Federal Court Rules Washington Must Let Inmates Vote
A three-judge panel of the 9th Circuit ruled today that a Washington state law that bars prison inmates from voting violates the 1965 Voting Rights Act.
The ruling is based on the fact a disproportionate number of inmates are minorities.
“The lawsuit contended that because nonwhites make up a large percentage of the prison population, a state law prohibiting inmates and parolees from voting is illegal because it dilutes the electoral clout of minorities,” KING 5 News reported. “The state contended that the lawsuit should be dismissed because the law was not intended to discriminate against minorities.”

In addition to the Katrina discussion (and in contrast with Puddy’s faulty memory of his own):
1. Hurricane Katrina was a natural disaster. The consequences of the disaster are a result of policy choices from within the Bush administration, with the assistance of the then-Republican Congress.
2. The seeds of disaster were sown through early decisions by the Bush administration to effectively dismantle FEMA. Bush considered the FEMA as organized during the Clinton administration to be a glorified welfare program, and one of his early goals was to dismantle it. His vision, and those of his administration, was for FEMA to be little more than a small coordinating-agency which had no professional staff of emergency workers. It’s primary purpose would be to disburse contracts to private companies to provide emergency services, and to place most disaster relief duties upon state and local agencies (yet another un-financed federal mandate).
2. As a consequence of # 2, above, there was a huge out-flux of trained emergency responders from FEMA. The agency was unable to provide emergency services at anywhere near the scale needed.
3. The privatization and out-sourcing plan didn’t work. Resources were not pre-positioned, tested, or even contracted for in even modest amounts. The talent drain had left an agency which didn’t anticipate the need for ice, and was left days later trying to buy truckloads of ice from around the country with bad delivery instructions, resulting in some trucks criss-crossing the country for several days until the ice was no longer needed (or melted). Previous disaster plans had been thrown in the trash cans by arrogant political appointees with dismissive comments such as “Americans won’t live in tents”, etc.
4. The flooding of New Orleans was entirely predictable, by anyone with a smidgeon of common sense and reasonable news knowledge. Anytime a hurricane comes within 500 miles of New Orleans, news articles had regularly reminded the readers that New Orleans had a significant flood risk. The Bush administration’s protestations that “nobody could have predicted” the scale of the disaster was laughable in New Orleans, where jus the year before the Times-Picayune had ran a series which turned out to predict the flooding, and it’s impact, quite accurately.
5. What happened in the weeks and months after Katrinia was an example of the most cynical and malicious of political game-playing of a Machiavelli character. The decision was made from within the Bush administration that although public efforts would be made to look like the re-building of Katrina was a national priority, every effort would be made to de-populate the city, and to spread it’s minority inhabitants (who tended to vote Democratic) among reliably red-state relocation sites, thereby disbursing their political impact to insignificance. This was done by making very public large-scale appropriations of rebuilding money, but placing a strangle-hold on the approval of any disbursements of money. This was surprisingly easy, as no money would be approved to allow tenants to move back within the city, only to property owners for their losses. The government wouldn’t loan money to the N.O. utilities to restore services, so no one could move back into areas with no electrical, gas, or sewer services, and then the goverment wouldn’t approve disbursement of loans to those areas without residents or public services available. It’s the typical type of catch-22 an adminsitration which wants to solve problems can find ways to resolve, but an administration which is satisified with the status quo is happy to allow to prevail. The end result was that only the wealthier sections of New Orleans were rebuilt, the hardest-hit sections, including the lower 9th ward, remain mostly vacant. The political consequences are that Lousianna is now a reliably Republican state in national elections.
6. Early promises to New Orleans businesses that they would receive the lion’s share of rebuilding contracts were outright lies. Even as those lies were being uttered, the Bush administration was signing no-bid contracts to politically-connected firms to manage the entire re-building effort. Haliburton subsidiaries received the greatist majority of those contracts. They, in turn, sub-contracted with other firms, mostly Texas companies (many employing laborers who’s right to work in the U.S. was suspect). By the time the government held a meeting in New Orleans with businesses who wanted to participate in the re-building effort (about three weeks after the hurricane), they were told that the contracts had already been issued. There has never been any regular audit of those contracts because the contracts were written for lump sums, without any right for the government to audit the firms being included in the contracts. But it appears that the Haliburton subidiaries were making about $350 per hour for labor in removing debris from New Orlean’s streets, and they laborers themselves were receiving minimum wage. The only contracts which went out to New Orleans businesses were ones issued by the City of New Orleans or the Parish itself.

As a lawyer, I get to see the dingy basements of every profession–medical, accounting, engineering, law enforcement, politics, whatever. I come out being proud to be a lawyer. So, I could give a rat’s ass about your idiotic poll. Americans are kind of stupid at the moment, and how they vote in polls that don’t matter doesn’t much matter. My clients love me.
