The Dude-Bro media have you meatheads so excited at the prospect of sobbing defeated “FemeNazis” and canceled gay pride events you may be missing the real show here. Jan 3rd is still months away. @137 “Have you checked out the rules and laws for police unions in Texas?”

@138 “I would write in Sloopy. Or Pogo. Or a candidate of my choice.”
I had no idea you’d carry abstention to such extremes, but based on everything I know about you, I’m not surprised.
“I will never vote for Hilliary Clinton under any circumstance.”
Why? What has she done?*
* I’m referring to something she actually did, not the lies about her propagated by the rightwing noise machine. Thus, murdering Vince Foster or pulling the troops back from Benghazi don’t count. Her husband’s infidelities don’t count, either; being the victim isn’t an element of guilt. Keep in mind that after spending 30 years of intense effort and $100 million of taxpayer money trying to criminalize this woman, the rightwing haters haven’t been able to convict her of so much as a parking ticket.
A rational voter would compare the relevant knowledge, experience, temperament, and character of the two candidates. It’s not necessary to go through the details of that exercise here. You just made it clear that you’re not a rational voter and, where you’re concerned, any attempt at an objective discussion of the relative merits of these two candidates would fall on deaf ears.
Moreover, even if you did apply some sort of rational process to the evaluation, you’re so poorly informed and full of misinformation that your conclusion would be irrational anyway.

Roger Rabbit spews:
@138 “Citizens are always permitted to do a write in if they choose or do not care for the two candidates.”
Absolutely, They’re also permitted to not vote at all, which is effectively what you do. What we’re discussing is not whether you broke a law or rule; there’s no issue there. This is about how you discharged your citizen’s duty to help select our nation’s leader.
“Making your question moot.”
No, it makes you a spineless jellyfish, unwilling or incapable of making tough choices where all the options are disagreeable. In short, put another way, you’re not military commander or CEO material.
Roger Rabbit spews:
@139 “If the person has a security clearance … they are breaking a number of statutes or at the very least should loose their clearance” if they disclose classified information. What classified information was disclosed in the op-ed? Be specific, because specificity is required to charge someone with a crime or revoke their security clearance.
On the other hand, all these folks serve at pleasure, and can be fired for any reason or no reason at all.
Roger Rabbit spews:
@140 Sure does look like the union is contractually on the hook for her criminal defense. Not necessarily paying for it, maybe providing it, depending on the fine print of the contract, in which case she doesn’t get to choose her lawyer. The union has a motive to economize, so probably the first – or, if not the first then the second – conversation the union-provided lawyer has with her may touch upon a possible plea bargain.
Think the union will go all-in for her defense, damn the cost? If that’s what unions did, there would be no lawsuits against unions by their members alleging breach of contractual duty to represent or provide representation. There are plenty of such cases in the law books.
In a case like this, where a totally innocent person was killed in his own home by a cop who had no legal right to enter his home, the critical point in any criminal proceedings against the cop is when the prosecutor decides to charge or not. The charging decision having been made, it will take jury nullification or prosecution incompetence to avoid a conviction in this case. Trust me, whichever lawyer defends this cop will be looking for the best plea bargain he can get for her.
And as far as employee discipline goes, she will not return to this job.
Roger Rabbit spews:
@142 You can’t expect an ignoramus who can’t tell the difference between classified and non-classified to know the difference between unethical and merely hard-nosed, either.
Elijah Dominic McDotcom spews:
152,
BZZZZZZZZZZZZZZZZZZZZT!!!
I’m so sorry. The rules are very clear on all this.
You are never allowed to question or challenge the right wing noise. Doing so would call into question the status quo upon which so many media careers depend.
1) Without acknowledging it, Democrats shall be relied upon to quietly push back making sure that just enough* poor kids get an education, just enough* African American motorists survive a traffic stop, just enough* uninsured sick people get enough health care to ensure a long painful (but thankfully quiet and invisible) death, just enough* low income, low skill, low education teen girls (preferably white) get reproductive health care, just enough* sobbing Guatemalan toddlers are reunited with their desperate mothers, and just enough* Nazi/Klan Tiki Torch rallies are disrupted with protest.
2) Democratic politicians and elected officials shall harness up to this burden gladly and eagerly and they shall toil in these fields steadily and without complaint. In return for this they shall be harangued mercilessly, beaten like a mule, libeled with unspeakable lies all of which shall be treated with respect and due consideration however ridiculous, and they shall be occasionally impeached and constantly threatened with it.
3) Most importantly, Democrats shall never observe the obvious and turn upon the corporate media whores who build their careers on this arrangement.
*The precise meaning of “just enough” shall remain in constant flux owing to a host of social and economic variables the single most important of which shall be the performance of the stock market indexes.
