Judicial Activism
On Tuesday, former King County Prosecutor Chris Bayley had an excellent Op-Ed in the Seattle Times discussing the growing problem of judicial activism in our state. To many, “judicial activism” may seem like another media buzz word. We saw the term used frequently during the Supreme Court nomination process of John Roberts and Samuel Alito. However, contrary to what you might think, judicial activism is a very real problem. It is a dilemma that affects citizens both nationally and locally.
Bayley in his Op-Ed, thoughtfully puts judicial activism into perspective. He correctly asserts that despite media attempts to frame judicial activism as a “conservative” cause, it is a problem that goes beyond simplistic ideological labels. The examples he gives are very compelling. One involves the Washington State Supreme Court redefining second-degree murder in 2002. The court’s ruling triggered hundreds of appeals throughout the state and stripped law enforcement officials of a traditional statutory tool. Immediately after the ruling, the state legislature stepped in and unanimously reenacted the statue.
Earlier this year in March, King County Superior Court Judge Michael Spearman ruled that convicted felons could have their voting rights restored even if they had not paid their court fines and victim restitution. In his decision Judge Spearman ignored prior case law and concluded that the state had not provided justification for denying the right to vote to felons who had not paid their fines. State Attorney General Rob McKenna has appealed the decision. Once again, this is a clear case of judicial activism.
This November, when you go to vote I encourage you to pay extra attention to judicial candidates. Judicial races may be low profile, but they have a significant effect on our local government.
As Bayley accurately concludes: “Judicial activism threatens the state constitution and serves to undermine public confidence in the courts and all of government. Liberals and conservatives alike should find this unacceptable.”

Atheist activist Larry Darby running for attorney general
MONTGOMERY, Ala. (AP) — Larry E. Darby, founder of the Atheist Law Center, announced Monday that he will run for state attorney general as a Democrat next year, and his beliefs include decriminalizing marijuana.
Darby is the second Democrat to enter the race for the office now held by Republican Troy King. Mobile District Attorney John Tyson Jr. announced earlier.
Darby has been active as an atheist, first serving as state director for American Atheists and then founding the Atheist Law Center in Montgomery. He served as its president until stepping down recently to purse his race for attorney general, but he still serves as general counsel.
As an atheist leader, Darby helped lead protests against former Chief Justice Roy Moore’s Ten Commandments monument being in the state judicial building, and he opposed a proposed constitutional amendment to ban same-sex marriages in Alabama. Darby said it was writing religious doctrine into the constitution.
The proposed constitutional amendment will be on the ballot June 6, the same day Darby will face Tyson in the Democratic primary. The general election is Nov. 7.

Former Gov. Don Siegelman still will be in a courtroom on the day he asks voters to make him the Democratic nominee for governor, according to prosecutors and defense attorneys.
Siegelman went on trial Monday, accused of bribery and racketeering. He wants to be acquitted of the federal charges by June 6, when he goes against six opponents in the primary election. A poll shows Siegelman and Lt. Gov. Lucy Baxley in a dead heat for first place.

WASHINGTON — A majority of Americans support a controversial National Security Agency program to collect information on telephone calls made in the United States in an effort to identify and investigate potential terrorist threats, according to the first poll on the issue.
A Washington Post-ABC News poll found that 63 percent of Americans said they found the NSA program to be an acceptable way to investigate terrorism, including 44 percent who strongly endorsed the effort. An additional 35 percent said the program was unacceptable, which included 24 percent who strongly objected to it.
A slightly larger majority — 66 percent — said they would not be bothered if NSA collected records of personal calls they had made, the poll found.

By the way, I was in Greece last week and it was shocking to see how much they hate us. As it is, as far as I can tell, and in the absence of any such statement as you suggested, the program is explaining racism by using the example of the three centuries of black oppresssion by majority whites in the USA. Kind of a handy point of reference for students, I would think. You know, at two of the referenced authors (J. K. Krause and Beatrice Mickey, and possibly all three) have doctorates in education, and also work as educators (prinicipals). They may actually know something.

I don’t think so, although I think they presented it sloppily. I think what they’re talking about are attributes of the cdominant culture that grow out of white European cultural influences. For example, Josef A. Mestenhauser, of the College of Education and Human Development at the University of Minnesota writes (emphasis mine):
“The dominant American first order preferences were (with the exception of minorities): preference for a future time orientation…”
They’re apparently not the only educated people who think that the dominant culture and minorities differ on these points.
as for collectivism (as well as future orientation), is it coincidence that some of the ugliest racial dominance in the USA was against the native Americans? In the Journal of American Indian Education, and an article titled “AMERICAN INDIAN CULTURES AND THE CLASSROOM,” Dr. Linda Van Hamme (Director of Research at St. Joseph’s Indian School in Chamberlain, South Dakota) writes:
“The values of many American Indians include the importance of group needs, present time orientation, nonverbal communication and reticence, and spiritual beliefs about nature which conflict with the mainstream values of individual competitiveness, future time orientation, the prizing of verbal skills, and beliefs about understanding and mastering nature evident in most classrooms (Little Soldier, 1985; Nei, 1993; Tippeconnic, 1983).”
