The basis of the charges – the checkbox on the form and partying blindly through tax filing season – are neither significant federal charges nor commonly made cases. There’s about 50 million American gun owners guilty of the form violation who are never getting investigated, much less charged. And the odds of being prosecuted for failing to file are worse than getting hit by lightning.
How would seeking to file in any other federal jurisdiction change any of that? It’s still the same prosecutor looking at the same conduct.
