– We have a moral obligation to everyone in the country, but people in detention who might die otherwise,

    Fat Hitler has signed an EO that would ban employees of Seattle based Perkins Coie from ever working in the federal government or holding security clearances, targets the firm with a baseless EEOC compaint claiming discrimination against white men and for which there is no complaining witness, bars Perkins Coie employees from entering federal buildings (like federal courthouses, detenction centers, prisons), and unilaterally cancels all previously signed contracts between the firm and any agency.

    Excellent idea at a time when ranks of DOJ are increasingly short handed owing to DOGE.

    Hard to say what they’re doing. I’m tempted to think they’re trolling the firm, but I think they’re actually serious.

    This could be a boon for criminal defendants represented by Perkins Coie lawyers. If their lawyers aren’t allowed in the federal courthouse, they’re deprived of their constitutional right to legal representation, therefore can’t be put on trial, and can’t be held indefinitely because they’re entitled to a speedy trial, so they’ll walk free. And white collar defendants will rush to hire Perkins Coie lawyers …

    “They didn’t ask me for any ID,” Machado said. “I was telling the officer if I can give him ID, but he said just keep my hands up, not moving. After that, he told me to get out of the car and put the handcuffs on me.”

    An agent then asked Machado how did he get into the U.S. and if he was awaiting a court date or if he had a pending immigration case. “And I told him I was an American citizen,” Machado said. “He looked at his other partner like, you know, smiling, like saying, can you believe this guy? Because he asked the other guy, ‘Do you believe him?’” …

    Machado said the experience shook his faith in Trump’s immigration enforcement efforts.

    True, the constitutional prohibition explicitly applies to Congress; but it’s hard to imagine a president can, by executive order, deprive citizens of rights in a manner that would be unconstitutional if done by the legislative branch.

    In any case, when you slap an attainder on one of the nation’s leading law firms, employing some of the country’s sharpest lawyers, you can expect it to be contested. And boy, if you ever wanted a test case for establishing limits on executive orders, this is the case.

    I think there are a few partners there who would take an interest in responding to this, troll or not.

    It’s the kind of thing that directly impacts the business. You can’t really represent a client’s federal appeal if you can’t appear for them and if you can’t visit them in custody for example. Even if like every other EO nothing about it is ever enforced, just saying it can hurt the business. And it would levy all these sanctions upon the firm and its partners for no discernable public interest reason, just an old political grievance.
