Sure it might be tempting to sit outdoors tonight, enjoying our beautiful summer weather, but are you nuts? You could be hit by one of those meteors! So come inside, turn up the radio and tune in to “The David Goldstein Show tonight on Newsradio 710-KIRO, from 7PM to 10PM.

7PM: Within hours of the revelation that British police had foiled a terrorist plot to blow up 10 airplanes over the Atlantic, Republicans were busy exploiting fear for political gain. Again. I invited Rep. Dave Reichert to join me to talk about our government’s appropriate response to terrorism, but apparently he’s afraid to come on my show. So Democratic challenger Darcy Burner will join me instead to talk about what we’re doing right and wrong in our so-called “War on Terror.”

8PM: Hey… wouldn’t it be great to get a free, zero-interest, $1.275 million mortgage? That’s what SAFECO gave former CEO Mike McGavick to entice him to move back to Seattle. And yet, rather than paying back SAFECO shareholders for their largesse, McGavick just lent his Senate campaign a cool $2 million. Washington State Democratic Chair Dwight Pelz will be joining me, and you can be sure I’ll be pumping him for a few choice soundbites. 9PM: Incumbent US Senators never lose primaries. That is, until the netroots-fueled campaign of Ned Lamont defeated 3-term incumbent Joe Lieberman Tuesday in Connecticut. Does this election signal the ascendancy of the blogosphere? The decline of the Democratic Party? Or simply the fact that a majority of Connecticut voters are sick and tired of Joe being used as a tool to prop up the Bush administration’s failed policies at home and abroad?     UNDERASSESSMENT IN THE HIGHLANDS

    I looked at Mike McGavick’s property records (Assessor Parcel No. 3304700290) because Goldy pointed out this $1,275,000 mortgage. You can’t tell what the interest rate is from the King County recordings (since promissory notes aren’t recorded, just the deed of trust), but this was one of two loans — the first mortgage being a market rate loan for $1,925,000 — that the McGavicks took out when their home purchase in The Highlands was recored on July 2, 2001 for $4,475,000.

    By the way, record title to the McGavicks’ home is not held by the McGavick’s personally, but by “John F. Donohue, III, Trustee of the Scimitar Trust of 2001”. (Scimitar, noun, a saber having a curved blade with the edge on the convex side and used chiefly by Arabs and Turks)

    What was really interesting was the property tax assessment of the McGavicks’ home by the King County Department of Assessments — in light of the property being sold for $4,475,000 on July 2, 2001:

    2001 — $2,726,000
    2002 — $2,922,000
    2003 — $3,117,000
    2004 — $3,261,000
    2005 — $3,424,000
    2006 — $3,715,000
    2007 — $3,669,000

    There is a lag time is assessments, of course. For example, the 2007 assessment (which was calculated this year 2006 for property taxes to be paid in 2007) is based upon a statistical analysis using sales data from 2004 and 2005.

    So the 2003 assessment for $3,117,000 was based on sales data from 2000 and 2001. And the 2004 assessment for $3,261,000 was based on sales data from 2001 and 2002.

    Normally, the assessed value of residential property results in an assessment level of 98% to 99%. That means that houses assessed for 2004, which sold in 2001 and 2002, were assessed at an average of 98% to 99% of the sales price.

    McGavick’s house, on the other hand, which sold in 2001, had an assessment level for 2003 of 69.7% and an assessment level for 2004 of 72.9%.

    I presume that other homes in The Highlands are similarly underassessed at about the same rate as the McGavick’s residence.

    Given that the property tax rate in Shoreline is around $12.00 per $1,000, and that the average residence in The Highlands is worth $4 million or more (and likely underassessed by $1 million or more), the property owners in The Highlands are each saving well over $10,000 per year in property taxes, compared with what would happen if they were assessed at 98% to 99% of value.

    I wouldn’t say every, just most. Legalized bribery in the form of institutionalized lobbying is the single largest corruption of our constitutional democracy. I don’t see how this is an “unfortunate” situation, though. If government is rotten to the core, and I think it essentially is, then it is our responsibility as citizens to rectify the situation.

