    So many layoffs have hit U.S. companies recently that it can be hard to remember which giant company laid off how many thousands of workers on which day. And whether it’s Indeed or Glassdoor, Microsoft or Amazon, many of the job cut announcements are linked one way or another to AI. Now an analyst at financial analysis giant Moody’s is loudly ringing alarm bells about the huge number of layoffs across the U.S., warning that while the economy isn’t yet in a recession it’s right on the edge of one.

    I’ve watched episodes of Alien: Earth.. The reviewers on IMDB, mostly old fans of the Alien franchise are panning it calling it “disneyfied” with CW network type characters. They have a bit of a point.

    This lawyer isn’t necessarily a recent graduate (like two months ago) from a mail-correspondence law school. Rather, he knows what he has to say to keep his DOJ job.

    In general employment law, an employee is “at-will” unless a law or contract says otherwise, meaning the employer can fire the employee without a reason and doesn’t need to justify it (so long as it doesn’t violate anti-discrimination laws).

    Where a law, contract, or company policy says an employee can only be fired “for cause,” what constitute sufficient reason may not be spelled out, but there’s a body of law defining “cause.”

    Cobb is a tenured appointee, not an employee, adding extra job security, and when the executive seeks to exercise its removal authority, courts will weigh heavily what Congress intended to be sufficient cause for removal.

    Courts, not the executive, make that determination. It would be obvious to even a neophyte lawyer or judge that allowing the president discretionary authority to determine “cause” would convert Fed governor positions to at-will appointments, rendering the tenure provisions of the statute on Federal Reserve appointments superfluous. Courts avoid interpretations that render statutory language superfluous.

    But this lawyer has to make the argument, or he’s out of a job. This DOJ has already fired lawyers for arguing in court that the executive branch has to follow the law, whatever it is. The only argument DOJ allows its lawyers to make is that the executive has unfettered powers; or, in layman’s language, what Trump wants Trump gets.

    This lawyer apparently wants to keep his DOJ job, despite the shitty working conditions, constant threat of dismissal, and having to professionally compromise his ethics, look silly to other lawyers and judges, suffer reputational damage in the media, and perhaps risk losing his license.

    I’m guessing he doesn’t have a family law firm to return to, or a trust fund to fall back on if something happens to his salary. And as Mark Twain supposedly said, “It’s hard to get a man to understand something, when his salary depends on his not understanding it.”

    When did you ever shop Shoreline Central Market? Did you once upon a time work at a Seattle hospital? Before you were shunted off, like Napoleon and Henri Charrière to exile on an island for bad professional behavior? That was quite a few years ago, wasn’t it?

    Things have changed. If you look up the Yelp reviews (here), and go to 1-star and 2-star entries, you’ll see complaints that the deli food has gone downhill and the produce isn’t as fresh. And they don’t make their own sushi anymore.

    I’m closer to Shoreline Central Market than you are, and sample their lettuce on a regular basis. In the store, not the dumpsters out back (I’m a rabbit, not a raccoon). They still have stuff you can’t buy at Safeway, Albertsons, or QFC; and it’s still expensive, which is no problem for well-heeled clientele like me.

    They do have fresh-caught fish if you don’t mind paying $30.99/lb. for halibut or $19.99/lb. for sockeye. As I recall organic avocados are now $3.98 each, or maybe it’s $5.98 each with tariffs. So yes, expensive. But you don’t think twice about grocery prices, any more than you think twice about leaving a 10% tip at a fancy restaurant (because it’s easier to calculate in your head than a 5% tip), right?

    Remember the opening scenes from “The Longest Day” and “Saving Private Ryan” depicting the slaughter on the Normandy beaches? Have you watched YouTube videos of the now very few, very aged veterans returning to those beaches, walking the now-peaceful sands, and remembering that day? Pursuing political ambitions with military means — as Putin is attempting in Ukraine — creates heartbreak for millions.

    And as often as not a single politician, assisted by sycophantic aides, is behind it. Hitler was temporarily a hero to many, but is remembered as a monster. Trump is temporarily a hero to some, but he too is pursuing political ambitions in a militaristic manner; is he setting himself up to be remembered as a monster?

    When I watch those movie scenes, and think about the few remaining elderly veterans stepping carefully on the Normandy sands, so as not to lose their balance and fall, I’m reminded of how terribly important it is to keep the power to affect the lives of millions away from people of bad character with harmful mindsets, how easy it is to fail at that, and then I think of the Republican voters who, despite the warnings of history, gave power to Trump. It’s a sad fact of human frailty that some people make mistakes the rest of us simply can’t forget or forgive.

    And tariffs are only a part of it. Trump has encroached on other core congressional powers. In many cases, stretching them to see how much he can get away with. If the courts stop him here, they’ll stop him there, too. This ruling means separation of powers is still in effect. That substantially limits executive orders. And that’s the big story to be gleaned from the tariff ruling, if it holds up in SCOTUS.
