Wednesday Open Thread

– The last 747 has been manufactured. I am surprised how nostalgic I feel about it.

– The bills on what to do about possession of drugs (item 1) is interesting. It doesn’t seem likely to pass, but you can write your legislator in favor of Senator Dhingra’s decriminalization bill.

– Good news for bike infrastructure.

– Fred Clark is good people. Drop him a few dimes if you can spare them. And if you haven’t, go read the Left Behind series.

– Anyway, please wash your hands right now. And get vaccinated or boosted if you’re eligible.

@58 previous re: what am I accused of…

When I purchased a gun in 2019 (“His GOD given right #2a!) I put on the affidavit (“Fuck background checks…it’s just a list so they can seize our guns. ΜΟΛΩΝ ΛΑΒΕ”) I checked the box that said I was not a user of or addicted to drugs. Shortly after signing the form I entered rehab.

At larger issue is how ludicrous our gun safety laws are that it was no problem at all for me to purchase a gun. (“STFU EVERY breathing human should be required to have a handgun. An armed society is a polite society and when the savages come for your family only a gun will protect you”)

In the year I filled out the form less than 500 forms were flagged for potential cases of over 75,000 filed. Of those less than three hundred ever involved any charges. Of those not a single one has resulted in a penalty greater than a civil fine. And some unserious Twat on the Internet believes I should be treated MORE harshly than anyone in the history of Federal form 4473. (“Your GOD damned right. Hunter is the worst kind of criminal. Don’t do the crime if you can’t do the time!”)

As for the taxes, if the authorities can prove that I knowingly and willfully filed false returns or hid assets, as someone with no criminal record it would be expected that I would be sentenced to repayment with penalty and interest. But some unserious twat on the internet thinks I will be sentenced to prison because…reasons.

The same unserious Twat thinks the left will storm the capital if I’m charged with any of these crimes and will likely put a fertilizer and ammonia laden U-haul at an IRS building to seek revenge.

I’m still sober, Thanks for asking. I’m not planning on using drugs today. One day at a time.

You’d be forgiven if you weren’t keeping up to date on the latest and greatest Qanon bullshit.
But while larger public and media attention on the far-right, paranoid conspiracy grift has declined since its peak before the 2020 election, Q is still going strong, especially online.

Q Patriots are still rallying and convoying. Still showing up at school boards and city councils. Just fewer of them and a bit less often. But no less enthusiastic.

Q has always been marginal. Attention getting, influential and spectacular, but marginal nonetheless. And that’s what makes me most doubtful of the theory that Trump just “goes away”. Trump is as much a cult as Q, and a thousand times larger. Some Trump cultists will lay down the burden and return to their mobile homes and RV parks. But a large percentages will never shift their loyalty and devotion to an alternative “outsider” paranoid conspiracy. Trump is their brand.

Trump’s calendar also includes the anniversaries of the deaths of those LE guys who committed suicide over their planning and execution failures that allowed the January 6 riot to occur.

Top Jan. 6 investigator says FBI, other agencies could have done more to repel Capitol mob had they acted on intel
“Law enforcement had a very direct role in contributing to the security failures that led to the violence,” said Tim Heaphy.

The House Jan. 6 committee concluded that the FBI and other federal security agencies could have prevented a violent mob from overrunning the Capitol had they acted on the large volume of intelligence collected beforehand, the chief investigator told NBC News in an exclusive interview — a judgment the committee left out of its televised hearings and final report.

Former federal prosecutor Tim Heaphy, the committee’s chief investigative counsel, said that while he endorses the panel’s main finding that then-President Donald Trump sparked the riot by urging protesters to go to the Capitol, his probe documented how federal law enforcement failures contributed to the debacle.

Telling people to march to the capitol and let their voices be heard is not a proximate cause to a riot. It’s a First Amendment expression, fully included in one of those articles of the US Constitution that didn’t come to mind when Patty Murray’s handpicked eastern Washington box-checking judge was questioned by Senator Kennedy last week. But I digress.

Driving the news: The Peter and Carmen Lucia Buck Foundation, formed in 1999 by the late Subway co-founder Peter Buck and his wife, announced that Buck’s will included instructions to give his 50% stake in the company to the foundation.

