Reuveni attempted various dodges and she grew impatient. The judge raised the stakes, and threatened that without some evidence of some kind she would find for the moving party and issue the order. Reuveni tried a Hail Mary and begged for more time to try and convince Bondi to produce “whatever documents are availalbe” to support her claim that Garcia is MS-13 (now he’s MS-13, but before he was TdA. The evidence is apparently “fluid”).
Judge refused. Issued the order. And now Bondi has to switch game plans again and attempt to argue to the 4th that the Maryland District lacks habeas jurisdicition. Unfortunately CJ Roberts himself issued the precedent ruling granting habeas jurisdiction over US detainees in foreign custody in 2008.

She affirms her Friday ruling and reitterates her Monday midnight deadline for Garcia to be returned to the United States. With less than 36 hours to go it’s very clear that Fat Hitler will defy this order if he is unable to obtain a stay from the 4th Circuit. That motion for a stay is currently before the 4th and the plaintiff’s response to that motion was timely filed yesterday afternoon. In its own filing to the 4th seeking that stay the government has conceded that the order it has executed to remove Mr. Garcia was unlawful. Nevertheless, according to the government the “execution” of that unlawful “removal order” “strips district courts of jurisdiction” in any suit challenging that unlawful order.
If that sounds preposterous, that’s because it is. And being preposterous, absurd, and entirely unmoored from any law or any binding precedent the government unsurprisingly has offered absolutely zero, zilch, nada citations in support of that silly claim. They just threw it out there and let it hang.
Finally the government rests it’s entire motion on the quite obviously false argument that Garcia’s claims exclusively “sound in habeas” and are therefore beyond the court’s power to remedy because he is “not in United States custody.” The plaintiff responds that this is false, and that Garcia does not challenge his confinement in particular but rather that he challenges his removal, which the government itself has conceded was and is unlawful. Garcia’s complaint is rooted in due process, the administrative procedures act, the immigration and naturalization act, and yes, lastly in habeas. And while the government’s arguments to deny habeas jurisidiction to the district court fail, even if they were to succeed, that still leaves Garcia a free man with a legal claim to U.S. residency living in El Salvador because of that unlawful removal. His current state of detention in El Salvador is predicated on the Fat Hitler paying for it, which the Fat Hitler admits. Thus, as soon as that ends, the only thing preventing his return would be plane fare and a U.S. customs official. I’ll gladly buy. But I’ll probably have to stand in line. And anyway, this is Fat Hitler’s fault. He should pay.
Fat Hitler has three appointees to the 4th. None of them assigned to Maryland. They often do not publish opinions for precedent. I expect that in this case as well. But I also expect the decision by tomorrow morning at the latest.

I wonder if that’s correct. While virtually all media sources are assuming a 43% increase in retail prices, it seems to me the tariff would be on the landing value at the port, not the ultimate retail value.
For example, if I’m a banana importer who pays 60 cents a pound to the exporter, and I sell the bananas to a grocery chain that charges retail customers 89 cents a pound, and a 25% tariff is put on bananas, the tariff should be 15 cents a pound, not 22¼ cents a pound.
