    He dialed up Elizabeth Warren after she gave a speech on the future of the Democratic party. He invited Chuck Schumer to the White House to talk about a New York infrastructure project. And he invited Peter Welch to an Oval Office event on an initiative important to Vermont.

    For a president who wants his party to retain control of Congress, itโ€™s a striking โ€“ even unexpected โ€“ level of outreach to some of the most liberal members on the opposing side.

    ICE has been routinely violating the 14th Amendment since last summer, so they’ve likely racked up quite a lot of legal liability by now.

    I think intentionally violating basic constitutional rights should overcome qualified immunity, though there’s no telling how far this Supreme Court will go in facilitating fascism.

    Minnesota is a joint and several liability state (modified). And ยง1983 does not create any cause of action against the federal government. Nor is the federal government lawfully permitted to indemnify any state or municipal employee, even when such an employee is acting under the direction of a federal agency or officer (Brownback v. King). So under any such lawsuit, unless a defendant is found to be at least 50% at fault (Minnesota statute), the state, and state taxpayers will pay 100% of the damages in all cases.

    They are not “sanctuary” laws. They are risk management and state taxpayer protection laws.

    @14 You’re right, and that raises an interesting question. If a detained and abused toddler who turns out to be a U.S. citizen sues the state under ยง1983 and pursues an FTCA and/or Bivens claim against DHS, how do you apportion damages?

    Of course, this is mostly theoretical, because I can’t imagine any but a couple of third world red states being stupid enough to participate in home invasions, secret arrests, and kidnappings of citizen infants and toddlers.

    This Supreme Court would decline to hear an appeal on a circuit court ruling denying QI. Because to do so at that level would create a precedent applying across all circuits uniformly.

    As it currently stands, the “clearly established” standard exists independently in each of the 13 circuits. Once any circuit holds that a statutorily or constitutionally protected right was abridged, as particularized by the unique circumstances in each case (prong 1 of the Saucier test), but also holds that any reasonable official would not have known that such a right was “clearly established” (prong 2), then QI is granted. However, once QI is granted that right as particularized by the unique circumstances of the case, becomes thereafter “clearly established”, but only in that circuit.

    That’s why the Supremes deny cert for QI appeals, either way. In most cases it would deprive law enforcement of greater immunity than if they remain silent.

    FTCA claims are limited to the classes of claims authorized in the statute and further limited to specific monetary damages arising from property loss or damage, or physical injury resulting in costs for medical treatment. They do not extend to civil or constitutional rights. And the administrative claim must be deemed exhausted before a civil suit may be filed in federal court.

    Bivens, in these cases, would be limited to 4th Amendment claims only. And QI applies to Bivens claims. Moreover, a Bivens claim may not be brought unless and until all lower court and administrative claims are exhausted (Egbert v. Boule). One common defense against Bivens claims is to extend administrative adjudication indifinitely, driving plaintif expense beyond the reach or capability of most claimants.

    The Leg should bar ex-ICE agents from police work in our state. It isn’t arbitrary. These folks have been trained to use racial profiling, excessive force, and to violate rights. No amount of retraining can unlearn these habits. Their presence would undermine the integrity of our state and local police agencies, and influence other officers to join them in unconstitutional policing. Such a ban is lawful; being a LEO is a privilege, not a right, and the law already bans felons and other undesirables. Passing this legislation merely adds another class of undesirables to the list of persons banned from LE work.

    Two Minneapolis trained observers were unlawfully detained by two ICE Fat Asses and being transported to the Minneapolis ICE detention facility to be tortured when the ICE Fat Ass driving began having a medical emergency and became incapacitated.

    While waiting for EMS to respond the two observers asked to be uncuffed so that they could render life saving first aid assistance. The other Fat Ass did so, albeit reluctantly. They marked the time, stabilized the driver, kept him alive until EMS arrived, communicated his vitals to the EMS and to the ER physicians, and helped guide and reassure the stricken Fat Ass as well as his partner.

    They were taken back into custody at the ER and delivered to the detention facility to be unlawfully tortured.

    The acting FBI supervisor of the Public Corruption Squad in the Minneapolis field office, Tracee Mergen, resigned last week in part over the investigation of the fatal shooting of Renee Good by an Immigration and Customs Enforcement officer earlier this month, according to multiple sources.

    Mergen left the FBI “in part due to the pressure on her to reclassify/discontinue the (Good) investigation,” a source with knowledge of her departure told CBS News. Another FBI source said Mergen “would not bow to pressure” from leadership.

    Her squad, which also handles civil rights cases, was involved in both the Good investigation and the ongoing probes into public benefits fraud in Minnesota. Mergen’s departure was first reported by The New York Times.

    The fatal shooting of Renee Good at the hands of an ICE officer was initially treated as a civil rights investigation, but Justice Department leadership later ordered the FBI and prosecutors to treat it as an assault on a federal officer and instructed them to investigate Good’s wife, CBS News previously reported.
