    Besides the road test under local conditions, the delivery alone racks up a lot miles if it’s Gillig. The factory is about 1000 miles from Seattle, and they drive them up here. About the only condition they don’t face are passengers. New Flyer ships battery buses from plants in St Coud and Anniston via semi trailer. Probably learned from delivery of CNG Buses. When I was attending EWU, saw a couple New Flyer CNG buses in Pierce Transit colors headed west. Was thinking, definitely a delivery, as Sunset Hill is pretty far away from Tacoma for a regular scheduled trip.

They claim that doing so would produce unacceptable risk for their agencies and their employees of being arrested, prosecuted, and sued by the federal government. These local police say they can’t even ask questions or make phone calls.

    So I feel like that claim must obviously be some fucking bullshit.

    That example indicates that no such risks would really exist. And the real reason why our local law enforcement are unwilling to involve themselves, even indirectly, in addressing these very compelling public safety threats in their communities is that they don’t personally like being called upon to protect the safety of non-whites and so-called “libbies”.

    I feel like this ought to provide all us non-whites and so-called “libbies” a useful data point when evaluating calls to defund those same police.

    I mean, why would we pay their salaries if they withhold their useful services?

The D.C. Circuit contacted the Department about the missing attachment and explained that, if it failed to submit the attachment, the circuit would consider the complaint as submitted. The Department did not supply the attachment.

    In the absence of the attachment, the complaint offers no source for what, if anything, the subject judge said during the Conference, when he said it, whether he said it in response to a question, whether he said it during the Conference or at another meeting, and whether he expressed these concerns as his own or as those of other judges.

    Later in the complaint … the Department refers to a Fox News clip discussing the same allegation. But it does not identify any source, contain any specifics, or answer any of the above questions. A recycling of unadorned allegations with no
    reference to a source does not corroborate them.

    This alone makes DOJ’s complaint beyond silly, but the order doesn’t stop there:

    A key point of the Judicial Conference and the related meetings is to facilitate candid conversations about judicial administration among leaders of the federal judiciary about matters of common concern. In these settings, a judge’s expression of anxiety about executive-branch compliance with judicial orders …, is not so far afield … as to violate the Codes of Judicial Conduct. Confirming the point, the Chief Justice’s 2024 year-end report raised general concerns about threats to judicial independence, security concerns for judges, and respect for court orders ….

    In other words, Boasberg didn’t say anything the Chief Justice hasn’t said. And wait, there’s more:

    To the extent the Department claims that the judge’s alleged March 11 remark amounts to a “public comment” with respect to “a matter pending … in any court” in violation of Canon 3(A)(6) … the J.G.G. action was not filed until four days later: March 15, 2025.

    And as for Bondi’s claim that Boasberg ignored a Supreme Court order,

    … the complaint … does not explain how a Supreme Court ruling about a prior action by the judge necessarily shows “willful indifference” when the judge addresses a distinct set of circumstances in a later ruling.

    I admit this point is sufficiently abstract that an amateur armchair lawyer might not get it, given that Bondi, an actual lawyer, obviously didn’t get it. As for her claims of bias,

    The Supreme Court’s decision to vacate the temporary restraining orders does not by itself show bias, particularly given the existence of several justices in dissent. … Nor does the D.C. Circuit’s decision to vacate the probable-cause order suffice by itself to show bias, as it led to a split panel and weeks of deliberations over whether to take the case en banc. … The proper forum for these allegations is the road already taken: relief in the D.C. Circuit and, if need be, the Supreme Court.

    This point, too, is a little tricky though a first-semester law student would get it. And then,

    To the extent the complaint asks that the underlying case be reassigned to another judge, that is not a form of relief available through the complaint process. … While judicial councils may prohibit judges engaged in misconduct from handling cases, … they do not have authority to reassign specific cases to other judges ….

    Again, this may sound arcane to the uninitiated, but you would expect the Attorney General of the United States to know this stuff, or at least be competently advised of it. Finally, for me personally, the most delicious part of the order is this:

    Accordingly, it is ORDERED that the complaint be dismissed …

    To summarize, this is a world-class slapdown of a stupid and incompetent AGUSA! Ouch! For any lawyer on the getting end of it, that has to hurt!

Local police must be ready to respond when summoned. As Metro is deploying another attempt at Battery buses(2.0 was a little better, after the issue that sidelined them is fixed, New Flyer XE40s will be back in service soon), There is one example with order 3.0 that is different, while New Flyers were delivered on flat bed trailers(not enough chargers between here and Minnesota and Alabama), the Gilligs were driven here, with about 1000 miles on them when they arrived in Tukwilla. Plus three other operators here already use this model, Pierce Transit has had the most experience, although what Metro is getting has an improved battery, PT uses them on Tacoma, Lakewood routes, plus Rt4 between Lakewood and Puyallup via 512, and Rt 400 Puyallup-Tacoma. Kitsap Transit has been a good local terrain torturer test.

    Wouldn’t be the first time Metro gas followed Pierce Transit on something, but could be the first time they followed through on it. Old METRO chose to follow Pierce Transit in pursuing CNG as a replacement for Diesel, but it didn’t survive the forced marriageable of Old Metro with King County, and King County Executives Locke and Sims canceling it in favor of Diesels with emissions controls.

    In hindsight Locke and Sims made the right call, Pierce Transit only has the Lakewood Garage (stupid decision, long deadhead times effect routes serving outlying areas of the district). Metro has six. Besides the fueling pads being modified, would have required new gas lines being installed.
