All right. Let’s all dry out before the next round. I hope your houses and places of employment are relatively dry.

  • I saw a lot of people biking yesterday and throughout the atmospheric river. While it definitely kept me off my bike, good infrastructure is better than good weather.
  • Pete Serrano seems like a real piece of work. Also, he has too many jobs.
  • The SPOG contract is not ideal. (second item)

    In her direct testimony as a prosecution witness the defense attorney testified that it was her understanding of the judge’s directions that she and her client should exit the jury room hallway to the public hallway where ICE agents were known to be present. And that is in fact where they exited. She described herself as being afraid and confused that day and that her “head was spinning” and she was “freaked out”. So her recollection may be imperfect. But she is the only eyewitness to that verbal exchange involving the accused that provides insight into requisite intent. Overheard or recorded comments from other court personnel, including their conversations with the judge have far less probative value. Whatever was discussed and/or recorded on courtroom audio, the conversation between the judge and the defense attorney was not. That attorney, a sworn officer of the court, has now testified in the record that she was not sent down the stairs as the prosecution alleges.

    Not jury nullification if the jury believes a witness that the prosecution put on the stand.

    My pesonal speculation is that Dugan probably meant for the defendant to exit via the stairs. But that isn’t what happened. And my speculation about her intent is not the standard of proof required. I didn’t see direct eyewitness testimony indicating the alleged intent. I saw some confused, and uncertain direct eyewitness testimony that was exculpatory with respect to intent. In other words, it’s a very weak case and that’s probably why the judge declined to take the stand. She doesn’t really need to prove anything to the jury. That’s the prosecution’s job. And they didn’t do it very well. So a jury following the law could very easily vote to acquit. Closing underway.

    But really, this if funny af. On a day where Republicans everywhere are being roasted alive over new revelations about their routine sexual traficking of children, the troll neeeeeeeeds to change the subject and get really focused on yet another otherwise dull, weak, poorly presented political prosecution from Pam Bondi.

    🚨🚨 New: WJLA has learned that Marvin Fernando Morales-Ortez, who is accused of killing someone a day after being released from jail in Reston, Virginia, is in the country illegally and faced numerous previous charges in Fairfax County, including being charged in a separate murder without ever facing justice.

    Fairfax County County Commonwealth’ Attorney Steve Descano nolle prosequi the man’s first-degree murder charge earlier this year, allowing him to walk free and allegedly kill another person this week.

    Court records indicate that since 2020, Morales-Ortez has been charged with at several crimes in Fairfax County, including a first-degree murder charge in 2021.     Virginia Gov.-elect Abigail Spanberger is considering Kincaid for a top Virginia State Police position, according to sources.

    To illustrate, let’s imagine a different charge, with similar intent requirements: intentional homicide.

    “We are asking you to draw the line. Why? Because judges should not commit murder.”

    Duh. Nobody should commit murder. That’s why there’s a fucking law against it. But any time as a prosecutor you find yourself begging the question in closing then you should stop and ask yourself why?
    Most of the time it’s because you failed to put on a convincing enough case.

    But that’s just more of me speculating. Maybe the jury will be convinced. Maybe the defense failed to provide reasonable doubt. Personally I think the defense attorney’s testimony gave them reasonable doubt. And I think the prosecution knows it. And that’s why they used this kind of closing argument. But I don’t think anybody can predict what a jury will do in a case like this.

    GNRC’s share price fluctuates a lot, and I’m pretty sure you’ve noticed, since you’ve been using options to effectively short the stock. That works if you get the timing right, but since accurately timing a stock is a matter of luck, that’s gambling.

    Of course, when owning a stock, you should always look at the underlying business, although I’m not convinced you’re doing that while flipping GNRC options.

    Looking at Generac as a long-term stock, its earnings and stock price fluctuate, but are trending up. In Generac’s case, the company is making money, has a dominant position in the industry, and a huge addressable market, which makes it a reasonable investment in my view.

    What you do, of course, is your business. Your money is yours to lose. If you had owned Tesla shares, instead of playing around with options, and held onto them (as I’m doing with Generac), you’d have made back your paper losses and wouldn’t have realized losses.

    Being a dumbass also is your personal choice and privilege.

    Hope you aren’t in for a disappointing surprise.
    The jury acquitted on the misdemeanor concealment charge. That act of concealment is a necessary element for a finding of guilty on the felony. The reason for giving the jury both is so that, in the event the jury does not find intent to obstruct, they can still vote guilty on concealment. But they got it exactly backwards.

    This opens a couple of opportunities. First will be a defense motion for JMOL (JNOV in state court). If the judge denies it’s an automatic appeal and a stay of judgement.

    Basically either the judge or the jury fucked the dog here. Either the jury got good instructions and failed to follow them. Or the judge gave them shitty instructions. Judges hate to admit they gave shitty instructions and will bend over backwards to find a way to blame the jury. So if the judge denies the motion for JMOL he’s admitting that he sent them in to deliberate with bad instructions.

    So basically they found her guilty on one count and not guilty on a similar count. I’m not sure where this case will go from here, but normally when the elements of two counts are the same they merge, and a jury can’t find a defendant both guilty and not guilty of the same crime.

    She was found innocent of concealing a criminal. She was busy obstructing while the criminal walked from a public place into a place not ordinarily used by the public into another public place, without stopping and visible to anyone who happened to be looking while in the same spaces. Being visible is how he got caught. It’s not like she had him hiding in her robe while she was obstructing ICE efforts.

    The judge’s instructions to the jury will likely factor into this, as stated @ 150 by someone paying attention and as completely overlooked @ 151 by someone unable to read past a headline and first paragraph. The foreperson was quoted:

    “I will say the jury followed [Judge] Adelman’s instructions faithfully,” the foreperson said.

    The troll’s analysis of the jury verdict relative to the charges is incorrect. (Big surprise!)

    In simple terms she was charged with a felony of obstruction by concealment. Her indictment charges that she did willfully seek to obstruct justice by concealing from DHS agents the person sought in their administrative order for removal.

    But she was acquitted of the misdemeanor charge of concealment. The specific act of concealment alleged in her misdemeanor indictment is the very same one that forms a predicate element of the felony charge.

    The jury concluded that the government did not prove to the standard required under law the charge of concealment. Therefore, as a matter of law the government did not prove the charge of obstruction.

    What will unfold now will he an internal struggle for the judge between their very strong reluctance to recognize jury error and overturn a bad verdict (which would trigger public outrage and damage public confidence in the court) and their reluctance to send a jury error likely of the judge’s own making up to the circuit for analysis under appeal.

    Predicting the outcome of that internal struggle and whatever comes of it is just as impossible as predicting juries. But I thing the chances for a JMOL are low. I couldn’t speculate on the chances for a successful appeal without a trial transcript, including all jury instructions, and a fairly laborious circuit analysis to understand that circuit’s history on these specific issues involving jury instructions and the included charges.