Buck died in 2021 at the age of 90, while his wife died in 2003. Both of Buck’s adult sons work at the foundation.
    …
It also lets the Buck estate dodge a massive tax bill were Subway to be sold. WSJ put the price tag at around $10 billion, with the Bucks in line for half of that.
Were the estate to hold the shares and then donate the post-sale proceeds, it would pay taxes on that estimated $5 billion. This way, neither it nor the foundation pay anything.

They tried their best, but Arkansas law enforcement authorities have been unable to protect at least two of their own:

The beating by the three officers took place in August of last year. The next day the Crawford County Sheriff informed the media that the viral video of the arrest only told a small fraction of the full story and that other facts would come to light that would help explain his officer’s actions. A week later Crawford County Sheriff’s Office placed two of the three officers on PAL and launched an investigation when the bystander video became even more widely circulated and reported on by media. After another week had passed and as the video continued to circulate online and media continued to ask questions, the CCSO announced that it was halting its investigation and requesting that the Arkansas State Police investigate instead.

In September ASP turned their investigation over to an Arkansas State “Special Prosecutor” Emily White who then began a extensive review of the findings.

One month after that in early October, with still no decision on criminal charges, CCSO announced that two of the three officers had been fired. Police BWC, dash cam video, and other video and audio evidence was still withheld pending a charging decision by the “Special Prosecutor”.

    November, no charging decision.

December, no charging decision. State of Arkansas says it is still reviewing the evidence.

January 2023, no charging decision. Evidence still under review.

January 7th, Tyree Nichols is beaten to death in Memphis by sport-murdering police. No update from state of Arkansas.

January 23rd, weeks after his death following multiple public disclosure filings, Memphis Police reluctantly agree to allow the family of Tyree Nichols to view BWC and surveillance video of his murder by Memphis police. They announce that edited versions of the video will be made public by the end of the week. After viewing the videos the Nichols family give press interviews describing what they saw. Still no update from the state of Arkansas.

January 24th, US Marshals took Levi White and Zachary King into custody Tuesday morning and went to their first appearance at the federal courthouse in Fort Smith on federal criminal charges in the August 21, 2022 beating of Randal Worcester in Crawford County Arkansas.

Still no update on a charging decision from state of Arkansas.

The real issue Democrats have with Twitter is that they don’t have a ready replacement for it, come 2024. If Twitter doesn’t place its thumb on the scales next time around, Democrats will need an alternative for their shtick. (Spoiler alert: It won’t be horsesass.org.)

    Mastodon is quickly flaming out.

Elon Musk drove more than a million people to Mastodon – but many aren’t sticking around

The number of active users on the Mastodon social network has dropped more than 30% since the peak and is continuing a slow decline, according to the latest data posted on its website. There were about 1.8 million active users in the first week of January, down from over 2.5 million in early December.

Mastodon, an open-source network of largely independently hosted servers, has often been touted as an alternative to Twitter. And its growth appears connected to controversies at Twitter. But for many it doesn’t fulfil the role that Twitter did and experts say it may be too complicated to really replace it.
    …
There were about 500,000 active Mastodon users before Elon Musk took control of Twitter at the end of October. By mid-November, that number climbed to almost 2 million active users.

Not sure what you mean here.

But regardless, where do you believe the other 90% of the data Giuliani was passing around came from? Why were cryptographic signatures scrubbed from 90% of the emails? In the years that passed between the laptop being left for repair, and the data claimed to be from that source being made available for analysis, why were a majority of the files accessed, copied, and in many cases rewritten by someone other than Hunter Biden? Why were many of the file access logs missing? Why were new file folders created in the data years after the laptop had been left with Mac Isaac? Why was one of those newly created folders titled “Salacious Pics”?

    @54,
“quote from Hunter Biden denying content is real,”

I was not aware that Hunter Biden had been provided with a copy of that data.

    When did that happen?

Other than that, he has been quoted denying allegations by Giuliani, Trump, Senate Republicans, and others that were based upon that “content”.

I think it would be impossible to either confirm or “deny” something you’ve never actually seen or examined. So it seems reasonable to me, considering that he’s been notified by the feds that he’s under criminal investigation, to avoid saying things that can’t be true about potential evidence in the possession of the FBI. I think that’s a crime in itself. So his lawyers are probably advising him to be careful while the FBI still has an active criminal investigation.

