7PM: Few right-wing groups are more vocal than the Building Industry Association of Washington (BIAW), which is in the midst of shattering campaign finance records by spending millions of dollars to put their hand-picked candidates on the state Supreme Court. But one hot-button topic they’ve been silent on is the issue of illegal immigration… and now we know why: as the Seattle Times reports today anywhere from 50 to 90 percent of residential construction workers are Latino immigrants, many of them illegal. Did the BIAW bust the unions and replace them with low cost, illegal workers? Are you willing to crack down on immigration if the result is dramatically higher food and housing costs?
8PM: Over $1.8 million has already been spent on behalf of right-wing Supreme Court challenger John Groen, most of it viciously characterizing Chief Justice Gerry Alexander as a senile, baby-killing boozer. What if anything can be done to prevent wealthy special interests like the BIAW from buying the bench? Terry Sullivan from Washington Public Campaigns joins me to discuss public financing of elections, an idea whose time may finally have come. Are you willing to pay to get big money out of local politics?

Here is the construction industry’s position on taxes.
Step 1: Around 1900 or so, Washington employers accept a state-administered system of no-fault insurance for injured workers in exchange for tort immunity for workplace accidents.
Step 2: The state collects insurance premiums from employers to pay for injured workers’ medical care and partial replacement of lost earnings.
Step 3: Unlike private insurance companies, the state refunds any premiums that aren’t needed for medical care, wage-loss payments, and administrative expenses to the employers.
Step 4: Employers join private organizations like BIAW who act as intermediaries and collect the refunds for them, who spend the refunds on political contributions and campaign advertising.
Step 5: Employers bitch about high industrial insurance “taxes.”
Roger Rabbit suggestion: Hey, if you’re an employer and want to reduce your workers’ comp premiums, fire the fucking BIAW, stop spending your refunds on political propaganda, and buy your wife a new set of dishes or take her out to a nice eatery! Du-uh … it ain’t rocket scientist, dummies!

As for any union-busting, Goldie- when was the last time there was any significant union presence in residential construction?
I remember union workers in the residential market- my father was a union carpenter. There hasn’t been a significant union presence in the residential market in three decades- and we’ve seen the rise of the Hispanic work force in the residential market in just the past five years or so. So where do you get the union-busting, Goldie? More invented facts?
In fact, what has happened in the residential construction market is that the smaller, local contractors have been forced out, and larger developers- often from outsdide the area- now dominate. There is- and has been for years- a problem with an underground economy in construction. Non-registered contractors, paying under the table and below scale, not paying taxes, worker comp premiums, or anything else- and aided and abetted by Home Depot and others who sell materials off the books. Legitimate contractor groups- including BIAW- have fought hard for the enforcement of the laws against this type of activity. Our outgoing L&I director, Gary Weeks, had his regional administrators make themselves available evenings and weekends so we can catch these operations.
But that was all occurring before the growth in the Hispanic workforce.
In fact, you might remember that the painters who walked off the job May 1st, and who were eventually hired back, were union members, making union scale. The Hispaniocs- legal or illegal- are becoming dominant in this workforce because they are willing to work, and work hard- unlike the lazy white boys.
The Hispanics workin for the drywall contractors I’ve represented are making $20 to $30 an hour, plus benefits. And the contractors are taking every legal step to verify immigration status. But what the Times forgot to say is that if a contractor insists on looking past the face of the documents provided, they’ll get sued by the very liberal groups that are so concerned about the downtrodden worker. They show up with an authentic looking Social Security card, and a valid Washington state drivers license, and you’d better not ask any other questions.
But, o course, this is about BIAW bashing, not about shedding light on any given issue- even if these contractors are members o BIAW only because the state runs an inadequate worker comp program so yo HVE to join a retro program to keep costs nder control. No, no need to go looking for the real issues when we can just get up on our high horse and flail away at “the enemy”, and collateral damage be damned.

Hey, I feel sorry for Richard and wouldn’t wish his personal problems on anyone except Mark the Welsher, but if he can’t even run his law practice then he sure as hell can’t run a court! There is no good candidate for Northeast District Court, but Frank LaSalata only THREATENED to throw small claims litigants into jail — there’s no proof he actually did it! Hold your nose, vote for him, and pray to God you never have to appear in his court!

In the early part of the century- 1911, to be exact- worker’s comp was put in place for a few high-risk industries. It was not extended to all employers until the Dan Evans administration, in 1972. Large employers are allowed to self-insure, and- starting about 1980, groups of like employers were allowed to band together in “retro programs” to handl their claims.
Unfortunately, the only part that Roger Rabbit got correct was that the state assesses taxes to pay for the program. The state doesn’t refund to intermediaries like BIAW. Groups like BIAW run the retro programs- and the retro programs, like the self-insureds, seem to be able to handle the program for one-third less than the state does.
those employers participating in a retro program get back the excess premims. Those stuck in the state-administered program get nada. Is it any wonder that employers join retro programs?
The BIAW keeps 20% of the refunded premiums, from which it runs its programs. It pay the claims administrators and all the other employees of the program. And- because the state program is so expensive- the rebates back to privately administrated programs are quite large. Out of those rebates, that 20% also provides a lot of money that wouldn’t otherwise be available for political action. And the rebates wouldn’t be so large if the state ran a program- and charged premims- comparable to what the self-insureds and the retro programs do.
So, yes, employers- especially those stick in the state-administered program- bitch about the high worker comp premiums.
And if the state ran an efficient and well-administered program, they wouldn’t be over-charging at the front-end, and providing such a wonderful source of funding for BIAW at the back end.
But people like Roger Rabbit won’t tell you the real story- the state of Washington is the BIAW enabler. Clean up L&I, and you’d dry up BIAW.

