The unstoppable democratizing force of new media technology

(©2006 TVW. View full source here.)

About an hour ago I received an email from YouTube informing me that at TVW’s request, they had pulled my clip of Dave Reichert talking about his intent to cut Medicare. I am in the process of filing a counter notice, and fully intend to defend my rights under the law.

But as you can see, it didn’t take me very long to upload the clip to another service. TVW is free to request LiveLeak pull this clip too, but there are plenty more video serving services where they came from—not to mention the technical ability to serve the clip myself—and I’m happy to play this game at least as long as TVW. Nothing will stop me from presenting Reichert’s own damning words to the public, short of a court order. (And perhaps, not even that.)

As I told TVW President and CEO Greg Lane yesterday, I will be happy to use TVW’s own embedded player with a time sequence parameter, once they make it available… but I’m not willing to wait. There are several fundamental issues at stake here, not the least of which being my Constitutional right to political speech, and a defense of the fair use exemption, one of the principle tools that make news reporting and commentary possible.

Had Mr. Lane contacted me before contacting YouTube, this confrontation might have been avoided. With a mutually acceptable technical compromise in the offing, it would be a shame to escalate this dispute any further… but that decision is now solely in the hands of TVW.

    spews:

What exactly do they mean by “time sequence parameter?” That you could set a clip to start at a certain point or a user could easily fast forward to a certain point if instructed?

Because, the embeddable flash player they were using last fall had the second feature.

  2. 2

    spews:

They could take forever to provide the technical fix they suggested.

If they want to play whack a mole, they’re going to be pretty busy given there are hundreds of video sharing sites out there these days.

When we win in November, we can imprison all the neocons and their supporters, confiscate their property and send their kids to reeducation camps.

The FCC will revoke the license of FOX news and that will stop anyone from being able to question us.

    The Real Mark spews:

    Goldy,

What are you afraid of? Having to present the clip in context?

Didn’t you and Darcy already get called on the carpet for this kind of smear stunt two years ago?

    Blue John spews:

@3. What you are doing is called “Projection” Where you project on your enemies, what you wish you could do yourself, or want to do yourself. Let me translate:” If only we could get rid of all those pesky bogs that deal with things like ‘facts’ and ‘reality’ and all media that isn’t Fox News, everything would be right in the world.”

    ArtFart spews:

    Goldy,

The player TVW is referring to is probably Flowplayer, an open-source embeddable Flash media player available from the “flowplayer.org” web site. I took a quick peek at the documentation, and the scripting options specifically include seeking to a specified time in a media file and playing it starting from that point.

    Steve spews:

@3 Hmm, we should put their kids in the homes of decent people (anybody but a Republican) so they have a chance to get their young minds right.

    Here’s some new news:

Obama’s VP Search Advisor James Johnson
    Resigns Amid Countrywide Scandal Allegations

    Obama can sure pick ‘em!

One wonders when Eric Holder, a participant in the shady Clinton pardons, will resign…

“The American people have reason to question the judgment of a candidate who has shown he will only make the right call when under pressure from news media.”

Should we impregnate all their women so those women have a chance at raising some decent kids?

  10. 12

    spews:

re 5: In what context is it OK to cut Medicaid? And, if you can think of one, is that the context in which Reichert made his statement or just the ‘excuse frame’ you dreamed up?

  11. 14

    spews:

re 6: Define your terms and give examples — especially of the ‘pesky bogs’. Is that the place in England where they found the preserved bodies of the Medeival oafs? Do you feel a kinship with Medeival oafs?

    You should.

  12. 15

    The Real Mark spews:

    Witless Lucy @ 12

Ya know what? I should’ve re-listened to that clip before posting the context comment. It IS in context.

Reichert isn’t proposing some wholesale cut in Medicaid. What he said was that they needed examine government waste (0:17 to 0:22). He then goes on to mention Medicaid and other “big programs,” where cutting a given percentage of waste / fraud would give you “more bang for your buck.”

So, Goldy, your original post is full of crap.

  13. 16

    Roger Rabbit spews:

@5 So are we to understand that in your crazy wingnut world posting a recording of Reichert speaking in his own words is smearing him?

  14. 19

    Roger Rabbit spews:

@15 I consider the $2 trillion you Republican numbnuts spent on your recreational war in Iraq to be pure “waste.” If you’re hot to cut government waste, start with that waste.

  15. 20

    The Real Mark spews:

    Roadkill @ 16

When Darcy (with Goldy’s help) pulled that Reichert quote totally out of context in the 2006 ad that was debunked on KING5(?) news.

  16. 21

    YLB spews:

To a wingnut any money NOT spent on jailing people or making war on people is “waste”.

Sheriff Hairspray has a special fondness for the former but is sufficiently enthusiastic for the latter as well.

  17. 22

    YLB spews:

And of course the grand enterprise of jailing and making war presents many opportunities for skimming profits for the right people with the right connections.

  18. 25

    The Real Mark spews:

    MLF @ 24

What the hell are you talking about? Goldy is the one posting the BS mischaracterization of Reichert’s comments. If you’re going to make comments like that, put some facts behind ‘em or shut up.