It can’t be true that Hunter Biden knows whether something the FBI has, which he has never seen*, is either real, partially real, partially fake, or entirely fake. It’s just not possible. He’d have to have access to it first, and then have a chance to either verify it or recall the contents. I think I read that the file data Giuliani was passing around had over 200,000 emails going back years. Nobody can remember 200,000 emails. A reasonable person can see that. Why can’t you? What’s your deal?

*So if you know Hunter Biden was provided a copy of Giuliani’s stuff please do share that. It sounded to me like Hunter Biden was trying to recover his laptop and was being denied access. I think one of the letters his lawyer sent out mentions that. But if you know better, please fill me in.

But that’s the point. That’s where your thinking seems to me to be fucked up.

What you are demanding that he deny or confirm, the “content” of Giuliani’s stuff, is something that he hasn’t had access to as far as I can tell. The forensic computer experts who have been allowed to examine it have found that over 90% of it has been fucked with by somebody other than Hunter Biden. So whatever Hunter Biden can even recall about all of his emails from years in his past when he was an active drug user (which probably isn’t much) it’s got very little to do with hundreds of thousands of emails provided by Rudy Giuliani that have clear evidence of being fucked with.

All he can do is respond to specific allegations. I think he’s done that. You seem to want to convict the guy of things you can’t say by setting an impossible standard.

It sounds that way to me as well. Except by the time he attempted it, it was no longer his laptop. He signed away his ownership by abandoning it. Now he wants to un-ring the bell.

The court case, if there is one, will likely hinge on whether the electronic content on the HD is part of the “laptop”, or whether it’s separate property. IOW he can’t contest that the hardware now belongs to Mac Isaac, but he contests that the HD contents are part of the laptop.

She’ll be a fucking disaster if she becomes president. She’s been a fucking disaster since mid-2019.

“When I ask people about Kamala Harris, they almost universally say, ‘What’s she doing? Where is she?’” said Whipple, whose new book is titled The Fight of His Life: Inside Joe Biden’s White House.

He added, “That’s not because the White House has muzzled her. It’s because, for whatever reason, maybe she felt early on that trip to Guatemala that was awkward and she had some criticism. Maybe she’s just gun shy.”

Klain, he said, has repeatedly encouraged Harris to engage more. “Ron Klain has told her repeatedly, ‘You can’t score runs from the dugout.’ He’s encouraged her to get out there and be higher profile, and she hasn’t,” said Whipple, who said he had incredible access to Klain and Biden’s top team during his two-year book project.

His comments follow multiple stories about the underperforming Harris and concerns in Democratic circles that she’s not ready for the top job.

She won her Senate race in 2016 not because of her experience and accomplishments. She won her Senate race in 2016, over a more experienced Democrat, because she had the endorsement of Barack Obama and Joe Biden. That turned out to be a mistake.

Let’s face it, she is where she is because of 1) skin color and 2) blow jobs given to Willie Brown.

Those things you mentioned are precisely why “Big Media” didn’t run with the story. Fox News asked Rudi for the actual files instead of printed copies of the purported files. So did everyone else. Once totally unserious media took the bait then Fox was clear to go with, “Other outlets are reporting” and go hard and so the echo chamber of Right Hate media got going creating a grand conspiracy. (Remember when we were assured there was a video of Hunter, an underaged girl and some gay sex on the laptop? “I’d like to see the girl” – Matt Gaetz)

This is the lesson even Fox learned from “L’affair de Rather”. Don’t run with a document unless you can really for sure 100% verify its authenticity.

Unserious Twat and his kind treat this as some big tech media conspiracy when what Rudi was offering from the get go was stuff that is so very easy to fake they just weren’t going to touch it ESPECIALLY as Rudi continued to stonewall on the requests that could authenticate. Add to it at this point Rudy was under investigation for his connections to Anti Zalinski Ukranians Lev Parnas and Igor Fruman who were arrested while trying to flee the U.S. Parnas has since been convicted of funneling foreign cash into the Donald J. These are FACTS that unserious twat would prefer no one brings up as he spins theories about Hunter, his laptop, his time spent renting(?) one of his dad’s houses and the voluntary cooperation with an FBI investigation the twat keeps calling “raids”.

