    Social media research is a pretty standard part of jury selection these days. But it’s limited to verified accounts that can be directly tied to the individual pool member via email, etc. And since most MAGA assholes post their ignorant rants anonymously it’s unlikely to show up.

    But in answer to your question, if I understand you, if a jury pool member were shown to have expressed the sincere belief that any person accused but not convicted is presumed guilty before trial that jury pool member would be excused for cause.

    It’s far more common to uncover a social media history expressing specific bias affecting parties involved in the case, rather than an outright refusal to grant due process, irrespective of bias.

    Just an addition to clarify the process, since it sounds like you may not have ever served on a jury or gone through voir dire (selection).

    It varies a lot by court, but at some point it’s an almost universal part of the process for pool members to state under oath that they understand that it is their duty if selected to consider the trial testimony and evidence without bias, and to grant a full presumption of innocence to the accused before they are even seated. This is often accomplished via jury pool forms ahead of the portion of voir dire that you see portrayed in media. Or other times the judge will put the entire pool through a series of “raise your hand” exercises in court before turning the pool over to the individual attorneys. All parties are present for this and receive completed copies of any jury selection forms.

    So any pool member who has indicated affirmatively during selection that they understand and agree with their duty to grant a presumption of innocence, but who has also previously posted social media declaring the opposite would be regarded as dishonest before the court. That’s bad. So once the evidence of the social media declarations were provided to the judge it becomes their duty to remove that person from the pool. And they’d normally also get a bit of a scolding interrogation from the judge in the process that might include threats of criminal charges. But normally just threats. Still, it’s very unwise to lie to judges in any way. So don’t ever do it.

    The only good option for the United States at this point is to just stop.

    But for the Insane Failing Cult Leader and his cult of MAGA chuds, like the troll posting here, politically that is at best only the least worst of many options. And all of the alternative options are far too complex for most of them to ever understand. So that leaves the cult frozen in an intermediate state of confusion and frustration, waiting for their cult leader to decide their fate for them.

    There is a huge downside potential for this to result in a decision to simply “burn it all down” and take the worst possible option.
    And that option would likely involve direct, verifiable orders through the chain of command to carry out widespread attacks on the civilian population of Iran.

A woman began screaming and sobbing uncontrollably.     I was there once when a pool member raised their hand when asked if they could agree to grant the accused the presumption of innocence before hearing the evidence. The defendant happened to be black. The prospective juror used the “n” word in describing why he would be unable to presume innocence. The judge cleared the court and then proceeded to engage in a quite withering interrogation of said prospective juror. Contempt was threatened. But he saved himself with an apology, which I personally did not find very credible. This particular judge has a Black spouse. I imagine she may have taken that into account when deciding to let the fucker off.

    A half day of voir dire was lost so that a new pool could be brought in.

    I said no three decades ago and asked the judge if I could approach before answering. I quietly explained I worked for a consumer advocate attorney and I know in a liability case against a multinational if it’s gotten to jury selection , Defendant’s attorneys have lost every motion to dismiss, request for summary judgement and tried to bury the plaintiffs in threats and paperwork so I really can’t be impartial.

    She sent me on my way with a smirk.

    @36 Many people want to get on a jury, and are disappointed when they’re challenged for cause or dismissed with a peremptory challenge, but some folks want to get out of jury duty because of work commitments, child care, school classes, or whatever.

    Getting out of jury duty is a fine art. As a lawyer, it’s not appropriate for me to offer advice on how to get kicked out of a jury pool, but I can tell stories. I recall a woman who was called to a jury in a civil case, and the void dire went like this:

    LAWYER: Are you employed?

    JUROR: Yes, I’m an assistant prosecuting attorney in [name of county].

    LAWYER: Why do you suppose lawyers don’t want other lawyers on their juries?

    JUROR: Well, maybe they’re afraid a lawyer in jury deliberations would ignore the jury instructions and persuade the other jurors to go with her opinion of what the law is, but I won’t do that.

    The questioning ended right there and the lawyer promptly exercised one of his peremptories.

    All media exhibit bias. This is true.

    But as I’ve pointed out here a few times in the past, there is a categorical difference between exhibiting bias in how objectively verifiable true events are reported, and simply ignoring objectively verifiable truth and instead reporting lies.

    Fox, as just one example, has freely admitted under oath that they deliberately misinform their audience by presenting claims they know objectively to be false. That’s very different from presenting objective truth but in a way that exhibits bias.

    Fox admitted under oath that they knew the claims about rigging of election machine software were objectively untrue. They knew those claims were objectively untrue claims at the time they reported to their audience the exact opposite, that the claims were true.

    An example of media bias would be, for example, continuing to focus their reporting on the existence of the false claims, while admitting the falsehood behind the claims.

    Another example might be Newsmax host Chris Planted informing his audience that candidate Vance’s claims that Haitian migrants were eating Ohio “cats and dogs” were “100% true”. When in fact there were and are no such original reports from anyone in Ohio at the time. That is an objectively untrue claim being reported as “100% true”. While exhibiting bias around reporting such claims would certainly start with any decision to report on them at all until they have been tracked down and verified.

    The fact that you don’t understand this difference leaves you permanently vulnerable to the influence of any liar capable of winning your affections. I’m guessing you’d drive a Tesla if you could afford one. And the reason you can’t might have something to do with a lifetime of very weak salary negotiations in which you consistently believed your employer’s lies.
