Wednesday Open Thread

by Carl Ballard — Wednesday, 3/4/26, 7:55 am

Good morrow ladies, gents, and all the lovely people who don’t slot well into the binary.

  • Data center regulation is dead this session.
  • Ban new ICE facilities and old ones. And despite members’ concerns, local jail.
  • Yesler bike lanes that don’t randomly end forcing you into traffic? Yes please.
  • Write your legislators. Or call them. The session is almost over, so you might as well do it now.

In a last minute emergency meeting Fat Hitler dragged Lockheed and Raytheon execs to the White House to demand more ammo.

DOD admitted that the first four days of Iran strikes consumed more long range munitions than four years of Ukraine.

A brief regional conflict with Iran just invalidated decades of faulty planning assumptions.

The past three days have seen the largest increase in average gas prices since 2005. And we aren’t done yet. Academic studies of oil markets show that in the past, a $10/bbl increase in average crude oil prices takes about four weeks for the full effect to show up at punp prices of an increase of $0.25 in the U.S.

Crude prices over the past 5 days show an average increase of $7.48/bbl with pump prices rising $0.22 So the magnitude of price increase is about 20% greater in about 1/6th the time.

Giant sustained jumps in pump prices combined with big drops in investment markets would doom Republican’s midterm chances.
So it’s very likely that in any sustained conflict of attrition with Iran, U.S. strategy must soon shift away from securing the regional security interests of Israel and toward securing the flows of gulf state petroleum products and petrodollars. This will quickly shift from air warfare to high seas naval warfare in asymetrical engagements. The U.S. navy is not well set up for that. Blowing up unarmed fishing boats is not the same thing as protecting high volume shipping lanes from sea drone attacks.

That was a Pakistani SSK in 1971, first SSN, well HMS Conquerer did sink a former American Cruiser. Another first though, this was the first combat sinking with a Mk48 Torpedo.

I toured Blueback down in Portland, in the torpedo room’s, they had three torpedoes representing the four decades of service. Mk14, Mk37, and Mk48.Apparently described until now, the Dud, Sub-Killer(by accident, USS Scorpion), and until now because only in SINKEX’s, the Overachiever.

You will not police your way out of the homeless crisis.

Across the U.S. average jail stays are $38,000 per year. King County is much higher.
Shelter is cheaper, even without accounting for the extraordinary costs of criminal processs required to put a homeless person in jail. Criminalizing being too poor to afford a home not only costs much more than just housing them, it leads to increased levels of homelessness. It’s just fiscally irresponsible.

Using air and sea drones at an average cost of about $40,000 Ukraine has sunk or disabled the 12,000 ton Moskva, the 3,400 ton Saratov, the 2,800 ton Olenegorsky Gornyak, and the brand new 1900 ton Sergey Kotov, among many others. And now the Black Sea is without a Russian Black Sea fleet, since all remaining surviving vessels have been forced to withdraw.

After blowing up the fuel terminal used to service the fleet, the attack disabled the minesweeper Valentin Pikul and damaged two antisubmarine patrol ships the Yeysk and the Kasimov. Sixteen Russian sailors were wounded and three killed in the attack using about 100 drones.

    20,
It is still far cheaper to build and operate shelters, even with those regulatory costs that irk you. $44 per day for a shelter against $190 per day for a KC jail inmate. And that’s only if that jail inmate requires no medical attention, psychiatric treatment, or addiction treatment. Then daily costs soar to almost $400.

Even with the regulatory costs for permits, planning review, and impact mitigation, building shelters is many times cheaper than jail.

    Don’t you like money?

19)Been watching coverage of some of the major defense conferences like the Surface Navy Association, and contractors are working on a solution to cheap drones, but still involves expending expensive missiles. One is equipping a Burke with a strap on launcher BAE Systems is marketing for other ships that would provide additional quad packs of Evolved Sea Sparrow Missiles, plus a new round for the main gun. Also a push for lasers and electronic jamming.

    https://youtu.be/92wflwChho0?si=-ZjGbNDQ7Ui5Wip8

The Italian Navy solution is using the OTO-Melara 76mm gun as CIWS for frigates and above. Some ships including aircraft carriers have three, using special rounds that airburst high velocity projectiles. Originally developed to fight supersonic missiles. The 57mm Bofors that the LCS, FFX, and Coast Guard cutters use, also have that capability.

Today in the courts, in CAIR v. DeSantis, wherein the governor designated by executive order a Muslim advocacy group a “terrorist organization,”

The First Amendment bars the Governor from continuing the troubling trend of using an executive office to make a political statement at the expense of others’ constitutional rights. The Governor’s decree coerces third parties, under threat of losing government benefits, to disassociate from the Council on American Islamic Relations (“CAIR”), thereby closing avenues of expression and suppressing CAIR’s protected speech. Once again, Florida chooses political posturing over the First Amendment. …

This Court finds that Plaintiff has demonstrated standing on its coercion claim. With respect to that claim, Plaintiff’s theory of standing is not based on direct censorship of its speech, but rather on Defendant’s coercion of third parties to cut ties with Plaintiff, thereby creating a prior restraint to Plaintiff’s future speech. …

Plaintiff’s motion for preliminary injunction … is GRANTED.

    https://www.scotusblog.com/2026/03/court-unanimously-sides-with-government-in-immigration-dispute/

The Supreme Court unanimously sided with the federal government on Wednesday in Urias-Orellana v. Bondi, holding in an opinion by Justice Ketanji Brown Jackson that federal courts of appeals must use a relatively deferential standard of review when assessing the Board of Immigration Appeals’ determination that asylum seekers did not experience the level of persecution necessary to qualify for asylum protections.
    …
On Wednesday, the court held that the INA requires appellate courts to apply the relatively deferential substantial-evidence standard, meaning, as Jackson explained in the court’s opinion, that reversal of the BIA’s decision is “warranted only ‘if, in reviewing the record as a whole, any reasonable adjudicator would be compelled to conclude to the contrary.’”