Imagine if 6 cops conspired with a buddy to conduct a pretext traffic stop and “teach a lesson” to his ex’s new boyfriend. If prosecutors establish this, every single one of these former public servants is eligible for the death penalty, and the city will pay an enormous legal settlement.

“The FBI is free to announce that the publicly disclosed salacious items found on the laptop are not included in its copy of the hard drive any time it wishes to do so.”

I guess I don’t see what that has to do with your claim that Hunter Biden was “admitting” that Giuliani’s data was “genuine”. You’ve grudgingly admitted that it was a dishonest claim. And you’ve tried to reject the specific denials from Hunter Biden, from the Biden campaign, and from President Biden.

So how does what the FBI announces now or in the future have anything to do with what Hunter Biden does or does not admit?

“The laptop was handed off to the FBI before its copied contents were distributed elsewhere.”

It seems to me this is a deliberately muddled claim. Are you attempting to claim that the copies “distributed elsewhere” match the file contents of the laptop drive in the FBI’s possession? Or are you claiming that the copies were made after the FBI took possession?

Either of those are bad claims, probably bad faith claims. Mac Isaac said that he copied data from the laptop before contacting the FBI about it and turning it over to them. And he’s also said that it was this data that he sold to Giuliani. So we know this data predates and is distinct from whatever the FBI has on the laptop drive. And we know that it is this data that has been forensically analyzed and found to be more than 90% unverifiable with multiple changes and rewrites and portions of the cryptographic signatures deliberately removed after the data was extracted from the laptop. So nobody needs to ask the FBI if the data they have is the same. It can’t be.

Regardless of what the FBI found on the hard drive they got from the repair guy, we know it isn’t the same data as the stuff Giuliani was distributing in 2020. So what the FBI says about whatever files they pulled from the laptop is unrelated to what Giuliani was distributing in 2020.

If Giuliani’s stuff is “genuine” why hasn’t he responded to the forensics that proved it contained files that were altered, added to, and deleted after it came into his possession?

    Yeah, I know all that.

Which is why I asked in the first place, what terrible thing is Hunter Biden accused of doing?

    So far it is
    – on one year’s tax returns that were prepared by an accountant he misstated a portion of his complex foreign earnings on an accounting statement accompanying the filing,
    – and at a point in time when he was in rehab, trying to get sober from cocaine, and when some of the largest media companies in the world were painting a target on his ass, he applied for a gun permit and falsely stated that he had never used drugs.

I don’t think he’s a great guy at all. I just don’t think he’s a big problem either. Not for me at least.

He’s a garden variety fuckup who did some garden variety fucking up. I still haven’t seen anyone show me anything more than that.

“my understanding is that no modifications to the laptop contents were made prior to copying them and handing the laptop off to the FBI.”

Based on what? Some guys unsworn word of honor in a podcast?

The forensic analysis I saw published in reputable national newspapers in 2021 that was based on the data that Giuliani was sending around and that formed the basis of claims against the Bidens made it very clear that the data had been altered in lots of important ways after it was extracted from a laptop hard drive. Those alterations were far from incidental and compromised more than 90% of the files Giuliani was offering.

“I never once mentioned Giuliani. “

No. Of course you didn’t. Because the guy looks sketchy as hell. Even Borat got a piece of him.

What you did mention is Hunter Biden. You called him a “POS” which is your opinion that I might partially share. Although I’m willing to give him credit for completing rehab, staying sober, and trying to turn his life around under what must be very tough circumstances. As I’ve said, he’s a fuckup. A garden variety fuckup. You called him a “sleaze”. I doubt even he would deny that, at least when he was using. You called his family criminals. But so far as I or anyone else can tell you can only base that on the stuff Giuliani was passing around. So you can’t pretend that it has nothing to do with this. Your whole deal is down to those corrupted and altered Giuliani files. You also said he admitted the laptop was his. That seems pretty obvious. I’m not sure that’s ever been the question.

But you went on to claim that he was also admitting the contents are genuine.

That is dishonest. It isn’t true to my knowledge nor based on anything you’ve said in response. That’s why I asked. Because I never saw anything to support such a conclusion. And in response to my asking you went on a rant trying to change the subject.
He hasn’t admitted that “the contents are genuine”. That isn’t true. And in response to allegations based on those “contents” he denied them. He’s a recovering druggie fuckup with an IRS case.

