Having now received criminal referrals from a number of state’s AGs, the DOJ has now confirmed that it is reviewing those referrals with respect to potential criminal prosecutions against the Trumpaloompas in seven states who prepared, signed, and submitted faked election certificates declaring Fat Orange Guy the winner in their respective states.
This will cause the various state prosecutions (but not any state investigations) to go into a holding pattern while DOJ has a deep think. I’m skeptical that DOJ will move forward. And if they are inclined to do so they must move faster than they are accustomed to with an election looming in November.
However, though some suggest that the department would not invest the institutional capital to bring a misdemeanor case, I think 18 USC 595 is the most likely charge they can make stick. Moving forward with indictments means they will also bring additional charges that might include felonies, such as false statement violations and conspiracy to defraud.
But if they decide to bring it, they’ll get plea deals for 18 USC 595, election interference. And they’ll seek sentences close to the max. Which I think is probably fair and just, given the circumstances. It seems like most of these people are minor pawns who got way out over their skis. They are truly the closest things we’ve seen to Bob’s “cosplaying grandmothers”.

In practical terms, though, a market that drops 10% and then bounces right back (i.e., in the next day or two) should more properly be considered a dip, in my view. In any case, Bob started crowing about a “correction” when Nasdaq dropped 13%, but as I pointed out, Nasdaq isn’t “the market,” it’s only one sector of the market.
Specifically, Nasdaq is the tech sector. Traders and investors piled into tech stocks over the last couple years, and pushed their valuations sky-high, so they were vulnerable to a pullback. Tech stocks also are vulnerable to rising interest rates. Now factor in that the Fed has been inflating stock values, and now it’s a no-brainer that when Fed policy shifts from inflating asset values to tamping down inflation, you’re gonna get a tech sector correction. In fact, anticipating this, investors began rotating from “growth” (tech) to “value” (not tech) last fall.
The rest of the market is overvalued, too. The Fed created trillions of dollars out of thin air that was funneled into the economy via the financial markets, and a lot of it stuck to stocks and never left the financial markets. So every sector, and nearly every stock, is artificially overvalued, just not by as much outside the tech sector.
Despite that, the market has failed or refused (whichever terminology you prefer) to correct, for a couple reasons: There’s no place else for money to go where it can earn anything (TINA, or “there is no alternative” to stocks), and investors have relied on the Fed backstopping the stock market (i.e., it won’t let the market go down, as demonstrated in 2018). That, of course, didn’t prevent short-lived, sometimes sharp but always short-lived, declines. It’s been said that investors became “trained” to buy these dips. In fact, “buy the dip” became a mantra.
Of course, investors realize the Fed’s commitment toward backstopping stocks won’t be quite as strong, and may even mostly dissipate, going forward. So it’s perfectly logical to think this time is different, that declines can now become corrections instead of dips. Readers of financial information are being told this by the financial media, including Barrons magazine, which Bob claims to read and may be where he got his idea of an impending 10% – 15% correction from, as they have quoted Wall Street figures who’ve thrown out estimates in that range. But who says the market has to make sense?
In purely functional terms, if the market goes down 10%, 15%, 20% — in my mind, the percentage doesn’t matter — and then rebounds, it’s not a correction, it’s a dip. Traders and investors have been indoctrinated to buy the dips, and it sure as hell looks like they’re buying this one, whether you call it a correction or a dip, because this decline doesn’t want to stick around. We’ve seen the DJIA drop 1000 points only to come all the way back and then some a couple hours later. That’s not a correction, in my book. A correction is when stock prices reset, because of fundamentals, or internal market stresses, or some external event, or whatever. A $60 stock going down to $50 and then bouncing back up to $58, $59, or $60 the same day or next day isn’t a reset, it’s a dip.
This market doesn’t want to go down.
The forces keeping it up are largely still there. Adding to that is you probably now have money fleeing Europe into the relative safety of American stocks. I suspect a lot of cash has crossed the Atlantic Ocean in the last week or so. American investors may well be selling stocks, but European investors are stepping in and picking up the slack. That’s my guess, or one of my guesses, and yes I am guessing, because I don’t know anything. Neither does Bob, he’s guessing, too.
He may get his correction. This might not be a dip. Maybe this time is different. It ought to be, because the Fed tooth fairy is on the verge of vanishing into a cloud of tinkling pixie dust, or so we’re led to believe. But ought has nothing to do with it, where the stock market is concerned. It’s very likely that investors who’ve become numbed and acclimatized to overpaying for stocks, because they have no choice, aren’t going to wait for a 15% decline, they’re gonna hungrily feast on a 5% to 10% decline.
We’re already seeing that happen.

A case? Gratz v Bollinger comes to mind. A black woman might not have voted as Breyer did. Probably not. As idiots at The Federalist are so eager to point out, there are not a great many African American Women working as lawyers.
It’s a hostile industry with barriers to entry in many places. A black woman lawyer who doesn’t want to work in criminal prosecution or criminal defense or government has few other opportunities. White women lawyers often find a natural client constituency in other women, and in woman owned businesses. But that acknowledgement is not extended to black women as lawyers. So a highly accomplished and successful black woman lawyer might see the issue very differently than a white man like Breyer.
Would not have changed the outcome holding in Gratz. But it would have changed the vote, the dissent, and the decision as published. The admissions programs would still have been removed. But their influence would have been more limited.
And future cases involving a future court with a different makeup could produce very different results with this new judge when compared to Breyer.

Last week we saw two consecutive days when the DJIA dropped ~1000 points only to recover by the end of the day. Today the market looks set to close up ~500 points, given a boost by Apple’s earnings.

4 years ago, 3M was $260. I started buying it on the downslide at $187 and have an average cost basis of $181. It’s a business working through some issues. I’ve been buying it while it’s down.
Meanwhile, not only hasn’t 3M cut its dividend, it has continued with steadily raising it, and also buying back shares. As a manufacturing stock, it serves a diversification function in my portfolio. And me being diversified, it’s less than 4% of the portfolio. It’s a small bet on a blue chip; not, say, a big bet on a bird-in-the-bush option trade.
I don’t have to defend this blue-chip stock, or owning it. It doesn’t need defending, it stands on its own. Here’s a suggestion: Why don’t you draw a cardboard sign that says “3M is a POS stock,” set up a folding chair outside the NYSE building, and see what feedback you get from people who know more about this than you do.
Don’t get me wrong, I’m not recommending you buy 3M at $163 or any other price, although I might add more to my own portfolio, as I’m a still little light in the industrials sector (my other manufacturing stock is Lockheed, which I bought for 86 bucks; I’m most weighted in consumer staples and health care stocks).