Jackson noted that the relevant part of the INA “does not use the phrase ‘substantial evidence.’” However, she continued, multiple other phrases in the statute “truncate[] the court’s review,” including Section 1252(b)(4)(B), which states that “the administrative findings of fact are conclusive unless any reasonable adjudicator would be compelled to conclude to the contrary.” The Supreme Court has previously held that this subsection “prescribe[s] a deferential, ‘substantial-evidence standard’ for review of agency factual findings,” Jackson wrote.

Perhaps. But perhaps, if you pay very, very extra close attention you might notice that hundreds of Democrats in the House along with most Democrats in the Senate will be breaking with Israel and AIPAC on this stupid war and voting no. But perhaps no more than one or two Republicans will.

There’s some good information for you in that if you can ever bring yourself to really pay attention long enough. And it’s a more than passing possibility that, should Democrats win control of either or both chambers this fall, a coalition may form to challenge for the leadership positions that is ready to jettison the AIPAC lobbyists and U.S.-Israeli policy once and for all. It’s one of the reasons Harris lost. She wasn’t ready to go there. So a huge chunk of the Obama/Biden coalition dumped her for that reason. $3.35/gal at my corner station. Was $2.85 before the bombings, then went to $3.05 right afterwards on Monday and now 3 days later it’s $3.35. An increase of .50 in less than a week. We’ll be lucky if we can go without rationing it.

The more the silly cries about supply disruptions and rationing continue, the higher Exxon’s share price.

China might see some supply tightening in the next 90 days but the US won’t.

There’s no way this isn’t corrupt:

Homeland Security Secretary Kristi Noem handpicked contractors to lead a $100 million campaign to recruit Immigration and Customs Enforcement officers instead of allowing competitive bidding for the jobs, according to three administration officials and internal communications reviewed by NBC News. …

In August, then-ICE deputy chief of staff Madison Sheahan threatened the job of an ICE employee for suggesting that the agency consider other contractors, according to internal communications. Sheahan said the contract award was “a decision made by the secretary,” according to internal communications.

Sheahan then called the employee to her office where he was yelled at for overriding Noem by suggesting the contract go to a company that was offering to do the work for a cheaper price, said an administration official who heard the conversation. The employee then acquiesced and agreed to award the contracts to the companies Noem chose, the three administration officials said. …

In a statement, a DHS spokesperson said, “Decisions about the ICE recruitment campaign contract were made by the ICE Director’s office. … But the three administration officials said acting ICE Director Todd Lyons’ office was not involved in choosing the contractors for the recruitment campaign and maintained that the decision came from Noem. …

The contract for the ICE recruitment campaign was awarded to People Who Think and Safe America Media, two firms that were previously awarded a $220 million ad campaign ….

    https://www.nbcnews.com/politics/national-security/noem-handpicked-contractors-lead-100-million-ice-recruitment-campaign-rcna261968

    Yeah, this firm:

Firm Tied to Kristi Noem Secretly Got Money From $220 Million DHS Ad Contracts

The company is run by the husband of Noem’s chief DHS spokesperson and has personal and business ties to Noem and her aides.

@123 Why do you care about Exxon’s share price? You don’t own stock. You’ve repeatedly said so yourself.

It could become a bit of a dilemma for me, because if Exxon’s share price goes too high, there’s an obvious incentive to cash out before it falls back, but then I’ll have to pay a lot of taxes.

Understand, I’m not against my Exxon shares skyrocketing, that’s part of what I own them for, but I’m just sayin’ this war making me richer doesn’t come tax free.

However, so far Exxon’s P/E is only 22, so there’s still room to let it run.

Exxon is actually down 1.1% since last Friday. This war isn’t helping its share price at all so far.

Ken Paxton is offering to drop out of the Texas primary if the Senate eliminates the filibuster and requires proof of citizenship for voting.

At some point, not tomorrow, eliminating the filibuster would mean statehood for D.C. and Puerto Rico, Supreme Court reform, reinstating ghe Voting Rights and War Powers Acts, and and a national abortion rights. And Republicans would have Ken Paxton to thank for all of it.

Markwayne made a comment today about ‘stepping in as acting Secretary’ immediately.

By federal law he can’t do that as a sitting Senator. If he even accepts the job and begins confirmation he’s done in the Senate. You know you don’t get to vote on your own confirmation or ask questions of yourself at your confirmation hearings.

Republicans, why do you keep electing people who don’t have the slightest clue what is and isn’t legal and constitutional?

So, you killed 26 people with an invasionary force to try to get back some bones you weren’t eve sure were there?

Failed and killed 26 people in the process?

This is not normal in any way.

Israel’s military said that its special forces had operated in Lebanon overnight on Saturday in an attempt to find the remains of the Israeli soldier Ron Arad, who has been officially missing since the 1980s. The mission was unsuccessful, according to the military, which said there had been no Israeli casualties. Although the Israeli military said only that they had operated in eastern Lebanon, the Lebanese National News Agency reported earlier on Saturday that an Israeli commando operation took place overnight in the Bekaa Valley and that 26 people had been killed.