Other ‘facts’ the unserious twat doesn’t want to deal with.

Multiple news agencies have looked at the 125,000 emails copied onto a ‘backup’ by the repair shop and peddled to the media by Rudy. The real numbers vary by which outlet but the absolute most they can ‘forensically’ verify as unaltered is 22,000. Getting to this conclusion took months of IT work on the part of the news networks and was reported well after the election.

So that means this, allegedly genuine copy, the media didn’t want to rush into reporting on holds over 100k emails that were somehow in the absence of all ways computers work, stripped of meta data and subhead data and server transfer protocol data as a natural process of being ‘backed up.’

If you’re playing at home, that suggests a strong likelihood that the hard drive Rudy was holding is a fake infused with some genuine, potential illegally hacked, files and a lot of garbage files.

Twat and the right wing media do not want their audience to ponder why the ‘mainstream’ media didn’t jump on a story in the three weeks until Election Day without being able to verify it from a known liar under federal investigation ALSO a campaign official for Donald Trump. ‘Just trust me. I’m America’s mayor nine eleven. This guy gave me a laptop and I printed some things and you have my word on it it’s really Hunter Biden’s but no I won’t give you the raw files on say a thumb drive so your IT experts can do even the most cursory examination. You have a printout. What more do you need to run the biggest story of your lives? Literally, bigger than Al Queda. Bigger than the moon landing. This story!”

You’ll probably notice in all the stories of ‘the laptop is verified’ some version of ‘thousands of emails’ gets used but not a single one of them mentions the hundred thousand that could not be. This is how incredible dumbasses like our Unserious Twat have come to believe that nothing at all about this is fishy and if the media didn’t cover it up we’d all be speaking Trans Hate under second term president Trump right now.

They also have no evidence that anyone ‘leaned on’ Facebook to suppress although they insist it’s a ‘fact’ other than the now famous image of Hunter. News flash, it is illegal to publish personal photos of ANYONE without their consent, see ‘The Fappening.’ When the campaign made the request to Facebook, the legal department of the tech giant would have said, “Yeah, letting people pass around this photo of dope smoking Hunter in the bathtub on our platform very much makes us the target of litigation.” (I know the Twat here is going to link to tons of opinion pieces and NY Post/Fox/National Review articles to ‘prove ‘ that what they are convinced happened happened. There is no evidence of it happening. ‘SHADOWBANNED BY ZUCKERBERG!’)

As to why the FBI doesn’t release, the Twat is asking why the FBI doesn’t always release evidence in an ongoing investigation like he’s totally new to this whole investigative technique thing.

Twat’s been at this same dead horse since October 2020.

@102 Giuliani can’t practice law in New York or D.C. That’s rather more than “discredited.”

Technically, he’s suspended pending disciplinary proceedings, not disbarred. The New York order reads,

“We conclude that respondent’s conduct immediately threatens the public interest and warrants interim suspension from the practice of law, pending further proceedings before the Attorney Grievance Committee (sometimes AGC or Committee).”

    https://www.nycourts.gov/reporter/3dseries/2021/2021_04086.htm

The D.C. suspension is a reciprocal suspension based on the New York order; i.e., suspension by one licensing authority triggers automatic suspension by other licensing authorities, where an attorney holds multiple licenses.

    https://lawandcrime.com/high-profile/washington-d-c-court-of-appeals-suspends-rudy-giulianis-law-license/

An interim suspension takes effect immediately in order to protect the public. Disbarment requires due process, which takes longer. New York’s licensing authority having found “uncontroverted evidence that respondent communicated demonstrably false and misleading statements to courts,” Giuliani’s disbarment status is equivalent to Amazon’s “out for delivery.”

Except that we now know that ‘copied’ hard drive had at least 100K emails that were stripped of authenticating meta data, again in absence of how creating a backup actually works.

Which is just the tip of the iceberg about how John Paul Mac Isaac’s story about how he simply made a copy of the hard drive and then eventually passed it to Rudy starts to fall apart.

