    @1 William Jackson Marion was hanged in 1887 for the purported murder of fellow railroad worker John Cameron in 1872 or 1873; Cameron turned up alive in 1891.

    Charles Hudspeth was hanged in 1892 for the purported murder of George Watkins in 1887. Hudspeth’s lawyer claimed he found Watkins alive in 1893, although this is disputed.

    There have been a number of dubious convictions resulting in executions and posthumous pardons, typically involving black persons.

    The state most likely to execute an innocent person is Texas.

    Texas still leads nation in exonerations

    The Texas Tribune reported that Texas currently leads the nation in exonerations, despite fewer drug defendants being exonerated recently. Beyond that, Harris County led the nation in exonerations in 2017.

    In fact, Texas is among 33 states which provide some restitution for the exonerated. It offers individuals who were exonerated and released $80,000 per wrongly imprisoned year, plus an annuity and some reintegration and financial assistance as well as legal fees and missed child support payments.

    With an average of 5.69 years lost per exonerated person in Texas, the state’s payment averages almost half a million dollars for each person exonerated. In 2018, Texas exonerated 16 cases, which means the state paid out approximately $7 million in that year alone.

    The Texas data is from 2018. Earlier in that decade a Texas effort was made to retrospectively evaluate cases and select for possible exoneration. 48% of those were drug cases. A lot of the time the drugs weren’t really drugs.

    Nowadays there are fewer exonerations in Texas because the easily proven (test the cocaine for presence of cocaine, howzabout?) wrongful convictions have been found and removed from the database.