    A class-mate of mine’s family lost their house to fire because the FD couldn’t find the house. . .Subsequently. the Fire and Aid were allowed in to the Highlands about once a month to familiarize themselves with the layout.     The Highlands By-Laws are a 46 page document that was re-written completely in 1996 and recorded under Auditor File No. 199612231398. There is a 4 page amendment to The Highlands By-Laws made in 1998 and recorded under Auditor File No. 199809091463.

    Nothing juicy — probably because the original by-laws of The Highlands didn’t make it extremely difficult to amend. By contrast, Innis Arden (just north of The Highlands) has some highly offensive deed restrictions on the type of people those lots can be sold to. Legally unenforceable, but highly offensive, and they never could get enough property owners in Innis Arden to sign off on eliminating these. So the legislature recently passed a law to facilitate the elimination of such offensive and unenforceable deed restrictions.

    Roger Rabbit comment: Yesterday, I posted on HA that I plan to vote for Richard Pope for district court judge because neither of the other candidates for the position are suitable to occupy a bench.

    The incumbent, Mary Ann Ottinger, is so bad she was suspended without pay by the state Supreme Court last month. Ottinger repeatedly violated the rights of defendants, even after previously being disciplined for it. Her most egregious abuse of power involved sentencing a juvenile girl to 375 days in an adult jail for an underage drinking offense not involving driving — without telling the girl she was entitled to an attorney.

    The founding fathers — who risked their homes, property, and lives to throw off tyranny — understood when they wrote the Constitution that the greatest potenntial threat to our liberty is not foreign enemies but our own government. They wrote the Constitution and Bill of Rights to prevent abuses of power.

    Beorge W. Bush should not be president for the same reason Mary Ann Ottinger should not be a judge. Neither of them takes the Constitution seriously or respects the rights it enshrines. Both placed themselves above the law and abused the power entrusted to them.

    I endorsed Richard Pope for district court judge because, even though I disagree with many of his political opinions, his comments on this board evince both a competent knowledge of law and a respect for the constitutional rights of accused persons. Richard understands — even if many of our resident trolls do not — that these rights do not exist to protect the guilty, but to protect the innocent from mistakes or overreaching by the very government officials the trolls say they do not trust. In Ottinger’s and Bush’s cases, their mistrust is well placed.

    “Restraints on alienations” refers to deed restrictions on who you can sell your property to. For example, “no property owner may sell his home to a Democrat” would be a restraint on alienation. My understanding is anyone buying into the Highlands has to be approved by the homeowners’ association, like getting into a country club or fraternity, but I may be wrong.

    I also read somewhere, years ago, that the Highlands precinct had the highest concentration of communist voters in the state. Guess who the live-in servants were voting for …

    Looking at The Highlands By-Laws, it seems like there are at least two significant restraints on alienation.

    First, if you want to sell your property, any existing Highlands club member, or The Highlands club itself, has the right of first refusal. And the first refusal right to purchase is set at the appraised value determined by club appraisers, as opposed to the price you may want to sell the property for.

    Second, your prospective purchaser had better become a club member. New membership is open to people who have binding purchase contracts (which naturally would be contingent upon membership approval). So if membership isn’t approved for the prospective purchaser, they basically have no meaningful rights to their property — which is why purchase contracts are contingent.

    If you actually manage to sell your property to a person rejected for membership — and The Highlands club doesn’t exercise its right of first refusal — the new owner would be prohibited from accessing the property (can’t use the private roads, etc.) and wouldn’t be able to receive any utilities.

