As for a simple popular vote for the presidential office, we developed the Electoral College to prevent the states with larger populations simply pooling their populations to bowl over the less-populated states. At the time, Virginia (my home state) was the big gorilla in the room, so the Framers wanted prevent Virginia from having too much influence at the national level.
Getting rid of the Electoral College would mean states like Montana and Alaska would be treated in an inferior manner and not have any influence on the national political stage. Those states would simply be largely ignored by the federal government. I doubt the lesser states would agree to amending our Comstitution with a plan that would make those states irrelevant.

Again, it’s not the EC per se. It is the 48 individual state level laws that require those states to award 100% of the EVs to whichever ticket wins the most votes in that state. These laws were designed to make the giant (at the time) states like New York, Ohio, and Pennsylvania the dominant players in presidential politics. They were also designed to marginalize and create regional dependencies within those large states by cutting off the influence of Southern Ohio, Northern New York, and Western Pennsylvania, among others. And if anyone bothers to look at the history they’ll see that for many years thereafter the winning tickets were dominated by candidates from those states, and in particular from the right parts of those states.
Over time, this gave increasing power to parties when those parties could in turn come to dominate the politics of those larger more populous states, if only regionally. Population demographics have shifted over time. But the influence of winner-take-all laws and the partisanship advantages they created have only grown more entrenched.
Meek arguments such as those offered by Shortbus are not just ignorant. They are fundamentally anti-democratic. They hand the selection of the presidency over to partisan interests and make our elections vulnerable to both the control and influence of wealthy global corporations and foreign espionage. There is no credible argument that is grounded in either tradition or democratic principles in favor of preserving the winner-take-all state laws. Anyone like Shortbus who makes such a claim mocks the founders.

Plaintiff is unable to access trial relief because the law enforcement officers involved are acting in common under both state and federal authority. So no one single jurisdiction can preside. And no common jurisdiction can exist. So no federal court can hear such a case unless the state cedes its jurisdiction (it will not). And no state court can hear the case so long as the officers claim they were acting under federal authority (they will).
And even if the plaintiff were to be granted trial access they would still have to overcome qualified immunity, wherein the plaintiff must be able to show, before trial, that the precise conduct alleged by the plaintiff has been “clearly established” previously in at trial to have resulted in a violation of rights. And it has to be precisely the same conduct and circumstances. Otherwise a case is dismissed pre-trial. And since it does not go to trial, no matter how egregious the conduct in that case may be, it never becomes “clearly established”.
It’s only a very tiny fraction of the most abusive conduct that ever sees the inside of a courtroom or even faces that risk. Law enforcement agencies and their insurance companies will typically only offer to settle at an amount calculated to represent their cost ahead of trial. The actual cost of a trial, and the potential for any subsequent appeal are seldom ever taken into account.
So most cases are brought in state civil court. And most state laws do not automatically provide for a plaintiff to recover costs, even if they prevail. So attorneys will not take such cases unless they are paid a large retainer in advance, or there are elements in the case that offer large settlements for excess damages. It means that cops are free to beat you up, knock your teeth out, blow out your orbital socket, and put you in the hospital for fun, knowing that unless you have the ability to hire your own lawyer and pursue it, they’ll never have to answer for it.

In all of these studies, the evidence that BLM protests didn’t cause a spike in Covid cases seems pretty clear and consistent. At the same time, gatherings of people not wearing masks in indoor venues like bars are producing a spike in Covid cases. The culprit is indoor crowding and not wearing masks, not crowds of mask wearers protesting outdoors. So, if you want to diss the protests, you’ll have to gin up some other excuse for doing so.
