Where a law, contract, or company policy says an employee can only be fired “for cause,” what constitute sufficient reason may not be spelled out, but there’s a body of law defining “cause.”
Cobb is a tenured appointee, not an employee, adding extra job security, and when the executive seeks to exercise its removal authority, courts will weigh heavily what Congress intended to be sufficient cause for removal.
Courts, not the executive, make that determination. It would be obvious to even a neophyte lawyer or judge that allowing the president discretionary authority to determine “cause” would convert Fed governor positions to at-will appointments, rendering the tenure provisions of the statute on Federal Reserve appointments superfluous. Courts avoid interpretations that render statutory language superfluous.
But this lawyer has to make the argument, or he’s out of a job. This DOJ has already fired lawyers for arguing in court that the executive branch has to follow the law, whatever it is. The only argument DOJ allows its lawyers to make is that the executive has unfettered powers; or, in layman’s language, what Trump wants Trump gets.
This lawyer apparently wants to keep his DOJ job, despite the shitty working conditions, constant threat of dismissal, and having to professionally compromise his ethics, look silly to other lawyers and judges, suffer reputational damage in the media, and perhaps risk losing his license.
I’m guessing he doesn’t have a family law firm to return to, or a trust fund to fall back on if something happens to his salary. And as Mark Twain supposedly said, “It’s hard to get a man to understand something, when his salary depends on his not understanding it.”

They do have fresh-caught fish if you don’t mind paying $30.99/lb. for halibut or $19.99/lb. for sockeye. As I recall organic avocados are now $3.98 each, or maybe it’s $5.98 each with tariffs. So yes, expensive. But you don’t think twice about grocery prices, any more than you think twice about leaving a 10% tip at a fancy restaurant (because it’s easier to calculate in your head than a 5% tip), right?
