    Yes and no, mostly no.

    The Fourth Amendment requires a judicial search warrant to enter a home, but SCOTUS has carved out two exceptions: Hot pursuit of a criminal, or exigent circumstances (e.g., a homeowner holding a gun to his spouse’s head).

    Immigrant removal is civil in nature, so the pursuit exception generally doesn’t apply to ICE, although arguably if someone assaulted an ICE on the street and then ran inside, they could go in after him, because assault is a crime.

    If ICE agents conducting detention and removal operations encounter a domestic violence in progress, they should call the cops, because they’re not authorized to make criminal arrests of citizens.

    But let’s get back to the DHS memo. Todd Lyons, the ICE official who wrote it, isn’t a lawyer, and has his head up his ass. He claims to have vetted it with the DHS Office of General Counsel; if so, those lawyers have their heads up their asses, and should be hauled before their respective bar disciplinary boards for incompetence.

    Lyons has a law enforcement background, and like more than a few cops, mistakenly believes an arrest warrant for a person inside a residence is all police need to enter the residence. That has gotten plenty of cops sued.

    This moron goes even further and claims an administrative warrant for civil detention is as good as a search warrant signed by a judge. This assertion is even weaker than the unfounded claim that an arrest warrant gets him in the door. His memo invites a raft of FTCA and §1983 claims against the government, though I have a feeling the ACLU will be taking Lyons and ICE to court for injunctive relief on this very soon.

    No LE is exempt from the Fourth Amendment and Supreme Court cases interpreting it. Not the FBI or Secret Service. Not Border Patrol or ICE. Not state or local police. It applies across the board, to every dude with a badge and gun in the U.S., no matter who they work for.

    If you’re a capitalist leech like me, and you live off the wealth created by workers, you don’t have to put up with employers who play games like in the video.     • It’s still a phase II study.

    • It’s randomized with a 2:1 distribution favoring the use of both drugs vs just the MAb. Still, only 107 patients got both.

    • The autogene has to be injected nine separate times, every 21 days. That’s in addition to the MAb administration. BTW monoclonal antibodies are no picnic for the patient, regardless of the illness requiring their use. The MAb is intravenously infused every 21 days, possibly up to 18 times if the patient lives a year.
