  • The Spokane 3 trial is really exposing how awful Spokane police and ICE are.
  • I keep saying write your legislators and members of Congress and other officials. As well as other actions. My friend and a Drinking Liberally alum is trying to make a clearinghouse of all of the sorts of things that you can do.
  • Fire season looks to be particularly bad because the Trump Administration are fighting the worst fights.

    But since you decided to bring up terrorist attacks taking place on a military base, maybe this is a good time to mention one of the most overlooked SCOTUS rulings this term: Hencley v. Fluor.

    Reversal and remand in a case where the circuit applied a doctrine called “battlefield pre-emption”. 6-3 decision with Thomas writing and Sotomayor, Gorsuch, Kagan, Coney Barret and Jackson. So not an ideological decision, but a rare principled decision for Thomas. With Alito naturally writing a very ideological and critical dissent from Thomas.

    Thomas describes three new principles:
    – No pre-emption without text – “There is no federal pre-emption in vacuo without a constitutional text or federal statute to assert it”;
    – Judge-made defenses must be narrow – “Congress knows full well how to make its intention to preclude private liability known”;
    – “And we decline to extend Yearsley to bar allegations such as Hencley’s” – the rule as described in the previous ruling may no longer be applied in cases of private liability.

    Every word of this decision, written by a conservative justice who has dissented in previous decisions upholding QI, may be precisely applied to QI. QI is a pre-emptive doctrine. It tosses liability at pre-trial. It is a judge-made doctrine. There is no constitutional text and no federal statute describing it. It is applied as broadly as possible, such that the current rule applies it automatically unless there is a previously well established understanding in place – i.e. it applies in all cases unless the court has previously ruled otherwise. So the previous rule, to follow Thomas’ logic, may no longer be applied.

    If a military contractor loses their immunity for conduct falling outside of their lawful authority, why do police officers get to keep theirs?

    As doctrine Hencley is a serious blow to the foundational principles (or lack) supporting QI. Of course, it’s well within the ambit of the current conservative majority to simply ignore Hencley when it suits them. And they probably will. But it will be another good example of a court that has completely abandoned principle for politics, and another good argument for radical reform.