    However, there is nothing in The Highlands By-Laws providing for beheading anyone with a scimitar …

    This is not just a gated community for security reasons, but a gated community which even excludes the fire department, except by appointment only! Which won’t allow the assessor’s office in, requiring them to conduct appraisals by air!     #1) The US has no viable alternative but to cut its losses and end its occupation of Iraq. The entire premise of invading and occupying a sovereign nation that posed none (zero, zip, nil) threat either to the US or to Iraq’s immediate neighbors (think about that for a while) was criminal from the outset. We owe the Iraqis nothing less than our immediate withdrawal, allowing a UN peacekeeping force to come in and try to restore the peace. In reality, this will almost certainly mean the dissolution of the so-called “democracy” we have installed at gunpoint, with the country devolving into 3 separate states. Not that this scenario wasn’t foreseen, but the ideologues in the White House chose to ignore it, as well as the very real destabilization this dissolution is likely to cause in the region.

    #2) As for an outward show of weakness, the world is largely in tune with the military weakness this nation displays in choosing to attack third-rate, backwater militaries (Iraq, Afghanistan, etc.). It’s got to be fairly disgusting watching the equivalent of a professional boxer taking on a handicapped five-year-old. As citizens, we should be embarrassed and outraged at this sort of immoral bullying and fight-picking; instead, right wingers are so scared shitless of the specter of terrorism that they ignore such unpleasant realities. Your assertion that “our ability to gather intelligence will be gutted by liberals who believe that protecting the lives of Americans violates the so-called ‘civil rights’ of terrorists” belies precisely this ignorance: you are essentially asserting that the US cannot prevent terrorist attacks within the boundaries of constitutional law. If you want to ignore the real causes of terrorism (some of which we cannot control but are almost certainly self-limiting) and choose instead to live in a totalitarian police state that would ostensibly protect you from such threats, then I’d invite you to consider emigration. There are still a few old-fashioned totalitarian police states out there — Zimbabwe comes to mind.

    #3) Bush and Cheney should, by any measure, be impeached and convicted for high crimes and misdemeanors. Rumsfeld, Feith, Perle, Wolfowitz, et al should do hard time in the grey bar motel with them. I’m not normally terribly in favor of capital punishment, but the crimes of these treasonous arm-chair murderers is certainly befitting of such punishment.

    #4) Taxes will increase. How on earth do you expect any government to pay off a federal debt of $8 trillion and counting? Are you prepared to write a check for $28K (sans interest, of course) to cover your share? Add to that the actual costs of the Iraq occupation (which have not yet been added to either the budget deficit or the federal debt) which, in the opinion of some economists, has conservatively surpassesd $1 trillion already (a more realistic estimate puts the cost over $2 trillion). Who the fuck is gonna pay for all this? You? I sure as hell hope you don’t have kids, as you’re bequeathing them with a pretty hefty birth tax.

    Et cetera. It’s pretty easy to poke holes in every single one of your arguments. You really need to educate yourself, at least a little bit;

    I went through a number of sales in the last few years in The Highlands, and there is a pattern of significant underassessment.

    As I said before, property tax assessment is based on sales values from two to three years before — i.e. 2004 and 2005 sales data are used in 2006 to calculate assessment for payment of 2007 taxes. Generally, 2007 assessments for a given home that sold in 2004 or 2005 will average at 98% to 99% of what that home sold for in 2004 and 2005. This ratio is called the “assessment ratio”, and has been at the 98% to 99% level for many, many years.

    However, if you look at homes in The Highlands which have sold in Year X, they will typically be assessed at around 73% of this price in Year X+2 and 70% of this price in year X+3.

    The McGavicks bought their home for $4,475,000 in 2001. But for 2007 — seven years later — it is still assessed at only $3,669,000, or 81.99% of the 2001 sales price.

    I doubt that you could find too many homes that sold in 2001, but have received a 2007 assessment for less than that 2001 sales price.

    During ‘Nam, certain Army interrogators would turn V.C. prisoners over to the ROK troops. They in turn would take them up in a helicopter in pairs. At about 500 feet they would simply kick one of them out the open hatch. The other one would start talking like a jaybird. He would testify to anything just to get back down to the ground.     What the hell is it with Democrats and gambling?

    Last session they passed a law saying that you can’t play online video poker and made it a class C felony. Furthermore, you can’t own anything that portrays gambling in a positive light. Gambling magazine subscribers in this state saw all of their subscriptions cancelled a few months ago.
