    Yesterday I mentioned the impending strike by Long Island Rail Road employees. Did not have time to mention the potential one among engineers and electricians at the Southeastern Pennsylvania Transportation Authority. At 12:01AM they went on strike. This could have been prevented, at least temporarily. Governor Corbett could have requested President Obama appoint a PEB under the Railway Labor Act, and while they were investigating, it would have been up to a 240 day moratorium. He did not make the request. I don’t know if work rule reform was in the negotiations, it I think that they got some room to cut. SOUNDER runs with an engineer and conductor, and sometimes a security guard or two checking fares. SEPTA sometimes has 5 conductors on a train.

    The reason why there could be Federal intervention in these disputes, is that operations like SEPTA and LIRR are legacies of private railroads, whose commuter operations were taken over by state agencies. SEPTA is former Pennsylvania Rail Road and Reading, while LIRR is former PRR. They are covered by the Federal Railway Labor Act, whose contracts don’t exactly expire. These debates usually are over amendments.

    SCOTUS ruled today that lying on a federal firearms form about who you’re buying a gun for is, in fact, a crime. But this ruling barely squeaked through on a 5-4 vote.

    The majority wrote “the law helps keeps guns out of the hands of those not legally able to buy them, including those with mental illness or previous felony convictions.”

    The dissenting justices were the usual rightwing suspects; and to those guys, straw man purchases of guns for violent criminals and crazy people are perfectly okay and ought to be legal.

    Once extremists get appointed to the court, there’s nothing anyone can do about them. We all have to wait — sometimes decades — for them to retire or die off. The only satisfactory answer is to keep them from being appointed in the first place.

    And that means never voting for Republican presidential candidates, because it is Republican presidents who appoint whackjobs like Roberts, Alioto, Thomas, and Scalia to the court. The only way to keep them off the court is by never electing a Republican to the White House. Never.

    So, no matter how disagreeable a Democratic presidential nominee might be, you’ve got to vote for that person. Because if you don’t, you’ll get SCOTUS decisions like the one we almost got today. We dodged a bullet this time, but just barely.
