Feingold is doing the repubs a big favor by pursuing the censure. It is forcing the issue to the front, so all the facts can be seen. That’s probably why so few dems are supporting him on it. If it was a given illegality, they would be lined up at the microphone. As it is, they are cowering.
Now some FISA judges are saying that the president has consititutional power to order warrantless wiretaps on foreigners. If the other end of that call happens to be domestic, that doesn’t break the law. There is actual case law to support that view.

Today those photographs have created an international media firestorm today and I wanted you to get a full explanation as to what has happened. The “Blame America First” crowd is desperate to malign me, right along with our brave troops who are serving in Operation Iraqi Freedom.

When we traveled to Iraq to support our troops we found that the REAL Iraq was a very different place from what you see reported by the mainstream news media. Most parts of Iraq are peaceful and calm. Violence is almost exclusively limited to 3 out of Iraq’s 18 provinces.
Figures released by Iraq Body Count Press on March 9, updated by statistics for the year 2005 from the main Baghdad morgue, show that the total number of civilians reported killed has risen year-on-year since May 1st 2003 (the date that President Bush announced “major combat operations have ended”):
* 6,331 from 1st May 2003 to the first anniversary of the invasion, 19th March 2004 (324 days: Year 1)
* 11,312 from 20th March 2004 to 19th March 2005 (365 days: Year 2)
* 12,617 from 20th March 2005 to 1st March 2006 (346 days: Year 3).
In terms of average violent deaths per day this represents:
* 20 per day in Year 1
* 31 per day in Year 2 and
* 36 per day in Year 3.
The mainstream media was not happy with our trip and our message that our troops are winning the war and the country is becoming stabilized. The news networks either ignored us or criticized us. But in the last 24 hours they have suddenly taken an interest in our trip to meet with the soldiers and inspect the progress being made in Iraq.
Amazing, MSM has their own reporters in Iraq and don’t report the work of those they have no relationship with. Besides that, who the hell is Howard Kaloogian, anyway?
The reason for their sudden interest is that my campaign posted a picture from Istanbul, Turkey (where part of our delegation traveled through on the way home to the United States from Baghdad) and we mistakenly identified the photograph as coming from Iraq.
Like I said, who knew?
It was a mistake. I accept full responsibility for it. Once I realized the situation, I had the photograph replaced with one of the many photos we took from Baghdad.
It took us all day to find one, but I am told a Sp4 who patrols the streets took the replacement

No Michael, what Repukes do is they vote “for” something on paper, but don’t fund it. For example, the GOP paid lip service to homeland security, but repeatedly voted against federal funding and shoved all the costs on states, which had to lay off cops and teachers to pay for homeland security “unfunded mandates.” The Bush administration dragged its feet for several years on paying for body armor and up-armoring vehicles, so they could give tax breaks to the wealthy, whose fat bank accounts are more important to Repukes than soldiers’ lives. But then, why not? They don’t send THEIR kids to fight their wars. Soldiers are just cheap labor, and Repukes are CHEAP LABOR CONSERVATIVES. They don’t value the lives of coal miners, either — as shown by the fact the Bush administration writes off or fails to collect over 95% of the fines imposed on mine operators for safety violations. The lives of soldiers, miners, and workers mean nothing to them.

No, you don’t have it right. McDermott is asserting that he has a First Amendment right to pass on information he has received, just like a newspaper (or anyone else who receives it) can. This case has been heading for the Supreme Court since it was filed, and it will doubtless remain on course.

Or maybe not. The federal judge originally dismissed Boehner’s lawsuit. The DC Circuit Court of Appeals reinstated it. The U.S. Supreme Court ordered the Court of Appeals to consider the matter further in light of some recent case favorable to McDermott’s position. The DC Circuit did not change its position. The trial judge then ruled in Boehner’s favor on summary judgment. The DC Circuit has now upheld that decision.
The US Supreme Court could still address the matter. But they probably won’t.

There was one thing I thought was very wrong about the District Court’s decision in October 2004 on summary judgment. This was the assessment of $50,000 punitive damages on a summary judgment decision.
I can see the judge ruling in Boehner’s favor on summary judgment on liability. And I can see the $10,000 damages, since the statute specifies a minimum damage of $10,000 for intentional violation, and Boehner did not claim a higher amount of actual damages.
But assessing punitive damages on summary judgment is ridiculous. This should require a trial and weighing of evidence. If either side had demanded a jury, the amount of punitive damages should be a jury issue.
Moreover, $50,000 in punitive damages in a case where the plaintiff had not yet presented any evidence of actual damages is ridiculous. This is unconstitutional punishment and violation of due process to assess excessive punitive damages, without consideration of the actual damages.
It should be noted that the statute is already rather punitive in nature, since the plaintiff is entitled to at least $10,000 in statutory damages, even if they really don’t have much at all in the way of actual damages.
McDermott should have appealed the punitive damage issue as well. But looking at the recent Court of Appeals opinion, he didn’t do this. Too bad.
I have absolutely no confidence that if the shoe were on the other foot the courts would have ruled in a similar fashion. In fact, I have no confidence in this government at all.

Judge Kornblum: To be admissible, the evidence would have had to have been lawfully seized or lawfully obtained and the standard that the district judge would use is that, depending upon where this is, is the law in his circuit. In most of the circuits, the law is clear that the President has the authority to do warrantless surveillance if it is to collect foreign intelligence and it is targeting foreign powers or agents. If the facts support that, then the district judge could make that finding and admit the evidence, just as they did in Truong-Humphrey.

Speaking of KIRO… we got a textbook example of librul media bias this afternoon on Ross’s show. It was unfuckingbelievable. The issue was a bunch of mayors of librul cities complaining about HR 5005 and how it would affect their ability to trace guns used in crimes.
So Ross first had on a guy from the NRA who explained very clearly what the law would and would not do. Then he had on a guy from Nickel’s office who said the exact opposite of the NRA guy.
If Ross really wanted to clarify the issue, then he would have had both guys on at the same time and let them duke it out. But he didn’t. He set up the NRA guy and then gave the mayor’s guy the last word and way more air time. So his real agenda was to discredit the NRA. He has no fucking interest at all in presenting facts or truth on the issue… he just wants to work his left wing kook agenda.
So don’t tell me there’s no librul bias in the media. Unless you have your head up your moonbat ass, it’s right there to see.
