    Jack Kennedy is often credited with lowering the highest marginal rate from 91 percent during the Ike years but it was just a proposal – he was killed before he could make it happen.

    LBJ followed through and he lowered it to 70 percent not the 65 percent that Kennedy proposed.

    Middle class in this country was doing just fine with taxes on the rich that high. AOC’s proposal isn’t radical. After decades of the middle class treading water and getting squeezed while the rich got super rich, her proposal deserves to be considered and debated.

    Here’s a brief rundown on how, despite rampant speculation among “journalists” that AMI is magically bulletproof, they might be charged with criminal violations of 18 U.S.C. § 875(d).

    To illustrate we need an example. Let’s say Shortbus goes online and buys himself a “Sniffer Probe” manufactured by TehDumbfuck Inc. The “Sniffer Probe” promises to perform magical feats of discovery or whatever, and comes with a warranty with specific terms. Now of course, there’s no such thing as a “Sniffer Probe”. So TehDumbfuck just fills an old cigar box with a bunch of wires, broken circuit boards, and a 9v battery and puts a USB port on the side.

    Pretty soon Shortbus discovers that the thing does not work at all and demands his money back as a remedy – one specifically called out in TehDumbfuck’s warranty. TehDumbfuck tells Shortbus to pound sand, mutters something about “user error” and “personal responsibility”. Now we all know the right thing for Shortbus here is to contact an attorney. But we know that isn’t his style.

    Instead he contacts TehDumbfuck Inc. by email and threatens them. In his email he sets forth a quid pro quo with specific terms. “Give me back my money and in return I promise I will make no further claims. And I further promise I will not go on Jesse Jones and reveal to the public any information about my experiences with your defective product and your refusal to honor your warranty and in so doing damage your company’s and your product’s reputation.”

    Is this threat a criminal violation of the federal extortion statute?

    -It is transmitted in interstate commerce – email.
    -It includes a specific threat to injure TehDumbfuck’s reputation.
    -The threat is aimed specifically at obtaining cash which is a thing of value.

    Sounds like it works, it meets the elements of the statute, right? Shortbus is in trouble, right? And yet to any lay person this doesn’t sound right at all. Shortbus has a legit claim here under the terms of the warranty. Why can’t he, citing that claim, make a threat in order to produce performance from TehDumbuck? Lawyers make threats all the time. In situations just like this. But lawyers know things “journalists” don’t. In this case they know magic words (fuck the law, right?) arising from case law. A nexus to a claim of right.

    Shortbus has a claim of right owing to the warranty. And this next bit is very important. His threat is directly related to and pursuant to that claim. That’s the “nexus” part. The threatened injury to TehDumbfuck’s reputation arises directly from the failure of the product and TehDumbfuck’s refusal to honor the product warranty.

    Please note here, Shortbus isn’t threatening to publish horrifying video of TehDumbfuck with a horse. In that case, Shortbus would still have a claim of right to his money. But the threat to publish video of TehDumbfuck being violated by a horse would not be directly related to why Shortbus is owed money. And so it could indeed result in a criminal charge of extortion.

    Now Shortbus is not a “media” company. And we can assume that AMI’s conduct would enjoy some deference owing to the First Amendment. And AMI may have a claim of right to be asserted here. They declare forthrightly that their reputation as “journalists” may be damaged if people come to believe that their reporting on Bezos’ divorce is politically motivated. So they may have a legit claim of right to obtaining from Bezos a promise not to say those kinds of things in a public forum. But does the threat to publish dick pics entailed in the terms arise from a nexus to that claim? A reasonable person might say hell no. A US Atty pissed off and embarrassed about an immunity agreement might say it too.

    And perhaps more importantly, a US Atty sincerely motivated by broad public interest, and having become aware of this sweeping, egregious, and routine conduct engaged in by AMI and others, and its negative effects on compelling public interests and the rule of law, might want to establish an expanded precedent case in media law.