“The experts found the data had been repeatedly accessed and copied by people other than Hunter Biden over nearly three years,” our report explained, with those we spoke with being unable to “reach definitive conclusions about the contents as a whole, including whether all of it originated from a single computer or could have been assembled from files from multiple computers and put on the portable drive.”

    For example:

“[An expert] also found records on the drive that indicated someone may have accessed the drive from a West Coast location in October 2020, little more than a week after the first New York Post stories on Hunter Biden’s laptop appeared.”
“Over the next few days, somebody created three additional folders on the drive, titled, ‘Mail,’ ‘Salacious Pics Package’ and ‘Big Guy File’ — an apparent reference to Joe Biden.”

That points to the drive being altered literally while it was in Rudy’s possession. Now Rudy we know is a crappy attorney, recommended for disbarment by DC Bar Council, but surely he knows a thing or three about chain of custody. Or maybe he doesn’t. Maybe he really is that much of a fuck up. (It’s also entirely possible that the laptop investigation the FBI has confirmed is ongoing centers on Rudy and his Ukrainian friends trying to do all kinds of illegal shit by planting evidence.)

ONLY the genuine laptop would be useful to make a criminal case and ONLY if no one can find any evidence it was altered either remotely by any hacking activity OR Mac Isaac while it was out of Hunter Biden’s custody. At this point that seems like a pretty tall order.

Then there’s his story that the computer kept shutting down so THAT’S why Mac Isaac started to take individual files and folders and copy them to “jigsaw” a backup. Seriously? You have a macbook that was never claimed and you run a computer repair shop. A macbook malfunctioning that badly is either:

    A – Stripped for parts
B – Wiped, has OS Mojave reinstalled and tested to see if it can be sold as ‘refurbished’.
    C – Landfill.

This guy’s story is in his spare time he manually ‘backed up’ folder by folder, file by file, this laptop and in the process ‘stumbled on’ files he found disturbing.

Sure. Totally plausible. He wrote a book. That’s what he claimed.

but surely he knows a thing or three about chain of custody.

    I have grave doubts.

It may be that at one time in his career Rudy had a working understanding of criminal procedure and the federal rules of evidence. But I think he’s a functional alcoholic who has suffered from a few decades of the ravages of that disease. I think he operates on instinct now. And his instincts are limited.

He’s not great with technology, full stop. This is a guy who made people print out his emails and only later in life forced himself to struggle with smart phone technology so he wouldn’t be left out and so he could surf Tik Tok porn. He famously burns through phones because he forgets his passwords. And of course, butt dials insurrection conspiracies.

As someone of his generation, and like his former client, he is probably mystified by the declining authority of “documents” in the digital world where he actually lives. So I would assume that he fully expected news rooms to accept his email printouts as having some kind of genuine authority, simply as paper documents. I guarantee you he does not know what “full headers” are. And wouldn’t be able to respond if asked.

And all that may explain why this ridiculously inept and comic episode from ultra MAGA world has traction with people of a certain age, like the Shit-lord failure. That sad fool probably feels a sincere sense of righteous outrage that reputable news agencies refused to run with Rudy’s mad, spittle-flecked ravings about THE BIDEN CRIME FAMILY. These are, after all, the same people who placed so much importance in state issued souvenirs like BiRF CeRTifIKiTs that they found themselves denying that Hawaii was part of the United States. These are people who refuse to make purchases online through a 128 bit encrypted website. Yet simultaneously think nothing at all with paying for a bar tab by leaving behind a “document” that contains their name, address, phone number, social security number, bank routing number, bank account number, and exact original of their signature, having zeroed out the tip line on the bill.

This is our system in crisis I suppose. People rise to a certain status of authority and influence, despite having stopped tracking some of the most important changes going on around them. Their authority provides them with the ability to delegate around their incompetence. And their influence helps them to maintain the authority even as their performance declines because of that incompetence. But as with these people, the crisis will also pass in time.

Just to point out, Trump has repeatedly stated that any Jewish person who doesn’t support Israel or him is “disloyal” and George Santos raised money on kickstaretr using a Jewish-sounding alias because “the Jews will give more if you’re a Jew.” And Marjorie Taylor Greene appearing at that conference with Nick Fuentes who later last year said “I want this country to have Catholic media, Catholic Hollywood, Catholic government. I want this to be a Catholic occupied government, not a Jewish occupied government.”