  19. 28

    spews:

re 15: Why are you so diligent about saving millions on Medicaid, but you are not bothered in the least by the squandering of trillions in Iraq?

    You are a traitor.

  20. 31

    spews:

re 29: Thanks for the admission that being unethical sounds Republican. Or are you dyslexic, also — like Blueballs John.

Oh, sorry Blueballs. But I guess I’m as ‘dyslexic’ as you are.

  21. 33

    My Left Foot spews:

    Mark at 25:

    Dear Dumbass:

The principle here is the use of the tape, stupid. It is not really what Reichert said, it that he said it and Goldy used it. Goldy did not edit the tape and insert words for Reichert. He used a short, CONTINUOUS piece of the speech to illustrate a point. It is fair use, it is political speech. Context is for the viewer or reader to discern, not some political hack who does not like the reference.

Just because you don’t like the result does not mean get to change the rules of free speech, political speech or fair use.

Now go fuck yourself, you unprincipled fuck.

  22. 36

    The Real Mark spews:

    MLF @ 33 & michael @ 35,

If Goldy hadn’t put up the post with his gross mischaracterization, the fair use issue would be moot. I would bet that TVW is worried that Goldy will try to pull more smears like (he and?) the Darcy campaign did in 2006.

    STFU, Kool-Aid Kids.

  23. 37

    YLB spews:

It’s no mischaracterization. Medicare/Medicaid and Social Security are run with a tiny bit of overhead that puts any private insurance company to shame. Fraud committed by doctors and others have been effectively squeezed out over the years.

Sheriff Hairspray playing to the wingnut crowd wants to cut into the bone no doubt. Anything can be sacrificed on the holy altar of tax cuts for the rich.

  24. 38

    spews:

    TRM @36,

I put up Reichert, in his own words. 38 seconds of contiguous video of Reichert talking frankly to fellow Republicans what his budget cutting agenda would be during a non-election year, based on the assumption that the Republicans would still be in control.

You are free to come up with your own interpretation of what Reichert really meant, but me, I’d rather folks have a convenient way to hear Reichert speak for himself. And if folks fear, that somehow I’ve taken those 38 seconds out of context, they can always link to the source video and watch the whole damn thing for themselves, just the way TVW wants them to do.

  25. 39

    My Left Foot spews:

    36:

So Goldy’s words are a “gross mis-characterization”? The tape is fine, but the written word could confuse someone? Whose fault would that be?

This is like you and your Hustler magazine. You have the choice to read the articles or look at the pictures. Everyone here has the choice too. You can see what Reichert said in the original video and/or you can read the article.

Who you gonna believe, asshole, me or your lyin’ eyes?

Do you honestly think people are not smart enough to deduce the truth? Or, MORE LIKELY, you are concerned that the truth is EXACTLY what they will come to?

TRM, come back when you find your principles. Hell, come back when you find just one.

  26. 40

    Puddybud spews:

Yes clueless idiot: we pay from our taxes for all the 62000+ social security peeps working in the department along with the 10 regional offices, 8 processing centers, approximately 1300 field offices, and 37 Teleservice Centers. That’s why it only uses ~1% of incoming revenues. If they averaged 50K per person = $3,100,000,000 in salaries add 30% for benefits $4,030,000,000. Then how much all those buildings cost to operate?

    What a moron!

  27. 41

    Puddybud spews:

Carl Left Foot Grossman: You mean Teresa lets you read Hustler? Isn’t that excitement bad for the heart? How is Chester the Molester doing these days?

    Waaaaa haaaa haaaa haaaa haaaa

  28. 42

    My Left Foot spews:

    36: con’t….

If Goldy is, as all you trolls continue to scream, an insignificant blip on the WA political scene, hows come (colloquial expression) y’all are so eager to stop him?

    I’m just sayin’……

  29. 43

    YLB spews:

40 – Yep, modest overhead compared to monies being managed. Nobody ever gets rich working for SS unlike the CEOs of some insurance companies with compensation+stock sometimes exceeding a billion dollars.

According to Sheriff Hairspray, anything, anything (except military) must be cut to save tax cuts for people like the greedy CEO of United Health Care.

Thanks for helping me make my point.

  30. 46

    cmiklich spews:

What an absolute hypocrite @sswipe you are Goldstein!

You b!tch about the rule of law for George Bush but sociopathologically feel no guilt about STEALING other people’s rights.

    What a P.O.S.

    What a liberal.

    What a democrat.

    Yes, those ARE insults.

  31. 49

    spews:

I am a Libertarian that agrees with Ron Paul when he said these medical programs are the LAST thing we should go after.

We have created such an imbalance in the economy that pulling these types of programs would be as heartless as, well, as a neocon (and that’s pretty bad)

We give Millions in tax cuts and subsidies to big business/corporations in Washington.

IF you want to save easy money, DAVE, do so by cutting the individuals that are NOT actually individuals. Namely corporations.

Thanks for posting this video and what can we do to support individual bloggers rights to do the exact same thing the news does???

Do you now which parties, (D), (R), (L), (G) etc support your rights?