I didn’t come to Washington State until 1979, so I haven’t been aware of what kind of Workman’s Compensation system was existent in Washington before that date.
But if they didn’t make Workman’s Compensation universal until 1972, no wonder the Union movement was so strong here! Of course, by the time you have the large (unionized) employers like Boeing covered by Union contract, and railroad employees and sailors and fishermen covered by federal law, then only small employers would have their employees at risk. There isn’t ANY part of this statement that you got right! Call them “taxes” if you want, worker’s comp is insurance, and the employer and employee payments functionally are insurance premiums no matter what you call them. And worker’s comp was indeed a political compromise that got employers off the tort hook in exchange for no-fault coverage of all workers injured on the job.

If L&I wasn’t charging excessive premiums because it cannot run its program properly, BIAW wouldn’t be getting anything.
The retro program that BIAW runs is funded out of that 20%; the BIAW- just like the Restaurant Association and others- handles the claims management for its members, and does such a better job than the state does for those stuck in the state program that the members get about a third of their worker comp taxes back- and that wouldn’t happen if L&I was efficient and competent.

Keith Ellison’s Excuse Brigade — the “don’t touch Keith” crowd in the DFL, the media and the blogosphere — has gone into overdrive for the man who is the DFL’s choice to represent Minnesota’s Fifth Congressional District in our nation’s capital.
The Brigade cut its teeth on Ellison’s 40 or so unpaid parking tickets, and his nine moving violations since 2000. Its candidate hit the campaign trail in June with a suspended driver’s license, thanks to his failure to pay his fines. This was nothing new for Ellison, who seemed unfazed. “I don’t know how many prior suspensions I’ve had,” he told the Star Tribune. “I don’t keep count.”
In dismissing Ellison’s irresponsibility, the Excuse Brigade didn’t even break a sweat. What’s a suspended driver’s license when you’re an attorney fighting for social justice? Sometimes your great work can’t wait (speeding ticket), and sometimes you’ve got to fight for the oppressed no matter how long it takes (expired meter).
Ellison’s defenders brushed off their candidate’s $25,000 in unpaid back taxes — incurred some years ago and later paid — in a similar spirit. Let’s face it: When you’re on a crusade to right big wrongs, you’ve got little time for the petty details of personal life — license suspensions or tax liens. Anyway, this stuff has nothing to do with running the people’s business, right?
Ellison’s lengthy history of campaign-finance disclosure violations posed a greater challenge. The state attorney general sued him twice over filings, and his record includes numerous warnings, a default judgment and a collection agency. When Ellison accepted the DFL nomination in May, he faced fines of over $2,500, including $1,500 for a “willful” violation that could have been charged as a criminal gross misdemeanor.
But it’s Ellison’s history of support for Louis Farrakhan — and the notoriously anti-white, anti-Semitic Nation of Islam — that has set the Excuse Brigade scrambling. Ellison says that his association with the Nation of Islam was limited to 18 months in the mid-1990s — a claim that the Brigade has repeated.
He also says that he failed to scrutinize Farrakhan’s positions sufficiently. Today, Ellison proclaims brotherly love, and all is forgiven.
But facts are stubborn things.
Ellison’s support for Farrakhan dates from at least 1989, when he wrote an article defending “Minister Farrakhan” for the Minnesota Daily. In 1995, he was a Minnesota organizer for the Million Man March, which the Nation of Islam convened. In 1997, Ellison publicly supported the executive director of the Minneapolis Initiative Against Racism when she allegedly called Jews “among the most racist white people.” The Star Tribune described Ellison as a “representative” of the Nation of Islam in an article about the incident. In 1998, when Ellison made his first run for the Minnesota House of Representatives, the paper described him as “well-known in the black community as … a supporter of Louis Farrakhan and the Nation of Islam.”
The Excuse Brigade has sought to counter these inconvenient facts by falling back on the nuclear option — the B word. Folks who draw attention to Ellison’s support for Farrakhan are bigots, they say. Case closed.
So far, the Excuse Brigade has said little about the latest Ellison revelation. A few weeks ago, Nihad Awad, executive director of the Council on American-Islamic Relations in Washington, appeared at an Ellison fundraiser, and he and at least one other CAIR employee have donated to Ellison’s campaign. Sen. Charles Schumer (D-N.Y.) described CAIR as an organization “which we know has ties to terrorism.”
Mike Erlandson, an Ellison opponent in the primary election, criticized Ellison for appearing with Awad, whom Erlandson described as a supporter of the Palestinian group Hamas.
Why is the Excuse Brigade pouring so much energy into Ellison’s defense? Any other candidate with half this record would likely be persona non grata in any political party.
The truth is plain, if unpalatable. Many are willing to overlook Ellison’s record because they are breathless with excitement at the chance to send the first Muslim — and the first black Minnesotan — to Congress.
Ellison’s candidacy may be a defining moment for the DFL. Is this the new face of the party of Hubert Humphrey? Heavy hitters such as Walter Mondale and Mayor R.T. Rybak have endorsed Ellison, and DFL fundraisers extraordinaire Sam and Sylvia Kaplan have raised big bucks for him.
The question of the hour is this: Is Ellison’s DFL also the party of Amy Klobuchar and Mike Hatch? We have six weeks to find out.

Hey Roger, here’s a question for you. Since we get no income tax deduction for our contributions to the social security system, shouldn’t the benefits from the system come to us tax-free? As it is now, up to 85% of the yearly beneift is subject to income taxation, depending on the recipeint’s other income. Isn’t taxation of social security benefits double taxation?
