    I don’t think it best serves the interests of justice to offer Trump a negotiated plea with minimal to zero time served. This is for three big reasons.

    The first would be the precedent it may set. Many similarly situated defendants have been plead and sentenced to very similar violations of the same statutes. They ALL got real time. Years, not months. We do not have different justice for ex-presidents. Nor should we.

    The second is the obstruction, which Trump now admits to, but with a special “golf shirts” excuse. That should always be a deal escalator down. Arrogant fuckwits who tell themselves they can lie, destroy, conceal, and otherwise out maneuver law enforcement are never not a problem. But obviously any ex-president in control of an entire major political party and half of Congress is a much bigger challenge to the rule of law. And those prolonged and determined efforts to thwart the law must be viewed in that light. It’s beyond Nixonian. Nixon after all, agreed to step down and go into seclusion in California.

    The third reason is really Trump himself. I don’t think he will EVER sincerely accept his own personal culpability for what he has done and what he is now putting the country through. It is insane to pretend, that even if his attorneys and advisors could convince him to take a no-time deal, he would not immediately repudiate such a deal and attack the government, the court, and even his own lawyers for convincing him to save himself. The system should never tolerate that kind of abuse from those who are guilty by their own admission (Mike Flynn, POS).

    But that still leaves us to struggle with how this cruelly prolonged Republican criminal debacle affects the nation politically, at a politically perilous time in our history. If Trump could be made to give a detailed allocution, listing his own specific criminally offensive conduct and expressing his sincere understanding of and remorse for the direct and substantial harm he has done to the United States, and if that allocution as entered into the record could be published, then I think it might be better to offer a short-time deal, less than two years.

    He’s prevented from running, and we can put the orange pig in the rearview mirror forever.

A dividend cut isn’t his idea; Barrons has an article this weekend, which I read today and he probably saw yesterday, predicting a dividend cut after a couple more quarters. 3M’s current yield is about 6%, more than double its historic yield, so cutting the dividend by half would take the yield back to its average given a constant stock price.

    The Barrons article cited a couple of analysts who suggested the stock might have 5% to 10% of short-term downside. The fundamentals already were in a trough before this settlement, but Value Line projects a cyclical recovery beginning next year, with sales, cash flow, EPS, and book value all trending upward. If the settlement Bob is crowing about costs ~$1.00 off EPS, the company can afford it. A dividend cut to conserve cash would have more to do with other factors.

    Meanwhile, for now, 3M stock has a fraction of the volatility of, say, Tesla’s stock.

    3M will have to tender legal payments of just under $1 billion per year. It really can’t afford another major settlement, and we don’t think the firm may have a choice in that matter, between its Combat Arms suit and lingering PFAS liabilities. If legal payments eventually total over $2 billion, we think the math would become too difficult without a cut, particularly without the contribution from healthcare. Either way, 3M’s risk/reward isn’t too attractive at current prices.
