A little follow up to a conversation last week about Amtrak, a little dispute Amtrak is having with the Surface Transportation Board over on time performance. Of the six Class I railroads that host Amtrak trains(the 7th, Kansas City Southern, quit passenger service in 1969, 2 years prior to Amtrak start-up) Norfolk Southern is only above Canadian National Railway in performance ranking. Canadian Pacific and BNSF are near the top.

With Governor Christie out of the race, one of his first things to focus on, is a crisis of his own making, that could have affected him in NY and PA if he had stayed in. Commuter Rail employees at New Jersey Transit have not had a contract in 5 years, and the Rail Labor Coalition has followed what I call the strike calender of the Railway Labor Act. A recent amendment to the act affecting commuter rail operators may be in the DOC’s favor. The change is that the second Presidential Emergency Board is supposed to recommend a last, reasonable offer, and penalties are for the side that refuses. In the case of PEB 249, the second Presidential Emergency Board in this dispute, the RLC accepted the recommendations, since it did not treat the engineers, conductors, maintenance of way employees, mechanics, and electricians like other state employees, NJT and Governor Christie refused to accept the recommendations.

Roger – last night I was doing some cleaning up and organizing, going thru my previous 25 years of tax returns so that I can shred what I don’t want and scan the rest and then shred them too.
I came across my 2003 tax return, filed in 2004, that included loses for stocks. I thought I’d share my bad investing techniques with you.
On 1/17/03 I dumped a bunch of stocks that I probably bought right before 9/11/2001, but I am not sure, maybe it was even after 9/11/2001.
I invested $4.946 in 80 shares of Cisco, 3 shared of Caterpillar, 20 shares of Home Depot, and 140 shares in a Company called H Power (HPOW) and CS (which was split into two different companies, one called ETS and the one called RSTN. I know the last two (or three, however you consider them) probably mean nothing to you – I’d give you the full names but I ripped up and tossed out the paper I wrote them down on and would have to dig out the 2003 return again to state them and I don’t feel like it. But anyways, other than the last two, the other stock were ok. It was the last two that really were shitty picks.
So, on 1/17/2003 I sold everything and they were only worth $1,720 – a loss of $3,226. But if I still had those stocks today, the Cisco, Cat and Home Depot stock alone would be worth $4, 525, without any consideration of any dividends that they may have paid, if they did – solely based on Today’s current price.
But the two crappy stocks were 45% of the $4,946. If I had taken that 45% and invested it in one of those other stocks, then today the investment would be $7,723 (if all Cisco), or $9,909 (If Home Depot), and $7,094 (if all Cat). Again, not considering any dividends and I guess splits.
That was the my first and last attempt to buy any stocks. I later played around with Mutual Fund Investments, but again with the same results.
Although I learned the valuable less of just sticking with it in the long haul I still can’t do it.
Currently, even my 401k is invested in the Stable Fund (earning a guaranteed +/- 3%). I did invest in other funds just recently, but again, I made the same mistake of selling as soon as a drop in the market.
The only good thing I can say is that none of my 401K was invested in anything but the Stable fund before 9/11 and up until after 2008 crash. I was lucky enough not to take any of those loses which would have probably been compounded by me getting out if I was in, furthering no gain as the markets climbed.
Not at all implying that you are putting yourself at risk, really just writing this to bolster your comments of hanging in there for the long haul.

You remember, the ones that wanted to keep slavery as a legally protected institution, and expand it as the number of States increased.
That was the whole point of the 14th and 15th Amendments.

The Courts Scalia was referring to were the State Courts, who had either supported the Jim Crow Laws, or repeatedly refused to consider ruling on them. In other words, in Scalia’s opinion, the States do have the right to use legal means to restrict sufferage to certain demographics if they so choose to.
The Declaration of Independence has no bearing whatsoever under the Law. It is merely the document written in as polite and succinct a manner possible to tell the King to go fuck himself.

It overrepresents people from small rural states who tend to be Republican, and underrepresents people from states like California and New York with large urban populations who tend to be Democratic. Johnson’s contention is silly for another reason, too. Even if Democrats win the White House and a Senate majority in November, does anyone believe Republicans will let them appoint whoever they want to the Supreme Court? Even after the American people of spoken? Of course not, they’ll filibuster any nominee they don’t like, which is basically anyone even slightly to the left of Scalia. It takes a supermajority to confirm a Supreme Court nominee.
So what’s the solution? There isn’t one. I think Democrats should do the same thing to Republicans they do to us. If Obama, who was chosen by the people twice, can’t appoint Scalia’s replacement then why should a Republican president, if they win in November, be allowed to do so? Democrats may not have enough votes to confirm an Obama nominee, but they sure as hell can block a GOP nominee, and that’s exactly what they should do if Republicans don’t allow a vote on Obama’s nominee.
In other words, if Republicans want to put it off until the next presidential election, then Democrats should play that game, too. Let the Court operate with 8 justices and tie on every case of consequence until kingdom come! What goes around, comes around! It’ll be D.C. gridlock in its most perfect manifestation.

I like the idea of putting forward a half dozen or so moderate, highly qualified, well liked nominees and giving the committee the option to hear them in whatever order they like. Give them the choice to either go through the motions of rejecting a whole slate of highly qualified nominees, or flat out refusing to consider even a single one of them. Either way, it’ll destroy Senate GOP approval ratings going into November. If the Senate GOP are going to whore themselves out like this, Dems should seek to make it cost more than it’s worth.
A bunch of these pricks are already looking past November and plotting their next moves with all the money this will bring in. They should be made to reconsider. If Republicans actually manage to pull back from the brink on this, it’s a win for progressives. We drain a little out of the GOP money swamp, and we replace an authoritarian religious zealot on the court with a reasonable person. If they don’t pull back, they lose seats in November. The White House needs to see this as an opportunity to either punish Senate Republicans or bring them to heel.

Here’s how the Dems should play this, but it requires the cooperation of Sen. Schumer, their probable next Senate leader. The Democrats have already used the nuclear option to eliminate filibusters of lower-court judicial nominees. Schumer should tell McConnell that if Obama nominates a moderate and he doesn’t allow a vote on that nominee, then if our party wins the White House and Senate in November, we’ll go thermonuclear and also eliminate filibusters of SCOTUS nominees. So he’s running the risk that a President Sanders or Clinton will be able to confirm extremely liberal justices (even socialists!) with simple majorities if he’s unwilling to accept a moderate appointee from President Obama. Then we’ll find out what McConnell really thinks of Trump’s, Crud’s, or Robotio’s odds in November.

The Constitution, the evolution of public opinion, and the march of history are all on the side of expanding legal protections to women, minorities, workers, children, and the disabled. Any moderate, however “moderate” will tend to move in that direction. When it’s allowed to, the law and the Constitution work pretty well to protect regular folks. We don’t necessarily need any avowed liberal justices on the court. Just competent moderates. While Senate Republicans debase themselves, President Obama gets to be the grown up here. And that’s good for everyone (except swing and blue state Senate Republicans).
