Correction: Julie Le is not an AUSA. She is an associate at Erickson, Bell, Beckman, and Quinn in St. Paul, Minnesota. Looks like she’s been with the firm for about three years and has been admitted to the bar in MN for about 2.5. Very, very inexperienced and obviously thrown in way over her head.
She is working as a private attorney on behalf of the United States Attorneys Office for the District of Minnesota because Elmo and DOGE did such a good job of firing all the people that the lying troll says deserved to be fired that the local office is no longer able to keep up with their work load and nobody will come to work for them anymore. So they employing outside counsel.
And this is what you get. A brand new baby associate with almost no experience. At least she knows she has professional obligations to advocate on behalf of the clients her firms assigns to her to the best of her abilities. But that doesn’t mean she has to lie for them or pretend they aren’t gigantic fuckups either.
And probably nothing in this viral story is more indicative of the shitshow going on within this Team of Clowncar Fascists than the fact that they sent assigned outside counsel to respond to a show cause hearing in federal court. I trust the judge to recognize the degree of contempt that this displays for his court.
@88 There’s a separation of powers issue here. The 4th Amendment requires a judicial branch judge to sign off on probable cause for an executive branch LE search of private premises. For this reason, an immigration judge’s warrant, much less an ICE agent’s warrant, can’t satisfy 4A requirements.
Not only don’t ICE administrative warrants, and immigration judge warrants, fail to satisfy the “signed by a judicial branch judge” requirement, but they also don’t have to, and often don’t, satisfy the 4A’s “probable cause” requirement. Reasonable suspicion that someone may be an illegal alien isn’t sufficient to enter private premises without consent.
The 4A warrant requirements are typically thought of in a criminal LE context. By contrast, ICE enforcement activities and warrants are civil in nature. An ICE warrant is similar to an inspection warrant (think EPA or health code enforcement). But despite the fact execution of an ICE warrant doesn’t expose a person to criminal jeopardy, the 4A protections of private premises are not relaxed for civil enforcement. ICE still needs a search warrant signed by a judicial branch judge to enter private premises without consent.
Also, note that an arrest warrant isn’t a search warrant. If cops show up at your door with an arrest warrant for someone claimed to be at the premises, but without a search warrant, they cannot legally enter without consent.

The problem, of course, is what happens if ICE agents knock on the door of a private residence, present a warrant signed by an ICE official or immigration judge, demand entry, are refused, and force entry (perhaps harming the property and/or the occupants in the process). Under the 4A and caselaw, that is an unconstitutional entry and illegal use of force, but because of expansive immunity and restrictions on suing federal LE, there may not be a practical legal remedy.
In my view, and this is just my opinion, the Todd Lyons memo authorizing ICE agents to enter homes and other private premises without a judicial warrant should strip ICE of qualified immunity, because the agency policy and directives to personnel are illegal per se. The agents in the field can’t be blamed for not following policy, as grounds to overcome their qualified immunity on an individual basis, because they’re following policy. The grounds for forfeiting immunity are agency-wide.
