    1) not having presented the indictment to the full grand jury;
    2) misinforming the grand jury about the Constitutional rights of the accused to remain silent at trial;
    3) having presented to the grand jury evidence obtained without a valid warrant constituting privileged communications between the accused and the counsel representing the accused in the present procedings;
    4) evidence that the court and the DOJ have characterized as “highly exculpatory” was withheld from Halligan’s presentation to the grand jury, in violation of the law;
    5) Halligan having been legally barred from presenting any charges to a grand jury against James Comey after the FBI executed an illegal and warrantless seizure of the communications between James Comey and his attorney in this case, and after which Halligan ordered and received a “comprehensive briefing” on the content of those communications before filing the indictment;
    6) the statute that grants the DOJ a possible six months to bring a new indictment “does not permit the filing of a new indictment or information where the reason for the dismissal [is for] some other reason that would bar a new prosecution”.

    There is probably lots more. And many of these aforementioned defects, bars, and instances of potentially criminal misconduct in the prosecution are for obvious reasons highly summarized and can be expected to encapsulate multiple individual errors, defects, and criminal offenses on their own, any one of which can be grounds for subsequent dismissal.

    The merits decision in this case removing Lindsay Halligan as United States Attorney for the Eastern District of Virginia settles only one of what are obviously a large universe of prosecutorial defects and blunders that abused and misled the grand jury and deprived the accused of due process and other important rights. Any appeal of that decision will be limited to that question alone. And any resolution of such an appeal in favor of the obviously vidictive prosecution will not overcome any of the other serious flaws.

    I guess they had better invade Venezuela now to distract all their mouth breathing idiot voters from realizing what a bunch of fuckups they all are.

    But today the entire United States is engaging in an otherwise unprecedented exploration of the UCMJ and even a plaque or two displayed at the military academies. And it would be naive as fuck to think that senior command officers in current service are not following along with interest, all the while conveniently being reminded not only of the words they spoke when they took the oath, but also the actual legal consequences for ignoring or forgetting them.

    It would have been a whole lot easier for Fat Hitler and his MAGASTAPO to get a National Guard General Jack D.     I assume all six will assert the Speech and Debate clause, their First and Fifth Amendment rights, and there’s no need to be polite about it (“Fuck off.”). There’s no benefit in talking to the FBI. No competent judge will issue search warrants based on that video, although Bondi might get a rogue judge to do it, in which case they’ll have a first-rate civil rights cause of action, not to mention a bar complaint against her.

    To put this all in context, Trump believes it’s illegal to criticize him, so it’s logical that he also believes it’s illegal to say soldiers don’t have to follow his illegal orders, even though that’s the law enshrined in the UCMJ and elsewhere. And there’s no honest broker at DOJ or the FBI to set him straight.

    So, because they’re all sheep, they’ll probably press forward with this, and crash and burn in the courts.
