Those who entered The Capitol unlawfully only after the police had been overrun, who are not known to have committed vandalism or theft, who did not assist in gaining entry or summon others for that purpose, who did not commit any assaults, nor express any intention of doing so are being charged with misdemeanors relating to unlawful entry and trespass. Those who in addition committed vandalism or theft face more serious charges. Those who expressed specific violent intentions, even without committing violent assaults, face still more serious charges. And those who breached the entry points or assaulted police face the most serious charges.
That’s all pretty standard playbook for this kind of violent mass criminal attack against the government. And nothing about the particulars of the charges and evidence against any single individual defendant is going to be very informative or give a clear picture about the overall terror attack itself. That’s why the pre-event planning communications and tactical communications of the most seriously charged defendants is of such interest to prosecutors and the courts. Those statements of tactical objectives, like occupying certain locations or positions, gaining possession of documents or resources, targeting of specific lawmakers, and staging of armed reinforcements more clearly describe the serious and violent nature of the terror attack itself. And of course the one common thread that ties it all together: the stated intention “to do everything possible to ensure that President Trump would be sworn in as President on Jan. 20th”.
And that’s is a discussion that no Republican wants to have at all. They’d much rather talk about Green Eggs and Ham.

1. There’s zero evidence that a LEO was murdered.
2. There’s zero evidence that a firearm was brought into the Capitol building by people who allegedly wanted to take over the government.
3. The vast majority of those in the Capitol building illegally were guilty of no more than trespassing.
4. One firearm discharge from a Capitol LEO seems to have ended everything. A single gunshot and the “insurrection” effort ended.
My observation is that a dozen or maybe two dozen people conspired. My observation is that since nobody brought a firearm, the penalties in

It’s really fascinating to me how consistently we find older, angry white people confronting this fundamental aspect of western criminal justice traditions and pouting about “unfairness”. Criminal intent is a feature of almost any criminal statute. And although there are exceptions, the more serious crimes associated with this terror attack on The Capitol are not among them.
As I see it, at least, this pouting and expressed sense of unfairness simply comes down to privilege. In practice, questions in a criminal investigation surrounding criminal intent offer law enforcement and prosecutors the greatest discretion and leverage in the development of evidence and the bringing of charges. And it’s obvious that historically in the US that discretion has been employed to the benefit of white people, especially those with money. And just as obviously that leverage has been employed to the detriment of people of color and the poor.
So whenever white people of a certain political orientation see that discretion being used against “their own” it frustrates them and feels “unfair”. Well, that’s our system, at least insofar as it confronts the vast majority of the accused.
As I posted earlier, the common thread uniting nearly every single one of these defendants in this terror attack on The Capitol is their clearly expressed criminal intent. Yes, you can go to jail for a long time for having the wrong intent. That’s a feature, not a bug. And it’s a big difference that distinguishes most of these defendants from most of the people Tara calls “Antifa”, or BLM, or whatever.
If Tara’s sense of white privilege didn’t stand in the way of her intellectual honesty she’d have seen that already. But instead, like most white “conservatives” she has to have it pointed out to her.

4. The arrival of an overwhelming force of National Guard troops coupled with the orders from their leaders and organizers including President Trump to leave the grounds is what ended the terror attack.

To be clear about it, she’s a spokesperson. It isn’t “her” argument. It’s her job to deliver it. It’s Biden’s argument.
Biden still believes that as the nation recovers from the pandemic, the terror attack on The Capitol, and four years of GQP incompetence, and as the stimulus package goes into effect, some Republicans in the Senate will break from Moscow Mitch’s planned obstruction. Part of that is his own belief in himself. He seems pretty convinced that given a chance to demonstrate some success and to communicate that opportunity for success one-on-one with moderate Republicans he can bring some of them around.
I think he misjudges them and Trump’s hold over them. I think he’ll far well short of the ten he needs. But I also think that given time and the right political conditions Biden will come around to lowering the threshold. I think the language telegraphs that. He hasn’t said he would oppose changes to the filibuster. Senate rules with respect to the end of debate have changed continuously throughout history. The two-track cloture rules only came into existence in the 1970s. And the current rules were revised as recently as 2017.
Changing of Senate debate rules is actually pretty routine. I don’t think it’ll be a big deal for Biden once he’s had a chance to warm things up a bit.

It’s axiomatic that the records of his multiple violent felony convictions were withheld from the GSA by persons in the White House office of personnel in order for Mr. Klein to be granted the appointments and clearances. This is indicative of the kind of routine criminal misbehavior by the Trump/GOP White House that is probably unworthy of DOJ prosecution.
However, since Mr. Klein was still employed by that White House on the day he attacked police with a riot shield while taking part in a terror attack on The Capitol that may not be the end of it in his case. If Mr. Klein used his position as a high security clearance federal employee in any way that day, then the criminal actions that enabled him to obtain that status are far more serious and a criminal investigation by DOJ is in order.
